AN ORDINANCE PROVIDING FOR EXTRATERRITORIAL REVIEW OF
SUBDIVISION PLATS WITHIN TWO MILES OF THE CITY OF TIFFIN
PURSUANT TO IOWA CODE SECTION 354 .9.
BE IT ENACTED by the City Council of the City of
Tiffin, Iowa;
Section 1 . Purpose. The purpose of this ordinance is '
to envoke the provisions of Iowa Code Section 354 . 9,
providing for the review of subdivision plats within two
miles of a city.
Section 2 . Iowa Code Section 354 . 9 is hereby adopted
by the City of Tiffin, and the City hereby envokes the
authority provided in said Code provisions to review all •
subdivision plats within the following described area:
1. East of the City of Tiffin to Interstate 380 to the
east;
2 . 340th Street of Johnson County to the south;
3 . Half Moon Road to the west; and
4 . North to the section line dividing Clear Creek Township
from Madison Township.
All of the boundaries described are within two miles of the
current existing boundaries of the City of Tiffin.
Section 3 . Repealer. All ordinances or parts of ordinances
in conflict with the provisions of this Ordinance are hereby
repealed.
Section 4 . Severability. If any section, provision, or
part of this Ordinance shall be adjudged to be invalid or
unconstitutional, such adjudication shall not affect the
•
validity of the ordinance as a whole, or any section,
provision, or part thereof not adjudged invalid or
unconstitutional.
Section 5 . Effective Date. This Ordinance shall be in
effect after its final passage, approval, and posting as
provided by law.

On the 26th day of April 1995, at a regular meeting of
the Tiffin City Council, Tiffin, Iowa, Councilperson
Brown introduced Ordinance No. 1995-19d. , and
moved that it be given its first reading. The motion was
seconded by Councilperson Stratton
Ayes :
Brown , Bartels , Stratton . Morgan and Kern
Nayes :
None .
Five members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared the motion carried,
and that Ordinance No. 1995-191 , was read the first time
and discussed and placed on record.
Thereupon, it was moved by Councilperson
Kern and seconded by Councilperson
Bartels that the laws and rules
providing that ordinances be considered and voted on for
passage at two council meetings prior to the meeting at
which it is to be finally passed be suspended and dispensed
with and that Ordinance No. 1995-19k be placed on its
last reading.

None
Five members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared the motion carried,
and Ordinance No. 1995-10, , was then placed on its last
reading and was read the last time.
Thereupon, it was moved 10Y .
Stratton, and seconded by Councilperson
Brawn that Ordinance No.
1995-19 . be placed upon its final passage and adopted.

"Aye" , Mayor Glenn R. Potter declared the motion carried,
and the ordinance was passed and adopted.

Whereupon the mayor declared that Ordinance No.
1995-191 be adopted and signified his approval of
same by fixing his signature thereto.
Passed by the council on the 26th day of
April , 1995 and approved by the mayor on the
26th day of April 1995.

I, Clerk of the City of Tiffin, Iowa, state that an
ordinance entitled AN ORDINANCE. PROVIDING FOR '
EXTRATERRITORIAL REVIEW OF SUBDIVISION PLATS WITHIN TWO
MILES OF THE CITY OF TIFFIN PURSUANT TO IOWA CODE SECTION
354.9 and known as No. 1995-19,1 was duly passed by the
council on the 26th day of April 1995, and signed
by the mayor on the 26th day of April 1995, and
published on the 27th day of April 1995, by
posting copies thereof in three public places within the
limits of the City of Tiffin, Iowa.
