The following guests were present: Councilman Rick Mihalevich; Dick Otke; Gary Oberkrom; Eric Landwehr, Cole County Public Works; Nicole Roberts and Danisha Hogue, News Tribune. 1. Introductions lntr()c;juctions were made at this time. 2. Approval of the July 11 11 2019 Committee meeting minutes Councilwoman Ward moved and Councilman Schreiber seconded to approve the July 11, 2019 minutes, motion carried. Councilman Kemna was absent for this vote. *Councilman Kemna arrived at this time (7:33 a.m.). 3. New Business 1. Discussion of Right-of-Way Acquisition for Roundabout at Creek Trail and Edgewood Drive (Dick Otke, requestor) (Matt Morasch) Mr. Morasch stated Mr. Otke has had inquiries to purchase this lot and is wanting to know if the City plans to proceed with a roundabout at this location. There was discussion among Committee members, staff, and those present regarding the need to prioritize the roundabout due to the new school, the large volume of traffic on Edgewood, safety issues and Council authority to reallocate CIP fund allocations. Mr. Morasch explained that MODot does have a 50/50 cost share grant that staff could submit this project as it would fit the Minutes/Jefferson City Public Works and Planning Committee 2 August 8, 2019 criteria. He stated the applications for the grants are due October 1st and recommended submitting this project. Mr. Moehlman encouraged the Committee to limit their discussion on this issue and stated it could be discussed at the August 19th City Council meeting closed session. 2. Update on 408 Lafayette (Jayme Abbott/Ryan Moehlman) Mr. Moehlman explained he had sent Committee members a memo regarding the update on this property and stated this property could also be discussed at the August 19th City Council meeting closed session. 3. Transit Cost Recovery for State Shuttles (Mark Mehmert) Mr. Mehmert explained Transit is proceeding with cost recovery of providing the shuttle service and have sent and invoice to the state for payment. 4. Dawson Street Stormwater (Matt Morasch) Mr. Morasch presented a solution to the stormwater problem and explained Ms.· Griffin had done a drawing putting in a new outlet behind the homes, and removing the current garage at 202 Dawson and rebuilding it next to the home so it is not in the drai11age channel. He stated he would follow up with the property owners on Dawson Street regarding this issue. 5. Street Patching on New Bedford Court Area Follow Up (Britt Smith) Mr. Morasch stated he wanted to make the Committee aware of a new process for repair of concrete streets. Mr. Smith explained the streets built in this era have chemical intrusion into the sawed joints from salt and fertilizer. Staff used to put asphalt in the cracks but it was short term and unslightly, or overlay the street which is expensive~ • He explained the new method is to mill the joint back to sound concrete, coat it with a binding agent and pour specially formulated concrete to the repair area, then re-saw the joint and seal it. Staff have other streets planned for this method in Covington Gardens, Whitney Woods, Monticello Acres and Scenic Drive. Chairman Hussey requested staff give this presentation to the full City Council at their meeting on August 19th. &. Engineering Contract with Horner & Shifrin for Binder and Indian Hills Pump Station (Eric Seaman) Mr. Seaman explained the Binder Pump Station has old electrical and control systems which are no longer safe nor meet City Code. The Indian Hills Pump Station has pumps that are obsolete and the forcemain has leaked twice in the last 13 years. The cost for the upgrades and replacements is $264,340.00. Councilman Kemna moved and Councilman Fitzwater seconded to refer the contract to the City Council with recommendation to approve, motion carried. 7. Transit 5339 Grant (Mark Mehmert) Mr. Mehmert explained the grant funds are for buses, bus facilities, and bus equipment and staff proposes using the funds for replacing bus wash components, bus barn and bus wash overhead Minutes/Jefferson City Public Works and Planning Committee 3 August 8, 2019 doors, upgrade of Para Transit software, farecard system replacement, security systems in Transit facilities, security camera systems in buses and bus barn heaters. Councilwoman Ward moved and Councilman Kemna seconded to authorize staff to apply for the grants, motion carried. 8. Replacement of Railroad Crossing at Militia Drive (Britt Smith) Mr. Smith explained there is a current joint City/County project to extend the railroad spur in the industrial area west of Militia Drive. A recent inspection of the railroad crossing revealed the need for major repairs to the tracks and road crossing. Mr. Morasch stated there would need to be a joint City/County agreement to do the repairs to the tracks and crossing. Mr. Landwehr stated he felt the entire railroad spur should be a cooperative agreement with the City/County and would ask the County Commission for approval. 9. Airport Flood and Tornado Updates (Britt Smith) Mr. Smith gave a presentation showing the Street Division staff hours, equipment hours, disposal costs of both vegetative and non-vegetative tornado debris cleanup and also staff hours and equipment hours for the flood cleanup. He gave an update of the Airport explaining repairs to airfield pavement being made, the terminal building needing demolished, cleanup of the control tower and maintenance buildings, the corrosion issues with field lighting, the FAA owned Instrument Landing System, and update of the Levee with work on it to begin late fall or early winter. Possible funding sources include flood insurance proceeds, FEMA/SEMA funds, State Aviation Trust Fund Emergency Grant and MoDOT NPE Grant Fund. 4. Other Topics There were no other topics for di~cussion. 5. Citizen Opportunity to address Council/Staff on Storrnwater and Other Public Works Issues • Request by Dr. Conley for Bus Shelter at American and Wildwood Drives (Mark Mehmert) Mr. Morasch stated Dr. Conley has requested a bus shelter at this location and staff has explained if they wanted to donate a shelter, staff would work to put one in. Mr. Mehmert stated the cost of a bus shelter is $5,000 plus the pad. 6. Adjourn Councilman Fitzwater moved and Councilwoman Ward seconded to adjourn the meeting at 9:18a.m., motion carried. What the proposed amended language does : • Removes all references to offset dimensions (added to the code in 1977) • Introduces the wording "dangerous or hazardous condition" • Removes what was proposed as paragraph E . of Sec. 32-99 . What the bill does not do : • It does not change anything concerning the duty of abutting property owners. • The responsibility for property owners is longstanding in the C ity Code and appears as early as September of 1891 with Ordinance No . 26 which states "It shall be the duty of all owners or occupants of real property in this city to keep at all times the sidewa lk , curbs and gutters in f ron t of or adjoining such property in good repair and free from all substances of whatever ki nd ." The language of the substitute b ill follows this memo . Also attached to th is memo are excerpts of code from various Cities around the state pertaini ng to sidewalk maintenance and repair. It can be seen from these ex amples that the requirement of maintenance and repair are very sim ilar to those within Jefferson City 's code , name ly , it is the responsibility of the adjoining property owner . BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. follows: Sec. 32-98. Generally. Chapter 32 (Streets and Sidewalks) Section (32-98) is amended as It is hereby made the duty of every property owner having property abutting on a public street to place and maintain a good and sufficient sidewalk and curb along such street and abutting the property, when and as directed by the Director of Public Works in conformity with policies and procedures approved by the city council. The director shall require sidewalks to be constructed or repaired when any of the following conditions exist: 1. Claim for injuries due to condition of sidewalks a. (Code 1977, § 33-18; Ord. No. 12939, § 2, 6-21-99; Ord. No. 13301, 11-5-2001) Section~. follows: Chapter 32 (Streets and Sidewalks) Section (32-99) is amended as Sec. 32-99. Duty to construct, repair, etc. A. The owner of any lot or tract of land within the city shall build and construct, rebuild or reconstruct and repair the sidewalk lying along and adjacent to his property, and such property owner shall grade, fill and park that portion of the street lying between the property line and the street curb line, and build approaches. The term "approaches" shall be understood to mean the extension of sidewalks at comer lots, from the property line each way to the street curb line, being in fact the connection across the parkway or intervening space between the comer of the property and the crossing in the street. B. Sidewalls found to be defective do to cracking, spalling, deterioration, heaving, subsidence or other deficiency shall be replaced by the owner of the adjoining propertv, or in the case of utility work or other construction by those undertaking such activities. The sidewalk shall be reconstructed in accordance with the details in the City of Jefferson Standard Drawings unless otherwise dictated by adopted plan. Small scale replacements or repairs shall be finished in a manner that replicates the materials and style of the adjoining sidewalk. D. In the event that any such defective sidewalk, utility work. or construction as described in paragraph C above involves a sidewalk. or the curb at the intersection of the sidewalk and a street, ally, or driveway where a sidewalk ramp is required, or impacts an existing sidewalk ramp, a sidewalk ramp in accordance with the City of Jefferson Standard Detail and in compliance with the Americans with Disabilities Act shall be constructed by the owner or those undertaking the utility or construction work. Section 4. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Whenever the use, convenience or necessity of the public shall require it, the director of public works shall have the authority to order the owners or agents in charge of property adjacent to which curb cuts, sidewalks, curbs, or driveways are maintained upon the public streets or rights-of-way, to alter such improvement in such manner as he shall find reasonably necessary under the circumstances, if such improvement fails to conform to the aforesaid standard plans and specifications. The director shall allow a reasonable period of time for such alteration to be made. It shall be unlawful for any person to maintain such nonconforming curb cut, sidewalk, curb or driveway after the expiration of such time. • Sec. 24-34. -Handicapped ramps required. Whenever a permit is issued to construct, reconstruct, repair, alter or grade any sidewalk curb, curb cut, driveway or street, handicapped ramps shall be required to be installed in accordance with design standards included in the city's standard plan and specifications at all curb and driveway crossings to be constructed, reconstructed, repaired or altered; provided, that the director of public works may waive said requirement if he determines that requirement of handicapped ramps is impractical under all the circumstances. • Sec. 24-169.-Permit conditions. The following conditions shall apply to all ROW work permits issued under this article, unless specifically stated otherwise in the permit, and all work in the rights-of-way by an ROW -user: City specifications; applicable codes. All restoration of city ROW caused by excavations and facilities maintenance shall comply with the city standard specifications as may be amended from time to time by the authority of the director establishing such specifications and procedures consistent with the requirements and purposes of this chapter. A ROW-user shall perform all excavations or facilities maintenance in full compliance with all applicable engineering codes adopted or approved by the city and in accordance with applicable statutes of the State of Missouri, and the rules and regulations ofthe PSC and any other local, state or federal agency having jurisdiction over the parties. A ROW -user shall be responsible for all excavations or facilities maintenance done in the rights-of- way, regardless of by whom the excavation or facilities maintenance is performed Joplin, MO • Sec. 106-32. -Duty of abutting property owners. When any sidewalk, curb or guttering or driveway crossing the sidewalk or any part thereof shall be in need of repair or replacement, or shall be defective due to the change of grade of the subsurface or subarea beneath or adjacent to the sidewalk, curb or guttering or driveway, it shall be the duty of the adjacent or abutting property owner to repair or correct such condition after complying with the procedure and conditions of article Ill of this chapter, except that no fees for permit or inspection shalt be charged an individual making his own repairs. Walkway easements are not considered to be sidewalks and the responsibility for the maintenance and repair of the walkway easement is governed by Resolution 111-93. It shall be the duty of the owners or agents of real property under the control and management of the director of public works and transportation to make repairs to and reconstruction and renewal of the sidewalks, parking spaces, curbing and guttering abutting or adjoining such property, on the front or the side thereof, and to remove therefrom all weeds, earth, or other obstructions or substance s. (b) Harm to public property. Ln the event a private sewer line, other sewer facility, or any structure, tree, or other natural or man-made article on private property caus es harm to public streets, sidewalks, parks, or other public property, or in the event that the repair of any ofthe foregoing articles causes harm to public streets, sidewalks, parks, or other public property, the costs of repairing such public streets, sidewalks, parks, or other public property shall be deemed the res ponsibility of the owner of the facility or object causing the harm. Should any property owner or agent, after written notice issued pursuant to this section, fail, neglect or refuse to make repairs or removals, as required by this division, including the removal of weeds in a sidewalk, the city may cause the repairs or removals to be made or done and recover the cost of such repairs or removals, together with costs and expenses therefor, from the owner of such property by special tax bill or any other means for which the city may collect a debt owed. When repairs, reconstruction or renewals to sidewalks, curbing, or guttering, or removal of weeds from the sidewalks, are not made by any person or entity liable therefor, the cost thereof shall be paid out of the general revenue of the city, when no sidewalk repair fund exists or such fund has no funds to its credit. The Algoa Railroad Spur is located within the City limits and serves Command Web, ALPLA, and under a current agreement with the County the spur is being extended to serve Morris Packaging. At the present time the responsibility of track maintenance falls to the County and the inspection and upkeep of the railroad crossing belongs to the C ity . Currently the railroad cross ing is in need of significant renovation and City staff approached the County Comm ission w ith the request for joint City/County sales ta x funds to be used to make t he necessary repairs . The County was receptive to the idea but expressed the desi re to share jointly in all costs associated w ith the spur and the railroad crossing . Over the last fifteen years the County has invested approximately $50 ,000 in the maintenance of the ra ilroad tracks . The C ity for its part spends $250 per mon t h on the inspection of the railroad crossing which s ince its construction in 2004 has cost the City approximately $42,000 . R ight now the C ity is also looking at approximately $150 ,000 worth of repairs that are needed at the railroad crossing. The exact wording of the agreement has not been drafted but the substance would enclude the equal sharing of costs for the inspection , maintenance, repair and or replacement of the tracks and crossing fo r the ra il as it will exi st at the completion of the current rail extension . The County w ill rema in responsible for all contracts for work associated with the tracks and the City will do the same for the ra ilroad crossing . The purpose of the overlay d istrict would be to ensure that any new construction or majo r modifications t o existing structures were in keeping with the existing design of downtown buildings . As with any major planning/rezoning project , Planning Division Staff would host one or more public meetings to present the draft overlay district , so that property owners and other interested parties have an opportun ity to provide feedback on the con tents of the proposal. Planning staff would also hold discuss ions with any interested groups (such as the downtown association). Overlay zoning districts are established through the Zoning Code , and the process for their enactment includes review and recommendation by the Planning and Zon ing Commission and final review and decision by the City Council. Some general elements that would likely be included in a downtown overlay district include : Build-to line (to ensure buildings are aligned along the street) Minimum building height (ie , two stories) Required materials for exterior walls (Brick , stone , etc.) Minimum window requirements (includ ing storefront windows on High/Madison Streets) Entryway Designs Roofline Designs (Cornice/Frie ze/Parapet designs ) Staff hope to comple t e a draft des ign st andards overlay district this fall , and make the proposal available for rev iew by downtown property owners and the general public as well as· proceeding with public feedback meetings .
