AN ORDINANCE AMENDING THE ORDINANCE NO. 1963-53 OF THE
MUNICIPAL CODE OF TIFFIN, IOWA:
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1 . Purpose . The purpose of this ordinance is to
amend Ordinance No. 1963-53 of the Municipal Code of Tiffin,
Iowa, by decreasing the number of members allowed on the
Planning and Zoning Commission and to add the power to meet
as often as the commission determines necessary as allowed
under Iowa Code Section 414 . 6
Section 2 . Amendment . Ordinance No. 1963-53 , an Ordinance
for the City of Tiffin, Iowa, is hereby amended as follows :
Section 1 . Planning and Zoning Commission Created is hereby
repealed and the amended Section 1 . Planning and Zoning
Commission Created shall read as follows :
Section 1 . Planning and Zoning
Commission Created. There is hereby
created a town planning and zoning
commission, composed of five (5)
residents of the town of Tiffin, who
shall be qualified by knowledge and
experience to act in matters pertaiing
to the development of town planning and
zoning, none of whom shall hold any
elective positions in said town. Such
members shall be appointed by the town
council .
Section 2 . Term of Office is hereby repealed and the
amended Section 2-Term of Office shall read as follows :
Section 2 . Term of Office. The term of
office of said members shall be five
years, except that the members first
named shall hold office for such terms,
not exceeding five years, that the terms
of not more than one-third of - the

members will expire in any one year.
Any vacancy. occurring on the commission,
caused by resignation or otherwise,
shall be filled by the council for the
unexpired term. All members of such
commission shall serve with compensation
as provided by approval of the city
council, and including their actual
expenses which shall all be subject to
the approval of the council.
Section 3 .4 is hereby added and the new Section 2 .4 shall
read as follows :

Section 3 . Repealer. All ordinances or parts of ordinances
in conflict with the provisions of this Ordinance are hereby
repealed.
Section 4 . Severability. If any section, provision, or'
part of this ordinance shall be adjudged to be invalid or
Unconstitutional, such adjudication shall not affect the
validity of the ordinance as a whole, or any section,
provision, or part thereof not adjudged invalid or
unconstitutional .
Section 5 . Effective Date . This ordinance shall be in
effect after its final passage, approval, and posting as
provided by law.
On the 12thday of July 1995, at a regular meeting of
the Tiffin City Council, .Tiffin, Iowa, Councilperson
Brown
introduced Ordinance No. 1995-195 and
moved that it be given its first reading. The motion was
seconded by Councilperson Kern

Nayes :
None .
Five members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared the motion carried,
and Ordinance No. 1995-195 , was read the first time and
discussed and placed on record.
Thereupon, it was moved by Councilperson
Morgan . and seconded by Councilperson
Stratton that the laws and rules
providing that ordinances be considered and voted on for
passage at two council meetings prior to the meeting at
which it is to be finally passed be suspended and dispensed
with and that Ordinance No. 1995-195 be placed on its
last reading.

Nayes •
None
Five members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared the motion carried,
and Ordinance No. 1995-195 , was then placed on its last
reading and was read the last time.
Thereupon, it was moved by Councilperson
Brown and seconded by Councilperson
Bartels that Ordinance No.
1995-195 be placed upon its final passage and adopted.

Nayes :
None
Five members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter "declared the motion carried',
and the ordinance was passed and adopted.
Whereupon the mayor declared that Ordinance No.
1995-195 be adopted and signified his approval of
same by fixing his signature thereto:
