AN ORDINANCE LEVYING AND ASSESSING SPECIAL ASSESSMENTS ON
CERTAIN LOTS, PIECES AND PARCELS OF LAND LIABLE FOR SUCH SPECIAL
ASSESSMENTS TO PAY THE COSTS OF INTERNAL IMPROVEMENTS IN THE
CITY OF BEL AIRE, KANSAS, AS HERETOFORE AUTHORIZED BY
RESOLUTION NOS. R-92-07, R-92-10, R-92-12 AND R-93-17, R-92-15, R-93-02, R-
93-04, R-92-10 AND R-93-18, R-93-11, R-93-12 AND R-93-13 OF THE CITY; AND
PROVIDING FOR THE COLLECTION OF SUCH SPECIAL ASSESSMENTS,
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS:
SECTION 1. For the purpose of paying the costs of the following described improvements in
the City:
Construction of pavement to serve the property described as: SUMMIT HILL, Lots 17
through 35, inclusive, Block 1, Lots 11 through 17, inclusive, Block 2, Lots 1 through
7, inclusive, Block 3 and Lots 1 and 2, Block 4 (Resolution No. R-92-07);
Construction of a sanitary sewer main to serve the property described as: SUMMIT
HILL, Lots 17 through 41, inclusive, Block 1, Lots 50 through 56, inclusive, Block 1,
Lots 1 through 7, inclusive, Block 3 and Lots 1 and 2, Block 4 (Resolution No.
R-92-1O);
Construction of a storm water sewer to serve the property described as: SUMMIT
HILL, Lots 12 through 35, inclusive, Block 1, Lots 7 through 17, inclusive, Block 2,
Lots 1 through 7, inclusive, Block 3 (Resolution No. R-92-12 and R-93-17);
Construction of a water main to serve the property described as: SUMMIT HILL, Lots
17 through 35, inclusive, Block 1, Lots 11 through 17, inclusive, Block 2, Lots 1
through 7, inclusive, Block 3 and Lots 1 and 2, Block 4 (Resolution No. R-92-15);
Construction of pavement to serve the property described as: NORTHFORK SECOND
ADDITION, Lots 1 through 5, inclusive, Block 1 (Resolution No. R-93-02);
Construction of a water main to serve the property described as: NORTH FORK
SECOND ADDITION, Lots 1 through 8, inclusive, Block 1 (Resolution No, R-93-04);
Construction of a storm water sewer to serve the property described as: Lots 1 through
20, inclusive, Block 1, Willow Point Courts Addition (Resolution No. R-9.3-1O and R-93-
18);
Construction of a sanitary sewer main to serve the property described as: Lots 1 through

20, inclusive, Block 1, Willow Point Courts Addition (Resolution No. R-93-11);
Construction of pavement to serve the property described as: Lots 1 through 20,
inclusive, Willow Point Courts Addition (Resolution No, R-93-12); and
Construction of a water main to serve the property described as: Lots 1 through 20,
inclusive, Block 1, Willow Point Courts Addition; AND a tract of land lying in the
Northwest Quarter of Section 25, Township 26 South, Range 1 East of the 6th P.M.,
Sedgwick County, Kansas more particularly described as follows: Beginning at the
Southwest comer of Lot 1, Block 1, Willow Point at Eagle Lake, an addition to Bel Aire,
Sedgwick County, Kansas; thence West along the North line of said Willow Point Road;
thence North 347 feet parallel and 50 feet East of the West line of said Northwest
Quarter; thence East 610 feet to a point on the extended West line of said Lot 1; thence
South 360 feet along said extended West line, to the point of beginning (Resolution No.
R-93-13);
to the City of Bel Aire, Kansas (the "City"); as heretofore authorized by Resolution Nos. R-92-07,
R-92-lO, R-92-12 and R-93-17, R-92-15, R-93-02, R-93-04, R-9,i-lO and R-93-18, R-93-11, R-93-12
and R-93-13 of the City, there are hereby levied and assessed against the properties liable therefor the
several amounts set forth on Exhibit A attached hereto following the description of each lot, piece or
parcel of land, with such clerical or administrative amendments thereto as may be approved by the City
Attorney.
SECTION 2. The amounts so levied and assessed as set forth on Exhibit A of this Ordinance
shall be due and payable from and after the date of publication of this Ordinance; and the City Clerk shall
notify the owners of the above described properties, insofar as known to said City Clerk, of the amounts
of their respective assessments; and, said notice shall further state that unless such assessments are paid
within thirty (30) days from the date of publication of this Ordinance, bonds will be issued therefor, The
City Clerk shall certify to the County Clerk, in the same manner and at the same time as other taxes are
certified, for a period of 15 years, all of the above assessments which have not been paid within thirty
(30) days after the date of publication of this Ordinance, together with interest on such amount thereof
at a rate not exceeding the maximum rate therefor as prescribed by the laws of the State of Kansas; and
such amounts so certified shall be placed on the tax rolls and shall be collected as other taxes are
collected over said period of 15 years, the levy for each year being a portion of the principal amount of
the assessment plus one (1) year's interest on the amount remaining unpaid,
SECTION 3. This Ordinance shall take effect and be in force from and after its passage,
approval and publication once in the official city newspaper.
