Chairman's announcements There were none. 2. Ryder&Wilcox-local variance request(Leaching Facility Setback regulation)for 280 Old Owl Pond Road Judy Bersin presented this to the Board. She explained to the Board that this is a 33,000 square foot lot near Bakers Pond. The current dwelling is to be torn down and a 3 bedroom home will be rebuild with a new septic system. Conservation Commission has already given approval. The following variance is being requested: To allow the proposed SAS(leaching area)to be 179 feet from Bakers Pond. Mrs.Bersin stated that groundwater flow is NE which is away from the pond and the SAS is 20' above the pond. The effluent will never reach the pond. Mr. Skidmore stated that there is only around 27,000 square feet of buildable upland on this lot and they would need 30,000 square feet to be able to build a 3 bedroom home. This is in accordance with the Regulation Regarding Granting of Variances). Mrs.Bersin stated that they are surrounded by vacant lots. She asked if using a pressure dosed system would help. Mr. Skidmore stated that he believed the Board could not vary that part of the regulation. Dr. Chaffee stated that she was ok with everything except the shortage of square footage. Mr.Ford stated that he had no problem with what was being requested. Dr. Scherzo asked about the distance to the wetland. Mrs. Bersin stated that they were 103 feet away from wetland. Dr.Chaffee asked Mr. Skidmore if the Board should request clarification with Town Counsel on varying that part of the regulation. Mrs.Ice will check with Town Counsel and this request will be continued until the next meeting or when Town Counsel gets back to Mrs. Ice. 3. Siemasko&Verbridge-seeking support of a plumbing variance for 2070 Rte.28 Leslie Scherberger from Siemasko&Verbridge was present. WWW.TOWN.BREWSTER.MA.US BOH 4/5/2016 Minutes Page 2 This is an older home being converted to a commercial building that will be 930 Square feet for office space. They have applied to the State for a plumbing variance and as part of that application they need the local Board of Health's support. Mr. Skidmore told the Board that they had done these before and reminded the Board that they need to either vote to support the variance or not. Motion: The Board of Health does not oppose the requested variance. Motion: Dr.Chaffee Second: Joe Ford Vote:4-0-0 Action:Motion carried 4. Lawrence Norris-54 Thousand Oaks Drive-request for relief of bedroom limitation on property Mr.Norris was present. He stated that this is a 4 bedroom home that was built in 1973. He would like to tear it down and rebuild another 4 bedroom home. The issues is that it is in Zone II and the lot is only 33,200 square feet. Mr. Skidmore stated that because this would be considered new construction and the lot only has 33,200sf,the owner would only be able to build a 3 bedroom home. He suggested that the owner check and see if he could get credit for another bedroom on the lot if he used and I/A system. The Board was in agreement with what Mr. Skidmore had stated. 5. David&Rachel Simons-208 Leland Road-variance request to keep SAS within 300' of a pond Rick Judd was present. The owners are looking to finish a room in their home and had a septic inspection that showed the leaching are was only about 294(give or take)feet from the pond. This is a 1978 code system. Groundwater is at 23'. The groundwater moves from Mill Pond in a Northwest direction which means the SAS will not contribute anything to the pond. Motion: Finding that the groundwater flows away from the pond and the system is 23' above groundwater,approve the variance request of 5 feet from the SAS to the pond. Motion:Joe Ford Second: Dr.Chaffee Vote:4-0-0 Action: Motion carried 6. Request to support changing the legal age to purchase tobacco to 21 in Massachusetts The Board is in full support of this proposed regulation and agreed to send a letter stating that to Dan Wolf,Tim Whalen and Sarah Peak who are the State's Representatives. 7. Discuss May meeting dates Mr. Skidmore explained to the Board that Town Meeting is on May 2nd and if it were to go a second night,the Board would not be able to meet. Also,Town elections are on May 17th so the Board could not meet on that day either. The Board agreed to keep the May 3rd meeting date and if Town Meeting goes a second night the meeting can be postponed until May 10th. The dates will be May 3rd and 24th 8. Topics the Chairman did not anticipate None. Informational items were noted. Meeting adjourned at 7:45PM II
