HomeMy Public PortalAbout1997/02/03 A Special Meeting of the Mayor and Council of the Borough ofCarteret was called to order by Mayor Peter J. Sica on Monday, February 3, 1997 at 7:00 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll call vote, the following were noted present: Councilmember Deborah Bialowarczuk " John P. DuPont " James Failace " Jack Fazekas " William Feingold " Stanley Gutowski The Clerk stated that on January 30, 1997, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News & Tribune and posted on the bulletin board. To make 1997 Appointments and any other business that may come before the Council. RESOLUTION #97-41 was introduced by the Mayor and was referred to the Council for action Councilmember Gutowski said he would like to place the name of Craig Coughlin, Esq. Upon MMS&C, by Council members Fazekas and Gutowski RESOLUTION #97-41 "APPOINTING BOROUGH ATTORNEY IN THE BOROUGH OF CARTERET" was adopted. Upon individual roll call vote, Councilmembers DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. Councilmember Bialowarczuk voted no. 1 FEBRUARY 3, 1997 SPECIAL NEETING ROLL CALL STATlllENT OF ~IEETING NOTICE PURPOSE RESOLUTION #97-41 Appointing Borough Attorney - Craig J. Coughlin Adopted FEBRUARY 3, 1997 Corrrnents Councilmember Bialowarczuk asked if this was the same gentleman that we gave the part ofthe arbitration on? Councilmember Gutowski said it is the same person. Councilmember Bialowarczuk said she had a problem with that. At the time she voted yes for this gentleman for the arbitration of the police contracts. She didn't know at that time, they didn't let us know at that time, that they were giving both of these to the same gentleman. This bothers her. If she had known something like that, she would have stayed a crossing guard and taken two salaries from the Borough ofCarteret also. There is something wrong with this. We started off by paying him $5,000.00. Mr. Danser, by the time he was done, got $60,000.00. In other words, we are going to pay him as the Borough Attorney, but we are also going to keep paying him to arbitrate the Policemen's contract. How much money is this man going to make? There really is something wrong with this. She doesn't think this was a good idea. She thinks the people in town should know that this man is going to be making a ton of money. Councilmember Fazekas said "a ton". Councilmember Bialowarczuk said Mr. Danser made $60,000.00, Jack. Now this man is going to make a Borough Attorney's salary plus we are going to pay him on top ofthis to arbitrate the contract. Councilmember Failace said as we have paid Bob (Hedesh) in the past when he was Borough Attorney. Councilmember Bialowarczuk said he (Bob Hedesh) didn't arbitrate any contracts. Look it up. At this point everyone was talking at once. Mayor Sica said Ms. Bialowarczuk has a point and he asked them not to interrupt. Councilmember Bialowarczuk continued and said she didn't think it was right for the people of this town that one man should be drawing two salaries. Especially on a Policemen's contract that could end up in arbitration for two years or 2V2 years like the last time around. She doesn't think they should be paying somebody that amount of money, plus the salary as the Borough Attorney. It's not right. She voted no. Councilmember Failace said Borough Attorneys have done other litigations and have been paid $5,000 for this and $2,000 for that, upwards of L $100,000.00 in the past. He sees no difference in this. This guy is very, very good. He voted yes. RESOLUTION #97-42 was introduced by the Mayor and was referred to the Council for action. Councilmember Gutowski said he would like to submit the name ofRemy Quinones, Esq. Upon MMS&C, by Councilmembers Fazekas and Failace RESOLUTION #97-42 "APPOINTING BOROUGH PROSECUTOR IN THE BOROUGH OF CARTERET" was adopted. Upon individual roll call vote, Councilmembers DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. Councilmember Bialowarczuk voted no. The Clerk said she had been asked if she could swear in the Borough Attorney and Prosecutor. Mayor Sica said usually they are sworn in the next day at City Hall. If they want to get sworn in tonight, it's okay with him Municipal Clerk Barney swore in Craig Coughlin, Esq. as the Borough Attorney of the Borough ofCarteret. Municipal Clerk Barney swore in Remy Quinones, Esq. as the Municipal Prosecutor in the Borough of Carteret. The following appointments were made February 3, 1997 by the Council: OFFICE Board of Adjustment APPOINTEE TERM EXPIRES Adrian "Chip" Cece 12/3 1/97 Councilmembers Failace and Fazekas moved to confirm the appointment. Upon individual roll call vote, Councilmembers DuPont, Failace, Fazekas, and Gutowski voted in the affirmative. Councilmembers Bialowarczuk and Feingold voted no. The appointment was confirmed. Board of Adjustment James Mancuso 12/31/00 3 Councilmembers Failace and DuPont moved to confirm the appointment. Upon individual roll call vote, Councilmembers DuPont, Failace, Fazekas and Gutowski voted in the affirmative. Councilmembers Bialowarczuk and Feingold voted no. The appointment was confirmed. Upon individual roll call vote, Councilmembers DuPont, Failace, Fazekas and Gutowski voted in the affirmative. Councilmembers Bialowarczuk and Feingold voted no. The appointment was confirmed. Confirmed Board of Adjustment Alternate #2 John Riggio 12/3 1/97 Councilmembers Fazekas and DuPont moved to confirm the appointment. Upon individual roll call vote, Councilmembers DuPont, Failace, Fazekas and Gutowski voted in the affirmative. Councilmembers Bialowarczuk and Feingold voted no. The appointment was confirmed. Confinned Local Assistance Board James O'Brien 12/31/00 Councilmembers Gutowski and Failace moved to confirm the appointment. Upon individual roll call vote, Councilmembers DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. Councilmember Bialowarczuk voted no. The appointment was confirmed. Confirmed Board of Health Yolanda Delgado 12/31/00 Councilmembers Gutowski and Fazekas moved to confirm the appointment. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. The appointment was confirmed. Confirmed Board of Health Dr. Theodore Chenkin 12/31/00 Councilmembers Failace and Fazekas moved to confirm the appointment. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. The appointment was confirmed.
