BOARD OF HEALTH MEETING '16 MAR 31
TUESDAY JANUARY 19, 2016 AT 7:00PM
TOWN HALL, ROOM A
Board members present: Lemuel Skidmore,MS, Chairman;Carmen Scherzo, DVM,Vice Chairman and Joe Ford
Board members absent: Mary Chaffee, RN,PhD
Others present: Nancy Ellis Ice, MPH,CHO,RS, Health Director
Board member Annie Dugan participated in the meeting remotely via telephone.
1. Chairman's announcements
Mr. Skidmore went over the rules for having a Board member participate remotely and noted that all votes would have to a roll call
vote.
Mr. Skidmore asked the Board members to read the open meeting law guide(specifically the"deliberation"section).
2. Discussion on 33 Old Long Pond Road
Mr. Skidmore recapped what went on the previous meeting with regards to this property. He noted that Town Counsel did give an
opinion on this. That opinion stated that the Board may want to rescind the vote that was taken on December 15,2015 that states the
property was unfit for human habitation. He noted that it would take a 2/3 vote to rescind the vote.
Motion: Rescind the motion from December 15,2015 declaring the property unfit for human habitation

Town Counsel's recommendation was to start the process of condemning the home, or the Board could continue on with the
agreement with the owner that they wouldn't sleep there and would just go and do repairs that are necessary(or store personal items).
There are currently 2 owners,but one is trying to legally get their name removed from the deed.
Mr.Ford stated that he felt the Board should not condemn the property.
Dr. Scherzo stated that he is in favor of allowing the owners to be able to continue storing their personal items and keep going to the
house to do repairs.
Ms.Dugan stated that she is concerned that the proper channels haven't been followed and felt that a complete inspection of the home
should be done.
It was noted that at the last meeting,the owners agreed to notify the Building Inspector every time they went to the property.
Motion:Notify the homeowners that the Board is in agreement with them that they can be on the property to do repairs and store
personal items. The agreement also states that the homeowner will not occupy the building. The property will be monitored and if
there is evidence that someone is occupying the property,the Board will take further action which may include condemnation.

3. Discuss and possibly vote on the Pond Nutrient Regulation
Mr. Skidmore told the Board that this version of the draft regulation incorporates 2 regulations. The Pond Nutrient Regulation and the
Leaching Facility Setback Regulation. If the Pond Nutrient Regulation passes,the Leaching Facility Setback regulation will be
rescinded.
Dr. Scherzo handed out a statement that he had written regarding his concerns with the regulation and then read it to the Board.
There was discussion on deleting Section 8.1 from the regulation.
Motion:Delete section 8.1 from the regulation.

There was more discussion on this issue.
Dr. Scherzo and Ms. Dugan both pointed out some grammatical corrections.
Mr. Ford rescinded his second for the motion on the floor.
The Board agreed to send the corrections and comments back to Mark Nelson,have him do another revision and then it will come
back to the Board at the next meeting.
4. Discuss and possibly vote on the Regulation Prohibiting the sale of Synthetic Drugs
Mr. Skidmore stated that he had only received a copy of 1/2 the regulations. The rest of the Board also only got V2. Mr. Skidmore
stated that he thought it best to wait until the full copy was looked at and the full Board was in attendance. He spoke about the title of
the regulation and suggested that it may need to be changed. Mr. Ford also thought the title needed to be changed.
This will come before the Board at their next meeting.
5. Discuss and possibly vote on the Design,Operation and maintenance of Small Wastewater Treatment Facilities
Mr.Skidmore had some questions on section 3. The section regarding escrow. He suggested having Mrs.Ice talk with Lisa Vitale,
Town Treasurer about the whole thing. Mr. Skidmore also had questions on Section 5. Instead of a continuous graph,he suggested to
maybe have it be just the last 5 years. There were also questions on section 6-variances. The Board suggested that some of it could be
eliminated.
Dr. Scherzo had concerns with section 4 with regards to the lOppm. The Board discussed all the issues and the regulation will be re
written with changes and brought back to the Board for another review.
6. Discuss Planning Board application for Brewster Ladies Library
Noted.
7. Topics the Chairman did not anticipate
None.
