Home My Public Portal AboutOrdinances-1992-175 1 t ORDINANCE NO. 1992-1_7x_ I t CITY PARKS AND PLAYGROUNDS HOURS ORDINANCE. BE IT ORDAINED BY THE CITY OF TIFFIN, IOWA: I ,SECTION 1 : PURPOSE. The purpose of this ordinance is to regulate the hours of use for public parks and playgrounds operated by the City of Tiffin so that the parks are available for public use and the use does not conflict with the reasonable expectations of quiet and calm by City residents during the nighttime hours. SECTION 2: LIMITATION ON HOURS OF PUBLIC USE. All public parks and playgrounds operated by the City of Tiffin shall be available for public use between the hours of 7 A.M. and 0 P.M. daily. It shall be unlawful to use the parks between the hours of 10 P.M. and 7 A.M.: SECTION 3: PENALTY. Violation of the above provision governing the hours of use shall be a simple:misdemeanor as provided under Iowa Code § 903.1 (a), which provides for a maximum penalty of, imprisonment not to exceed thirty (30) days, or a fine not Ito:exceed one hundred dollars ($100.00). SECTION 4: REPEALER. All ordinances or parts`iof ordinances in conflict with the provisions of the Ordinance are hereby repealed. SECTION 5: SEVERABILITY. If any section, provision, or part of this Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall no affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional.
