A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LYNWOpD GRANTING THE APPgp~I, OF STEVEN L.
CRAIG FROM THE DECISION OF THE PLANNING
CON47ISSION DENYING THE APPLICATION FOR
CONDITIONAL USE PERMIT NO. CUP 97-02 AND
~ VARIANCE NO. VAR 97-01
WHEREAS, on February 12, 1997, Steven L. Craig and
Fernando Rivas, dba Genesis Auto Sales applied to the Planning
Commission for a Conditional Use Permit for an Auto Use in the C-
2A zone, and a Variance from some of the Development Standards;
and
WHEREAS, the Planning Commission, pursuant to law,
conducted a public hearing on March 11, 1997 to consider said
application; and
wHEREAS, at the conclusion of said public hearing, the
Planning Commission denied said application based on the fact
they could not make the required findings; and
WHEREAS, Steven L. Craig appealed said decision of the
Planning Commission to the City Council, within the time
prescribed by law; and
WHEREAS, the City Council considered said

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD
HERF_BY FINDS, DETERMINES AND RESO~VES AS FOLLOWS:
Section 1. The City Council concurs in the
determination of the Director of Community Development that the
proposed project is categorically ex~empt pursuant to Section
15301 of the State CEQA Guidelines, as amended.
Section 2. The City Council finds and determines
that the issuance of a Variance and Conditional Use Permit at
this location for an Automotive Use would not be detrimental to
the public health, welfare or safety, based on the following:
A. A similar business has operated at this
location for most of the past 30 years.
, B. The subject property is adequate in size to
accommodate the proposed use.
C. The proposed land use is consistent with the
existing zoning classification of C-2A (Medium
Commercial) and with the General Plan designation
of commercial.
D. The strict oz literal interpretation and
enforcement to the specified regulation would
result In practical difficulty or unnecessary

physical hardship inconsistent with the objectives
of this chapter.
E. That there are exceptional or extraordinary
circumstances or conditions applicable to the
property involved which do not apply generally to
other properties in the same zone.
F. That strict or literal interpretation and
enforcement of the specified regulation would
deprive the applicant of privileges enjoyed by the
owners of other properties in the vicinity
classified in the same zone.
Section 3. The City Council hereby grants the
appeal of Steven L. Craig, approving Variance No. VAR 97-01 and
Conditional Use Permit No. CUP 97-02, subject to all conditions,
restrictions and limitations set forth in the "Conditions of
Approval for Conditional Use Permit No. CUP 97-02," a copy of
which is attached hereto as Exhibit A and incorporat•ed herein by
reference.
Section 4. The City Clerk shall certify to the
passage and adoption of this Resolution.
PASSED, APPROVED AND ADOPTED this 15th day of April,
1997, by members of the City Council, voting as follows:
