ORDINANCE NO. 1991-172
AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 1979-81 OF THE MUNICIPAL CODE OF
TIFFIN, IOWA BY CHANGING THE USE REGULATIONS OF CERTAIN PROPERTY FROM R-1
(SINGLE-FAMILY RESIDENTIAL) TO C-1 (COMMERCIAL)
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF TIFFIN, IOWA:
SECTION I. Purpose. The purpose of this Ordinance is to amend the present
City of Tiffin Ordinance No. 1979-81 by changing the use classification of the
real estate described in Section II from R-1 (single-family residential) to C-1
(commercial) .
SECTION II. Amendment. The parcel of land hereafter described shall be
zoned as follows:
From R-1 (single-family residential ) to C-1 (commercial )
Beginning to a point 30 feet North and 140 feet West of the intersection of the
North line of Third Street and the West line of Main Street, thence easterly 35
feet parallel to Third Street; thence northerly 60 feet parallel to Main Street;
thence westerly 35 feet parallel to Third Street; thence southerly 60 feet to the
point of beginning.
From R-1 (single-family residential) to C-1 (commercial )
Beginning at a point 90 feet North and 140 feet West of the intersection of North
line of Third Street and West line of Main Street; thence 35 feet East being the
point of beginning and the Northeast corner of GTE lot; thence 14 feet South,
thence 25 feet East; thence 14 feet North; thence 25 feet east to the point of
beginning.
SECTION III. Authorization. The Mayor or other designee of the City
Council of the City of Tiffin is hereby authorized and directed to change the
Zoning Map of the City of Tiffin, Iowa which was duly recorded in Book 19, page
53, of the Records of Johnson County, Iowa, to conform to this amendment upon the
final passage, approval and publication of the ordinance as required by law.
SECTION IV. Certification. The City Clerk is hereby authorized and
directed to certify a copy of this ordinance to the Recorder of Johnson County,
Iowa, upon final passage as provided by law.
SECTION V. Repealer. All ordinances or pats of ordinances, in conflict
with the provisions of this ordinance are hereby repealed.

SECTION VI. Severability. If an section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional , such adjudication shall
not affect the validity of the ordinance as a whole, or any section, provision
of part thereof adjudged invalid or unconstitutional .
SECTION VII. When Effective. This ordinance shall be in effect after its
final passage, approval and publication as provided by law.
Councilman Brown introduced the foregoing ordinance which was then duly
read and considered by the Council . Its adoption was moved by councilman Brown
and seconded by Councilman Stratton. On roll call vote Councilman Bartels,
Brown, Morgan, Stoner and Stratto voted "Aye".
Councilman voted "Nay" .
Councilman Morgan then moved that the rule or law requiring three readings
of this ordinance on three different dates be dispensed with. Seconded by
Councilman Brown. On roll call vote Councilma Bartels, Brown, Morgan, Stoner and
Stratton voted "Aye" . Councilman voted "Nay".
Councilman Brown then moved for final adoption of this ordinance, seconded
by Councilman Stratton. Councilma Bartels, Brown, Morgan, Stoner and Stratton
voted "Aye".

The foregoing ordinance entitled AN ORDINANCE EMENDING ORDINANCE NO. 1979-
81 OF THE MUNICIPAL CODE OF TIFFIN, IOWA BY CHANGING THE USE REGULATIONS OF
CERTAIN PROPERTY FROM R-1 (SINGLE-FAMILY RESIDENTIAL) TO C-1 (COMMERCIAL) was
published on the 20th day of May, 1991 by posting copies thereof in three public
places within the limits, two of which are the mayor's office and the post
office.

above is a true and correct copy of Ordinance No. 1991-172 passed by the City
Council of the City of Tiffin, Iowa, at a regular meeting held on the 8th day of
