Sica at 7:30 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Thursday, February 20,1997. Upon individual roll call, the following were noted present: Councilmember Deborah Bialowarczuk John DuPont James Failace Jack Fazekas William Feingold Stanley Gutowski " " " " " Also noted present was Borough Attorney Craig J. Coughlin. The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Mayor Peter 1. Sica. The Clerk stated that on February 14, 1997, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News & Tribune, The Star Ledger and posted on the bulletin board. This was the night advertised to receive bids for 20 Mobile Home Heating Units and the Mayor called for all bids. Upon MMS&C, by Councilmembers Failace and Gutowski and unanimous affirmative vote of the full Council present, the Clerk was directed to open and read aloud all bids received which were as follows: BIDDER 1. The Clerk stated that Ordinance #97-4 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough of Carteret held on February 6, 1997. It was duly published in The Home News & Tribune on February 11, 1997 with notice that it will be considered for final passage after Public Hearing to be held on February 20, 1997 at approximately 7:30 P.M.. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Upon MMS&C, by Councilmembers Failace and DuPont and unanimous affirmative vote of the full Council present, the Mayor declared the Public Hearing to be open: There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Failace and Bialowarczuk and unanimous affirmative vote of the full Council present. Mayor Sica said yes. Mr. Malek asked how many passengers it holds? Mayor Sica said 29 passengers. Mr. Malek stated that the other bus hasn't got enough room. The Mayornoted that it is much bigger than the ones we've got. We can't get a 40 or 50 passenger bus because we can't drive around in Carteret. It's much bigger. There being no further comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Failace and Bialowarczuk and unanimous affirmative vote of the full Council present. There being no comments or objections to the Resolutions, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Failace and DuPont and unanimous affirmative vote of the full Council present. RESOLUTION #97-66 was introduced by the Mayor and was referred to the Council for action. Upon MMS&C, by Councilmembers Failace and DuPont RESOLUTION #97-66 "AUTHORIZING AMENDMENT TO THE 1997 TEMPORARY BUDGET" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. RESOLUTION #97-67 was introduced by the Mayor and was referred to the Council for action. Upon MMS&C, by Councilmembers Gutowski and Bialowarczuk RESOLUTION #97-67 "RESOLUTION APPROVING THE RENEWAL OF A.B.c. LICENSE NO. 1201-33-027-002, HELD BY FRANCES M. MELNIZEK FOR THE 1996-1997 LICENSE TERM" was tabled. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. Borough Attorney Coughlin asked that the Council consider tabling this resolution. It is unclear from his discussion with the prior Borough Attorney and Sgt. Bennett as to who has possession of the license. Mr. Hedesh believes that it's in the possession of the State and that therefore, we couldn't renew a license that the license holder doesn't have Since there's going to be an instant transfer, he recommends that this be held until the next meeting and then do them simultaneously, not simultaneously, but do one immediately after the other. RESOLUTION #97-69 Amusement Device Licenses Upon MMS&C, by Councilmembers DuPont and Failace RESOLUTION #97-69 "RESOLUTION AUTHORIZING THE ISSUANCE OF A 1997 AMUSEMENT DEVICE LICENSE" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. Upon MMS&C, by Councilmembers Failace and Bialowarczuk RESOLUTION #97-71 "AW ARD OF BID - 29 OR 32 ADULT PASSENGER BUS" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. . Mayor Sica said that it is a 29 or 32 passenger bus, all according to how we configure the handicapped. RESOLUTION #97 -72 was introduced by the Mayor and was referred to the Council for action. Upon MMS&C, By Councilmembers Fazekas and DuPont RESOLUTION #97-72 "PROFESSIONAL SERVICES CONTRACT FOR LEGAL SERVICES" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative RESOLUTION #97-73 was introduced by the Mayor and was referred to the Council for action. Upon MMS&C, by Councilmembers Gutowski and DuPont RESOLUTION #97-73 "PROFESSIONAL SERVICES CONTRACT FOR LEGAL SERVICES" was tabled. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. Borough Attorney Coughlin said that he has received some questions from members of the Council with regard to the process, but moreover, with regard to the possible consequences of the action. He asked that they consider that. He didn't mean to do it in Closed Session. Either this evening or at next week's Agenda Meeting, he would like a chance to talk, to show their concerns with the entire Council. E Mayor Sica said that he doesn't have a problem as long as our time doesn't run out. Borough Attorney CougWin said that it is his understanding that we have 45 days from the date of the decision which was ten (10) days ago. FEBRUARY 20, 1997 Upon MMS&C, by Councilmembers Feingold and Fazekas, all bills appearing on the prepared list, properly audited and signed, were ordered to be paid. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. PAYMENT OF BILLS The Clerk stated that she was in receipt of a resolution ±Tom the Middlesex County Planning Board concerning 1997 Scheduled Meetings and the Official Agenda Meeting Form. Upon MMS&C, by Councilmembers Gutowski and Feingold and unanimous affirmative vote of the full Council present, it was ordered to be received and placed on file. COMMUNICATION Middlesex County Planning Board The Clerk stated that she was in receipt of a Notice of Public Hearing ±Tom PSE&G concerning a hearing to be held March 21, 1997, Trenton, N.J., regarding a Permit Application for New Gas Main Installations in Road Right-of-Ways. Upon MMS&C, by Councilmembers Gutowski and Feingold and unanimous affirmative vote of the full Council present, it was ordered to be received and placed on file. COMMUNICATION PSE&G The Clerk stated that she was in receipt of the following reports: REPORTS Departments Fire - January 1997 Inspection of Buildings - January 1997; Total Estimate Cost of Construction $1,305,672.00; To Treasurer - $20,897.00 Treasurer - January 1997 Upon MMS&C, by Councilmembers Feingold and Fazekas and unanimous affirmative vote of the full Council present, all reports were ordered to be received and placed on file. BUILDINGS AND GROUNDS: Committee Chairperson Bialowarczuk reported that in the last couple of weeks they've been working on the new bank building. New counter tops have been ordered and the new sign has been ordered. Tow or three weeks ago they did have the requisition for the roof but it turned up missing so they have to get all new quotes for the roofing job which is going to se them back a couple of weeks until they get that all done over again. One of the biggest parts of that job now is getting the roof done and the restroom done in compliance. As they progress, she will let everybody know where they are at. As soon as she has a date on the move she will make sure everybody is aware of that too. She reported progress. Standing Comnittees FEBRUARY 20, 1997 Standing eÅ“nittees Continued FINANCE & ADMINISTRATION: Committee Chairperson Failace reported that as they all know, the budget was introduced on February 6, 1997 On February 24, 1997 the paperwork will go down to Trenton in reference to discretionary aid. They will keep their fingers crossed that they will get at least as much as they got last year. They filed the annual debt statement with Trenton and copies are on file with the Municipal Clerk if anybody wants to see it. Committee Chairperson Failace said that they are looking forward to still making some changes if they have to, if they can, when the budget comes back. This is not the final budget. We had to submit it by a certain date, statutorily so. There are still some things that we probably will do when the budget comes back. He reported progress. FIRE: Committee Chairperson Fazekas reported that what they are trying to do this year is some in-house training which would cut down some of our costs. Next week they have a Committee Meeting and they will be reviewing that along with gear for the Volunteers. What they are tying to do is not cut costs, but to try to monopolize some of the people's expertise. This way they won't have to go out for training and maybe we can do some of that inside. Again, as you know, they talked about a fire truck, $500,000.00, $600,000.00 and the Mayor is going to look into that because it's a big expenditure. With that we're moving right along. POLICE: Committee Chairperson DuPont reported that they had their Police Committee Meeting and a couple of topics came up. Obviously, equipment and manpower were the key issues. Our Police Department has started a new program. The Departing of Housing and Urban Development Violent Crimes Office of Investigations and the Carteret Police Department, particularly the Narcotics Bureau have entered into an agreement where the two agencies will work together and develop a plan to address the area of violent crime and narcotics in the housing and (inaudible) areas of Carteret. He thinks it's a good program. It's just starting and thanks to the Chief, we've got this rolling. Committee Chairperson DuPont reported that the Park and Walk Program in Chrome has been very effective. Committee Chairperson DuPont reported that he asked for the Police Committee to be put on the department E-mail so if anybody in that department wants to communicate directly with the Committee they can. He reported progress. 8 FEBRUARY 20, 1997 PARKS & RECREATION: Committee Chairperson Gutowski reported that he was down the park today to meet with Willie Kolibas. Unfortunately, he wasn't there, reason being his Mom is in the hospital. He asked everyone to remember her in their prayers. Also, the Mayor's sister is ill in Florida. Standing Committees Continued Committee Chairperson Gutowski reported that the boys are out cutting trees as best they can, being the cherry picker is in Pennsylvania. They've gotten a number of estimates and they sent it to the person that gave them the best estimate. He saw them out there today cleaning the fields, getting ready for baseball and softball season. He talked to Mr. Wanskus the other day and asked him about the Recreation Building. He figures that it should open some time in the middle of April which will hopefully coincide with the beginning of our baseball season. With that, we are moving right along. PUBLIC WORKS: Committee Chairperson Failace reported that Ted Surick has been out this week. He spoke to him last week, Sunday. Right after the last Council Meeting we said we had no snow and it snowed. Thank God it wasn't too much. They certainly didn't have to plow. They did a little sanding and a little salting to make sure it didn't get slippery. They said there's nothing exciting going on. He talked to them today. He reported progress. MUNICIPAL GARAGE SERVICES: Committee Chairperson Feingold reported progress. MAYOR: Mayor Sica stated that he received a letter today rrom Governor Whitman. Last year at the budget meeting we talked about putting some money in to repave parts of the Industrial Road that are failing. Last year he made application to the State of New Jersey for funds (inaudible) do the whole job, $210,000.00. We got a letter today that the State of New Jersey has appropriated $210,000.00 to fix the Carteret Industrial Road. Therefore, we won't have to do it through our bonding. We'll get $210,000.00 from them. He reported progress. PUBLIC DISCUSSION 5 Minute Limit FEBRUARY 20, 1997 45 McKinley Avneue Exit 12 Shopping Center KATHY DEAN inquired about the house at 45 McKinley Avenue. Her father's house is two houses away and she has been trying to sell it. Several people were brought there by the agency and will not look at the house because of this. That place is such a mess. The fence has been knocked down by kids. The pool that was filled in with direct, sand and it was filled with water. Someone very recently drained the water. Now, if somebody were to step in there they'd disappear. The windows are gone and everything is boarded up. She said that she wants to sell the house because she is paying taxes on it She asked if there is anything that the Building Inspector can do to find out what their intentions are because a year ago she was hearing that it was going to be torn down. Mayor Sica said that they didn't pay the taxes and then somebody came in and paid the taxes. If we didn't get the taxes he would have torn it down. He said that he will look into it tomorrow and if they're not doing something constructive and alleviating the problem there, then he will. call a hearing, give them a hearing because he is the Demolition Officer. If they don't show up at the hearing then he will tear it down. AN UNIDENTIFIED MAN asked if anyone looked into the Exit 12 Shopping Center, noting that it is a disaster. Mayor Sica explained that it was in bankruptcy. It was turned over to a lawyer ±rom North Jersey named Mangione. He met with him and the new owner has now purchased the Shopping Center. It's scheduled to close within the next ten days. He's a gentleman out of New York and he's already talked to him on that Shopping Center, what they intend to do with it. He not only is looking at buying the Shopping Center, but he is also looking at buying the car dealership on the corner who is closing down. The Chevrolet Dealer is closing down. He's looking at possibly some other land in the area. He informed him that he will either tear the Shopping Center down and build a brand new one or remodel the one that is there. Unfortunately, when it goes into bankruptcy there's not much we can do with it Once it gets into bankruptcy hands, our hands are somewhat tied. It is now coming out of bankruptcy. A fellow ±rom New York has bought it He has talked with him. He's got to give us ten days. If he doesn't do anything within ten days, he doesn't know what to do. We're just going to have to force the bank that holds the mortgage on it or fine the bank. One or the other. Can we do that? An unidentified person asked if there are code violations. Mayor Sica said that the parking lot is a mess. Borough Attorney Coughlin said that we could certainly enforce the property maintenance code. Mayor Sica said that we're going to give it ten days and by the next Council Meeting he will have an answer for him. 10 There being no further business or discussion, upon MMS&C, by Councilmembers Gutowski and Fazekas and unanimous affirmative vote of the full Council present, the meeting adjourned at approximately 7: 5 5 P.M..
