HomeMy Public PortalAboutOrdinances-1994-191 ORDINANCE #1994-191 AN ORDINANCE TO ESTABLISH PROVISIONS TO GRANT FRANCHISES FOR COMMUNITY ANTENNA TELEVISION SYSTEMS AND TO PROVIDE FOR THE REGULATION OF SUCH SYSTEMS IN THE CITY OF TIFFIN, JOHNSON COUNTY, IOWA WHEREAS, cable television has grown and changed since its inception, and; WHEREAS,the Federal government,through the Federal Communications Commission (FCC) largely has control over Cable Television rates and programming, and; WHEREAS, THE congress,by enacting the Cable Communications Policy Act of 1984 (the Cable Act), as amended by the Cable Television Consumer Protection and Competition Act of 1992,has granted local governments the right to grant franchises and to regulate the local operations of Cable Television companies, and; WHEREAS, cable technology has changed drastically and will continue to change rapidly in the years ahead, and WHEREAS,the local environment in which cable television operates is uncertain and subject to change, and; WHEREAS, Cable Television companies require use of public rights-of-way to construct and operate their systems, and; WHEREAS, the City of Tiffin, Johnson County,Iowa(the City)has an interest in the use of its right-of-way and in the protection of the public health, safety and welfare, and; WHEREAS, the City of Tiffin desires to exercise its powers to protect its citizens and promote the public health, safety and welfare. NOW, THEREFORE,BE IT ORDAINED PURSUANT OT CHAPTER 364.2, CODE OF IOWA,BY THE CIT COUNCIL OF THE CITY OF TIFFIN, JOHNSON COUNTY, IOWA,AS FOLLOWS:
