Motion declared carried Motion by Reiser, seconded by Laurent to accept the minutes of August 23, 1978, as presented. Motion declared car; ied Motion by Crosby, seconded by Laurent to accept the minutes of August 29, 1978, as presented. Motion d eclared carried 1. PUBLIC WORKS DEPARTMENT Paul Winter Motion by Theis, seconded by Crosby to accept the residnation of Paul Winter as of August 25, 1978, as per letter. Motion declared carried Richard Krotzer Contract Discussion of contract with Mr. Krotzer. Ron Duran asked that several additions be made. Motion by Crosby, seconded by Theis to approve contract with Mr. krotzer to perform duties as provided for in the contract. Motion declared carried 2. MEDINA CREEKSIDE Lyle Swanson reported that the necessary work had been done in the Medina Creekside area and that he would recommend approving the road and he sewer and water lines. Motion by Laurent, seconded by Theis to accept tickory Dr., as recommended by the City Engineer and return $2215.42 to David Gates as payment for connecting to the sewer and water in the street. Motion declared carried 3. ASSESSOR Discussion of Willis Kohnen's resignation Donna Roehl eras asked to notify Mr. Kohnen that he will be asked to work on land divisions, etc. until December 31, 1978, and to request that his records be brought to the city offices. 4. HUNTER FARMS Lyle Swanson reported that there is gravel on all streets, all are driveable and blacktop must be applied. Darrel Farr reported that Buffalo Bituminous is on strike and if they cannot do the work by the beginning of the week of September llth, he will secure another - tractor. Bob Solie, road con ractor for the project, explained that all of the delays have been caused by excessive rains. Mrs. Ray Swanson reported that their house has been built with the use of a stand-by generator, is ready for use and the elecgricy has not been installed to the property because the devel- oper has failed to complete the necessary road side grading to enable the electric company to install cable. Nancy Laurent asked if the city would be justified by having the work done rather than waiting for Mr. Farr. Thomas Crosby asked how long it would take for the city to complete the work. Lyle Swanson reported that it would be difficult to find a contractor at this time to complete the work. Mr. Farr and Mr. olie stated that they had completed the necessary work to enable Wright - Hennepin Electric to install service. Donna Roehl reported that Neil McMillan of Wright -Hennepin had repprted to her that they could not do the work because several trees and piles of dirt needed to be moved. 102 Thomas Crosby asked that Mr. Farr report to the September 12th meeting with information as to the strike situation of Buffalo Bituminous and what his anticipated completion date is. Also the possibility that in the future all roads and utilities may need to be installed before a building permit can be issued in such subdivisions. 5. GEORGE WOOD Mr. Wood appeared to request a variance from the set -back requirements to allow him to construct a barn 26 x 30 ft. on Lot c, Mortons Division, 2055 Tamarack Dr. He presented written permission from all landowners within 500 ft. Motion by Crosby, seconded by Reiser to allow Mr. Wood to construct a barn as described above, set -backs to be 180 ft from Tamarack Dr. and 110 ft. from the east property line, variance granted because size of parcel prohibits compliance with the 500 ft. set -back requirements. Motion declared carried 6. TRUXTON MORRISON, LAND DIVISION Mr. Schieffer explained the revised development contract conditions regarding roads in the Morrison Land Division, as follows: a. Gravel road built to (city specifications to Lots 3 and 4 b. Easement to Lots 1 and 2. If divisions of either of those lots, owners of Lots 1 and 2 to divide cost of upgrading easement. c. Easement to Lots 4 and 5. If division occurs owners of Lots 4 and 5 will pay cost of upgrading. d. Easement to north. When easement needs upgrading owner of Lot 9 would pay costs. e. Lots 3 and 6 will not pay as they have frontage on cul-de-sacas will owners of Lots 7 and 8. f. Street serving Lot 7 will not need to be blacktopped until building permit is requested for Lot 7, as it is undersized and will need to be platted. Wayne Neddermeyer inquired as to who would be required to do the blacktopping and what guar- antee the city would have that the job would be done. Thomas Crosby stated tiat Mr. Morrison is responsible for the work and a new buyer would have to rely on Mr. Morrison's signature. Motion by Crosby, seconded by Laurent to authroize the Mayor and Clerk to enter into agree went subject to chan_,es regarding blacktopping to be required before issuance of a building permit for a 6th house, with reference to minutes of June 6, 1978 regarding the fact that Lot 7 consisting of 3.508 acres is unbuildable until platted, subject to technical approval of city engineer and attorney. Motion declared carried 7. JAMES COL LINETT Mr. Collinett appeared to discuss the use of a mobile home as a timporary office on the corner of Co. Rd. 116 and Hwy. 55 to set up a test market for used cars. Wayne Neddermeyer explained that such a permit is granted for use during the time a building is being constructed, usually for a 6 month period. Mr. Collinett stated that they do not want to build a building until a test of the area indicates a market for used automobiles. Thomas Crosby stated that an agreement should be made with the seller regarding a test of the area. Motion by Crosby, seconded by Theis to decl ine the request for temporary use of a mobile home to Mr. Collinett as use is not provided for in city ordinances. Motion declared carried 8. WATER SUPPLY COMPANY Marlon Haugen presented operating projections for the forthcoming 3 years to establish a basis for an increase in water rates in Medina Morningside. Mr. Bererson presented written comment on the condition of. the wfl.ter mains. Discussion of sale of the water system to the city. Mr. Bergerson stated that it would cost ,135,000 to replace the system and that their investment is 66,438. Thomas Crosby asked that the matter be tabled until September 19th and that he would meet with the owners before that meeting. 9. MICHAEL HART Discussion of memo from Jeanne Mabusth regarding portions of Mr. Hart's request to build a horse barn and riding arena in Richard Schieffer agreed that with a Special Use Permit such Thomas Crosby stated that this is allowing residential in an present use of the property in the area is agricultural and in 1960 is no longer applicable. Jeanne Mabusth reported that homes have been built within the past 5 years in similar areas. Richard Schieffer stated that the ordinance could be amended to include residential non -farm dwellings in an M-1 district and that at some time a different catagory of zoning may be considered. Motion by Crosby, seconded by Laurent to grant a Special Use permit to Michael Hart to con- struct and operate a family horse barn of approximately 20 stalls, and an indoor riding arena, at least 500 ft. north of the middle of Hamel Rd. and 500 ft. west of the east property line. Motion declared carried 103 the Zoning Code pertaining to an M-1 District. a barn can be built. M-1 district all though the perhaps the land planning done 10. ST. ANNE'S CHURCH Motion by Reiser, seconded by Crosby to grant a non -intoxicating malt liquor license to Father Ardolph and St. Anne's Church for September 24th from noon until 8:00 P.M. Notion declared carried 11. LIBRARY LEASE, um PIN COUNTY Motion by Crosby, seconded by Theis to enter into a lease agreement with Hennepin County for use of the library facilities for 2 years at $258.10 per month. Motion declared carried 12. BILLS Discussion of Planner's bill. of time schedule as set forth Notion by Crosby, seconded by 7587-7647 in the amount of )8995.69. Motion declared carried Bob Derus was asked to contact the planner for a breakdown in their contract. Reiser to pay all bills except the planners bill. Order checks 20,080.33 and Payroll checks #r 5024-5052 in the amount of 13. GARY LINDGREN Discussion of letter from engineer regarding charges that should be paid per lot by Mr. Lind- gren taking into consideration the fact that he will be extending the utility lines to serve some lots at his own expense. Richard Schieffer stated that an ordinance should be written covering the situation. Motion by Laurent, seconded by Theis to authorize the attorney to draft an ordinance allowing Mr. Lindgren to connect to city sewer and water at $1223.00 per lot. Motion declared carried 14. HAMEL WELL SITE Discussion of payment of the balance due Medina Recreations in one payment or on a monthly basis. Donna Roehl was asked to check with Financial Consultant as to legality of taking the balance of $7000 from the Hamel Improvement Bond Fund. 15. FIRE DEPARTMENT CONTRACTS Thomas Crosby stated that he will meet with the Orono City Manager problems. to d i scuss mutual 16. SANITARY LANDFILL AIRPORT Thomas Crosby presented report that had been prepared by Lyman Wakefield. 17.
