AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 1979-83 , AS
AMENDED, OF THE MUNICIPAL CODE OF TIFFIN, IOWA, BY PROVIDING FOR
ZERO-LOT LINE DEVELOPMENT.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA :
Section 1 . Purpose: The purpose of this ordinance is to amend.
the Zoning Ordinance 1979-83 , as amended , of the Municipal Code
of Tiffin, Iowa, by providing for zero-lot line development
within two-family and multiple-family residential districts.
Section 2 . Amendment . Section 3 ( 10 ) of Ordinance 1979-83 , as
amended, is hereby repealed and the following Section 3( 10 ) is
enacted in lieu thereof :
Section 3 ( 10 ) . A "dwelling" is a building
used as the living quarters for one or more
families , not including auto courts , rooming
homes , tourist homes, or trailers .
a. A "private dwelling" is a dwelling
occupied by but one family alone.
b. A "two-family dwelling" is a dwelling
occupied by but two families alone.
c. A "multiple dwelling" is a dwelling
occupied by more than two families .
d. A "zero-lot line dwelling" is a dwelling
occupied by one family alone, with one wall
located on a side lot line which is not a
street or alley right-of-way line.
Section. 3 . Amendment: Section 4 of Ordinance No. 1979-83 , as
amended', ' is hereby repealed and the following Section 4 is
enacted in lieu thereof :
Al - Agriculture
A2 - Restricted Agriculture District
R1 - Single-family Residential District
R2 - Two-family Residential District
R3 - Multi-family Residential District
TC - Trailer Court District
M1 - Industrial District

Section 4 . Amendment: Section 11 of Ordinance No. 1979-83 , as
amended , ,is hereby repealed and the following Section 11 is
enacted in lieu thereof :
Section 11 . R-2 - Two-family Duplex
Regulations :
1 . The premises in the R2 Residence Zone may
be used for the following purposes only:
A. The uses set forth for R1 resident use.
B. Two-family dwellings provided, however,
that no more than three persons not members
of a family may room in each living unit
provided that off-street parking is provided .
In addition, there will be a minimum of 6 , 000
square feet of lot size for construction of a
two-family dwelling .
C . Zero-lot line dwellings provided ,
however, the following :
The side yard requirement does not apply
to the common side lot line, but the
applicable side yard requirement is still
required for one side yard .
ii . Each separate dwelling unit that is a
zero-lot line dwelling shall be •provided with
separate access and separate utilities
service.
iii . A legal easement shall be made for
permanent access for maintenance of the wall
located upon the common side lot line and for
other common elements, prior to issuance of a
building permit and occupancy permit, and
occupancy of either zero-lot line dwelling.
iv. No portion of a zero-lot line dwelling
shall project over the lot line.
v. Openings in the wall on the lot line are
prohibited.
vi . Not more than two persons , not members
of the family may room in such premises .

Section 6 . Amendment : Section 16 of Ordinance No. 1979-83 , as
amended , , is hereby repealed and the following Section 16 is
enacted in lieu thereof :
Section 16 . Height Requirements . The
following shall be the height restrictions
for each district and no structure shall be
erected to a height in excess, thereof :
A2 District - 25 feet
R1 District - 35 feet
R2 District - 35 feet
1 R3 District - 45 feet
TC District - 25 feet
M1 District - 100 feet
Section , 7 . Amendment: Section 17 of Ordinance No'. 1979-83 , as
amended , is hereby repealed and the following Section 17 is
enacted An lieu thereof :
Section 17 . Lot Requirements . The following ,
lot sizes shall be required for each district
as follows and in addition, each lot shall
have front, side, and rear yards not less
than the following depth and width per
district .
' R-1 District
Lot size - 90 ft . x 140 ft.
Front yard - 25 ft. N �

Side yard - 9 ft .
R-2 District
Lot size - 90 ft . x 140 ft .
Front and rear yards - 25. ft.
Side yard - 5 ft .
R-3 District
Lot size - 90 ft . x 140 ft.
Front and rear yards - 25 ft .
Side yard - 5 ft .
TC District
Lot - 3, 000 sq. ft. - single trailer

Section 8 . Amendment : Section 18 of Ordinance No. 1979-83 , as
amended, is hereby repealed and the following Section 18 is
enacted in lieu thereof :
Section 18 . Parking Requirements ., The
following shall be the number of off-street
parking spaces required for each respective
district . A parking space shall be an area
at least 9 feet wide and 20 feet long
connected to a public street or .alley by
driveway not less than 10 feet wide and so
arranged as to permit ingress and egress of
the automobile parked adjacent to the parking
space .
R-1 District - 2 spaces per lot
R-2 , R-3 Districts - 2 spaces per dwelling
unit. 2 spaces per lot for zero-lot line
dwellings .
TC District = 1 space per lot
Section 9 . Repealer. All ordinances or parts of
ordinances in conflict with the provisions of this Ordinance are
hereby repealed.
Section 10 . Severability. If any section, provision, or
part of this Ordinance shall be adjudged to be invalid or uncon-
stitutional , such adjudication shall not affect the validity of
the ordinance as a whole, or any section, provision, or part
thereof not adjudged invalid or unconstitutional .
Section 11 . Effective Date. This Ordinance shall be in
effect after its final passage, approval , and posting as provided
by law.

meeting of the Tiffin City Cduncil , Tiffin , Iowa, Councilperson
introduced Ordinance No. t94'/-)R6 , and moved
that it be given its first reading . The motion was seconded by

"Aye" , Mayor Glenn R.Potter declared Motion carried, and Ordinance
No . F1N'Ok6 was ' read the first time and discussed and placed on
record .
Thereupon, it was moved by Councilperson Tact) 'Is

that the laws and rules providing that ordinances be considered
and voted on for passage at two council meetings priortto the
meeting at which it is to be finally passed be suspended and
dispensed with and that Ordinance No.1c19-I&6- be placed on its last
reading .
