The Regular Meeting of the Mayor and Council of the Borough of
Carteret was called to order by Mayor Peter J. Sica, 7:30 P. M.,
Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New
Jersey on Thursday, March 6,1997.
Upon individual roll call vote, the following were noted present:
Mayor Peter J. Sica
Councilmember Deborah Bialowarczuk

Noted absent was Councilmember Fazekas.
AJso noted absent was Borough Attorney Craig Coughlin.
The Meeting was opened with a minute of silent prayer and the pledge of
allegiance led by Mayor Peter J. Sica.
The Clerk stated that on February 28, 1997, in full compliance with the
Open Public Meetings Act, a notice of tonight's meeting was sent to The
Home News & Tribune, The Star Ledger and posted on the Bulletin
Board.
Upon MMS&C, by Councilmembers Feingold and Bialowarczuk and
unæÜmous affirmative vote of the five members present, the minutes of
January 1, 1997 were approved as transcribed and engrossed by the Clerk.
ORDINANCE #97-6 was introduced and adopted on First Reading and
the Clerk authorized and directed to advertise same for Public Hearing to
be he1d March 20, 1997 upon J\1MS&C, by Councilmembers Gutowski
and Failace.

COMMENTS
Councilmember Bialowarczuk stated that she has a little bit of
a problem with this. At the last Council Meeting,
Councilmember Gutowski stated that he had quotes for the
cherry picker. Since then it's come to her attention that the
cherry picker repairs are in excess of the bid threshold. This
job should have gone out to bid. A purchase order was
obtained under false pretenses. She finds it ironic. Two years
ago Mr. Gutowski publicly announced he was the watchdog.
Now he is up here and it's almost like he's the dog being
watched. All the rules were violated on this job. She would
like the Borough Attorney, who isn't here at this time, to
investigate how this started, how it's gotten to this point and
how it can be resolved. There were State investigations in this
town December and January looking for precisely this type of
thing. We can't have this going on. The people in the town
aren't going to put up with it. The money for the bank is tied
up in here, but in all good conscience she can't vote to move
money that hasn't been appropriated properly through the
proper channels. As Councilmembers we can't just go and do
what we want to do. You have to follow the rules and
regulations.
Councilmember Failace said that maybe it was a
misconception or misunderstanding, but he thought that it was
a specialized piece of equipment and there really wasn't
anybody around that had the equipment, when we discussed
it.
Mayor Sica said he told everybody that if it's a specialized
piece of equipment, which he thinks it is, he doesn't think he
would have to bid it, but we would still have to get quotes. If
the purchase order was done wrong, he doesn't know because
this is the first he's heard about it tonight. That might be a
fact. Maybe we should hold off on this and straighten out the
paperwork first if there is something wrong with the
paperwork which he doesn't know at the present time.
Councilmember Failace said that it is being worked on now.
Even if it were a mistake... he was under the impression that
as a specialized piece of equipment we didn't have to do that.
Maybe it was a mistake because Stan worked on it. He thinks
it was an honest mistake.

Mayor Sica noted that he is sure that nobody knows this guy in
Pennsylvania that is fixing this thing. If there is a paperwork problem,
maybe we should correct the paperwork problem.
Councilmember Gutowski said that he did speak with Patrick DeBlasio
and he was assured that what we are doing tonight is certainly okay. He
too was under the same impression when he and Mr. Failace sat with the
Mayor that it was a specialty piece of equipment. They spoke with the
Mayor and noted that it had to be fixed, that it was in the condition that
it had been in for quite a long time previous to this year. Three of them
put their heads together and this is what they decided to do. They decided
to get it done and get it fixed under those pretenses. He talked to Patrick
DeBlasio and everything is okay with him.
Mayor Sica said that the Ordinance needs four (4) aftirrnative votes.
The Clerk said that she would check with the attorney because it is an
expenditure.
Upon MMS&C, by Councilmembers Failace and Gutowski, the Agenda
was amended to include Ordinance #97-7 regarding Sewer User Fees.
Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont,
Failace, Feingold and Gutowski voted in the affirmative. Councilmember

Mayor Sica asked what the reason was for removing the use of funds.
Councilmember Failace said that unfortunately, the Borough Attorney isn't
there, but he explained to him that there is certainly nothing to prohibit it.
The way it reads in the Ordinance, that if in fact, some point down the line
we realize that we have excess funds and we want to do something with
it or return some of it to the citizens by making adjustments, the way the
Ordinance reads you can't do it. We have to change the Ordinance in
order to do that, like if we cut $50.00 or do something in the sewer user
fee.
At approximately 7:35 P.M., Borough Attorney Craig Coughlin was
noted present.

Borough Attorney Craig Coughlin explained that the purpose of the
amendment is to delete a portion of the existing Ordinance with regard to
the use of sewer user fee funds. The..... .(inaudible) provides for the sewer
user charge fees to be used only for the administration of capital
improvements in connection with them. This change would eliminate that
and allow the funds to be used in accordance with State law.

Mayor Sica said that he didn't know why they are doing this
tonight when it wasn't discussed at an Agenda Meeting so
they would know what they are voting on intelligently here,
even for First Reading.

Mayor Sica said no. They are not doing that yet because they don't know
where the road is coming out until they meet "iith Mayor McGreevey on
Thursday. We can't design down at the bottom until we know where the
road is coming out.

traffic.

Mayor Sica stated that if we didn't get the truck traffic out of
there, what are they going to design? Ifwe don't know where
the truck traffic is going to come out, it makes a big
difference .
Councilmember Fazekas said that if it comes out passed City
Line, we can still do up to that point.
Mayor Sica said that if we will be able to get the money ITom
Urban Enterprise Zone to design the portion through Carteret
into Woodbridge, fine. Then we can do a feasibility study. If
we get turned down, what is the sense of hiring somebody to
do something if we may be turned down? We can't put the
cart before the horse. It's not that we aren't going to do a
feasibility study on that. It's quite obvious that we should find
out what we're going to do first before we do something
second.
Councilmember Failace asked when we will get a decision
ITom Woodbridge.
Mayor Sica said that he has a meeting with Mayor McGreevey
on Tuesday.
Councilmember Failace asked if we will know then.
Mayor Sica said no. We will know what they think on
Tuesday. Then we'll go down to the Urban Enterprise Zone
with the previous resolution that we just passed asking for the
money to design the road through Carteret and through
Woodbridge and Woodbridge will reimburse Carteret when
we start construction on the road, for engineering costs. If we
don't know where Woodbridge wants to go with it, if we don't
know what Trenton is saying we can or can't do with it. What
is the sense of doing a feasibility study in the Chrome area if
we are going to have to fight to get the road through. He is
not saying that we shouldn't do the feasibility study, but why
should we lock up our money now? Everytime somebody
shops in Carteret, we're making money. The money is always
there. Why put it in now if we don't have to? We're not
sitting down on the Chrome area. We are in the process of
negotiating to get an additional twenty-nine (29) units worth
of money for Senior Citizen housing in the area ofDaVinci's.
We're not sitting back and waiting. But let's not spend our
money until we know we're suppossed to spend it. A
feasibility study would not cost more than $10,000.00 or
$15,000.00 for that area, but why do it now?
Councilmember Fazekas stated that at the last Urban
Enterprise Zone meeting they brought up both areas. That is
why he suggested to also do Chrome.

The Mayor noted that the artists renderings were already done on the
Chrome area. That shows undoubtedly that we're going to do it. We
can't go to Trenton and tell them we want to do a feasibility study, but we
don't know what we're studying yet. He said he will explain to them what
we want to do with the Industrial Road and once we get it ironed out we'll
be back to do this portion. He said that his personal opinion is that the
Chrome area should be done even before Pershing Avenue, but he can't
win that fight unless he shows them that we're going to get that truck
traftic out of there first.
Councilmember Fazekas said that he just doesn't want to lose Soklers.
There are a lot ofcompanies....(inaudible).
Mayor Sica said that he wants the Chrome area done more than anybody.
Councilmember DuPont said that he is voting yes as long as we don't
ignore the Chrome area.

COMMENTS
Mayor Sica asked that tills Resolution be tabled and discussed
at the next Agenda Meeting. He has no problem with them
but he just wants to talk to them so that we know what we're
doing before we do it.

Councilmember Failace stated that we get murdered here and it would be
nice if something can change.
Mayor Sica noted that for years he's screamed about ITivolous lawsuits.
Here, the prosecutor comes in and takes on cases that can't be won on a
bet and we get stuck for a couple of hundred thousand dollars. This is
great. He said that he will provide a list of all of the Senators,
Assemblymen and municipalities, he wants this resolution sent to see if we
can get some State legislation adopted to stop these prosecutors that think
they can do this kind of stuff. All they are doing is killing the small towns
by these lawsuits. Every time you look in the paper there's another
investigation, someone's indicted and then they're found innocent and the
taxpayers pay the bill because somebody wants to play games.

Councilmember Gutowski explained that many people in
town spoke to him about this issue. They were of the opinion
that the judge made a ruling that Carteret did mostly
everything proper, which we did, but they asked for us just to
clean up our bid specifications which we are doing here. This
is no way saying that we are not saving money over our
previous garbage contractor which we are. We just feel that
we want to follow the judge's decision and just clean up our
bid specifications.

Councilmember DuPont said that these tanks are located at
the Recreation Center. On January 1, 1997 they said they
would make sure it was a safe situation. Step #1 was to
register the tanks and this is Step #2, to clean the tanks. Step
#3 will be to remove me tanks. The Mayor expressed helping
the Borough out.
Mayor Sica said he'll take the tanks out for ffee.

"RESOLUTION APPROVING CHANGE
ORDER"
was adopted. Upon individual roll call vote, Councilmembers
Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted
in the affirmative.
Councilmember Gutowski said that he is sure that they've all seen the
Recreation Center. It's coming along very nice. The windows are what
we are doing here. They need some gratings so that they don't get
damaged or broken.
Upon MMS&C, by Councilmembers Feingold and Failace, all bills
appearing on the prepared list, properly audited and signed, were ordered
to be paid. Upon individual roll call vote Councilmembers Bialowarczuk,
DuPont, Failace, Fazekas, Feingold and Gutowski in the affirmative.
The Clerk stated that she was in receipt of an application for an ABC
License Transfer rrom Maureen Bruss to Enrique R. Giordano, re: #1201-
33-001-006, B & B Lounge.
Upon MMS&C, by Councilmembers Fazekas and Gutowski and
unanimous affirmative vote ofthe full membership present, it was ordered
to be received, and turned over to the Police Department.

BUILDINGS AND GROUNDS: Committee Chairman Bialowarczuk
reported Progress. She said that she would like to do a walk through next
week for the computers and phone system at the new building.

She said that she read the newspaper article today about Brian
O'Reilly being missing. It was a very good article. She's been
concerned herself over the last three weeks. She's grown up
with him. She's gone to school with him. He's been in and out
of her home in the last several years. The article said that he
went through a twelve step program for alcoholism. That
should not reflect on him totally. The man still worked five
days a week and never missed a day's work. A great person.
It's very upsetting. She hopes they find out where he is and
what's happened soon She reported Progress.
FINANCE AND ADMINISTRATION: Committee Chairman
Failace reported that there's not a whole lot going on. The
budget is still down in Trenton. They haven't gotten anything
back. They're still looking at some other things. One thing
that is kind of disconcerting is we got a bill ITom Woodbridge
for the water going through there for 1996 for about
$90,000.00.
Mayor Sica asked what 1995's bill was.
Councilmember Failace said that 1995 was $87,000.00, but
they didn't get a bill for 1995 until 1996. He's been assured
by Patrick DeBlasio tht Mr. Parmar is going to evaluate it,
review it, find that if in fact, that bill was..... (inaudbile). This
becomes a problem when you're building your budget when
you're figuring maybe you need $50,000.00 or $60,000.00 but
Patrick assured him they can work around it. It's not going to
be that big of a problem. He reported Progress.
Mayor Sica explained that a very small portion of the sewer
bill goes for the actual running and treating of the sewers. A
very large portion of it goes to pay the outstanding debt to
build the new pump station and to build the new transfer line,
to build all of the new sewers that we've been putting in and
we continue to put in. What benefits the City of Carteret and
the taxpayers of Carteret is when we're successful in bringing
in major industries like White Rose or D. B. Brown, L & M
Foods or other big industries that are trying to locate in
Carteret. They then come in and pay a large sewer bill That's
to pay off the bills we made building the sewer plants. That's
why we continue to have surplus in our sewer accounts.
That's why we can then turn around and perhaps pave some
roads and continue to build a better sewer system. If you have
an industry come in and pay $100,000.00 in taxes, $50,000.00
of the money goes to the school system. When you're
successful in bringing in industries it helps to defray the cost
of the taxpayer paying that $50,000.00 because industry
doesn't put people in the schools. He said he is sure we will
work around the inefficiency of Woodbridge with our money
but W oobbridge better get their act together.

FIRE: Committee Chairman Fazekas reported that he sat
down with the telephone and computer wiring guy.
They are still looking for ways to fund a new fire truck. Weare still going
through the training program. This year they want to accomplish is we
want to make sure we maximize those who can train. The First Response
program is being talked about. We're trying to get all of the firemen
involved, the Police Department and the First Aid.....(inaudible). They all
have to be worked out. There has to be SOP's set up. There has to be ...
(inaudible).....with the Police Department and First Aid. With that, we're
moving right along.
PARKS & RECREATION: Committee Chairman Gutowski reported that
he met with Mr. Kolibas yesterday along with Mr. Failace to discuss a
number of items. The parks are moving right along. The softball/baseball
season is rapidly approaching and the guys are out there getting the fields
cleaned up. They discussed having the Borough lots cleaned up. Mr.
Ko1ibas assured him that that's going on when the guys have time to do it.
They're about to talk to Mr. Surick so they can work the Parks
Department and the Public Works Department in conjunction to getting
these lots cleaned up. Hopefully, the Mayor has expressed this once
before, that we have some private property owners that are not cleaning
up their property and we're going to do it and charge them back for it.
We have to get it cleaned up.
Committee Chairman Gutowski reported that under Recreation he didn't
get a chance to talk to Beverly Hedesh but he is working on a concert in
the park which will be done by the New Jersey Symphony Orchestra. He's
approached a number of banks hoping to fund it. They do some concerts
around the State that are funded by Chemical Bank, unfortunately, that
funding is all dried up. We have enough banks in town that are willing to
help us out. Hopefully, in the next couple of weeks he'll be able to talk
about it with Beverly and they can get a firm date. With that, they are
moving right along.
POLICE: Committee Chairman DuPont reported that they had their
March Police Committee meeting yesterday. A couple of topics came up.
There are some very serious equipment issues in the Police Department
Scheduling also came up. When they first started holding committee
meetings he was a little concerned that it would be difficult to open up
dialogue, but he can assure everyone that after three meetings our police
officers have a lot to say. It's going well. There are several very
important things that they will be trying to work on. He reported
Progress.
PUBLIC WORKS: Committee Chairman Failace reported that he spoke
to Ted Surick on the phone. It's kind of quiet. There's not much going
on. He did ask him to ask the citizens if they have any problems with pot
holes to please call the Garage at 541-3881 and they will take care of this
as soon as they can. He reported Progress.

reported Progress. Committee Member Gutowski said that he was
down at the Municipal Garage also yesterday and talked to Vie Kazio.

There are a number of things that are happening down there.
There are some equipment problems. He's working on some
police cars. There is a problem when a police car comes in.
It seems that the money isn't being transferred back to Vic's
account so he asked if we could find out exactly how that
works. With that, the garage is still there.
