ORDINANCE 1990-170 1
AN ORDINANCE AMENDING ORDINANCE NO. 73 OF THE MUNICIPAL CODE OF TIFFIN,
IOWA, SAID ORDINANCE ESTABLISHING RATES FOR SERVICE, CHARGES FOR THE
COLLECTION OF GARBAGE AND PROVIDING FOR THE COLLECTION OF GARBAGE WITHIN
THE CITY OF TIFFIN BY CONTRACT WITH ONE OR MORE PRIVATE COLLECTORS.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
SECTION I. Purpose. The purpose of this Ordinance is to amend the
present City of Tiffin Ordinance No. 73 so as to establish a rate for
the collection of garbage within the City of Tiffin.
SECTION II. Amendment. Section 3 of Ordinance No. 73 and
ordinance No. 121 of the City of Tiffin Ordinances is hereby repealed
and the following Section 3 hereby substituted in lieu thereof:
SECTION 3: Rates and Charges. The rate of charge for each
occupied dwelling unit shall be determined by the city council' and shall
be collected on a monthly basis. For those individual landowners of the
City of Tiffin ' who are over the age of sixty-two, the rate on their
homestead shall be reduced by one-half, upon application being made to
the City at the City Hall, provided there is no more than one person
under the age of sixty-two i-esiding with the landowner.
Statements for garbage collection services will be sent to the
landowner in whose name the sewage bill is listed upon the town `sewer
records. Unoccupied dwelling units will not be charged for garbage
collection providing notice of vacancy of a dwelling unit has been given
to the City. Payment of the above charges shall be paid on the
fifteenth of the month for each monthly billing period. Any charge not
paid when due shall become 'a lien on the property served by the garbage
collection system and shall be collected in the same manner as other
taxes.
Effective December 1, 1990, the charge for each dwelling unit
described above shall be $4.20 per month or $2. 10 per month for those
over sixty-two years of age who qualify for half price service.
SECTION III. Repealer. All ordinances, or parts of ordinances, in
conflict with the revisions of this ordinance are hereby repealed.

SECTION IV. Severability. If any section, provision or part of
this ordinance shall be adjudged invalid or uncbnstitutional, such
adjudication shall not affect the ordinance as a whole, or any section,
provision or part therebf not adjudged invalid or unconstitutional.
SECTION V. When Effective. This ordinance shall be in effect
after its final passage, approval and publication as provided by law.

On roll call vote Councilman Stoner , SlsymekerL Morgan,
Brown , Bartels voted "Aye".
Councilman voted "Nay". Mayor declared motion
carried.
Councilman Bartels then moved that the rule or law requiring
three readings of this ordinahce on three different dates be dispensed
with. Seconded by Councilman SlaYmaker . On roll call Note
Councilman Stoner, Slaymaker, Morgan , Brown , Bartels
voted "Aye. "
Councilman . voted "Nay".

ordinance, seconded by Councilman Brown'f . On roll call vote

The Mayor then declared Ordinance No. 1990-170 duly passed and

The foregoing ordinance entitled AN ORDINANCE AMENDING ORDINANCE
NO. 73 OF THE MUNICIPAL CODE OF TIFFIN, IOWA. SAID ORDINANCE
ESTABLISHING RATES FOR SERVICE, CHARGES FOR THE COLLECTION OF GARBAGE 'AN
PROVIDlNG'FOR THE COLLECTION OF GARBAGE WITHIN THE CITY OF TIFFIN BY
CONTRACT WITH ONE OR MORE PRIVATE COLLECTORS was published on the 17th
day of October, 1990 bv posting copies thereof in three public places
within the limits, two l of which are the mayor's office and the post
office.
