BOARD OF HEALTH MEETING
WEDNESDAY, SEPTEMBER 7, 2016 AT 7:OOPM
TOWN HALL, ROOM B
Board members present: Carmen Scherzo, DVM, Chairman;Annie Dugan, RN and James Gallagher
Board members absent: Mary Chaffee, RN, PhD and Joe Ford
Others present: Nancy Ellis Ice, MPH, CHO, RS, Health Director and Tammi Mason,Senior Department Assistant
1. Chairman's announcements
Dr.Scherzo explained the rules which need to be followed during the meeting.
2. Discuss request by Attorney John P.McCormick re:dumpster at Chillingsworth
Joanne Ritter,complainant. Spoke about what has happened since the last meeting. She thanked the Board for listening to their
complaints. Thanked the Rabins. They have done a great job keeping the odor and the noise down for the whole month of August
and into September. They hope that this will continue.
3. Brewster Farms Quick Pic-discuss ongoing issues with the dumpster on site
The Patels,the owners were present. Mr. Patel explained that they used to have a pick up once a week. It has been changed to
twice a week. Items have not been stored next to dumpster,everything is being put inside the dumpster.
Ms. Dugan spoke about her disappointment in how many complaints there have been. The Patels will continue to do twice weekly
pickups during the summer months and then once a week during the rest of the year.
Motion: If the Board of Health gets another complaint,the Board should require the Patels to come before the Board to discuss
increasing the cost of their annual permit.
Motion: Annie Dugan Second:James Gallagher(for discussion)
Dr.Scherzo asked who else used the dumpster. The Patel's stated that it is mostly them, but their tenants sometimes use it also.
Dr.Scherzo also said that he has driven by and the dumpster has been open and that the Assistant Health Director has also seen it
open.
The Patels stated that sometimes the tenants put the trash in the garage also. The Board asked that covered trash cans provided for
cottage tenants.
Motion: If there is another infraction,The Patels will be asked to come before the board and there will be a surcharge attached to
their permit.

4. Discuss proposal from Peter A.Schaible re: Litter
Peter Schaible was present. He walks frequently with his dog at Drummer Boy Park and elsewhere on town properties. There is a
considerable litter problem all over the Cape. Suggests that people can be persuaded to change their behavior and thinks changing

the sign to include a fine if people do not pick up after their pets in the park would be better and would be taken more seriously by
the people that go there.
Ms. Dugan stated that the Recycling Commission works very hard on this issue at the beaches.
Mr.Gallagher asked where it would go from here. Who does the signs?Who pays for the signs? What is the next step?
Dr.Scherzo thinks maybe this should go before the Selectmen. They are in charge of the litter. We could pass this on to the Animal
Control Officer
Ms. Dugan stated that he had the Board of Health's support 100%.
Mr.Gallagher sees no problem with putting a sign up since we already have a regulation.
S. Discuss final draft of the Regulation Prohibiting the Sale of Synthetic Cannabinoids&Cathinones
Dr.Scherzo thinks the draft is ready to go.
Motion: Present this at a public hearing for a date to be determined. AD seconded. 3 yes.

6. Discuss and approve minutes from the 6/21/16 meeting
Bring back to the next meeting.
7. Topics the Chairman did not anticipate
Ms. Dugan stated that she had researched DPH rules on nuisances. She would like to see this Board form a simple regulation for
this. This will get put on the next agenda.
Informational items were noted with the following comments:
#3.Analytical results for Ocean Edge monitoring well fence--Mrs. Ellis Ice stated that Dr.Scherzo had questioned monitoring well#2
not being tested. Thinks Coastal Engineering should be contacted.
#4. Lab results for White Rock Commons--Ms. Dugan saw 3 areas that were over the allowed limit. NI stated that it does go to DEP
for review
#7. Letter from Eversource re:Spraying--Mr.Gallagher asked about individual wells.
#10. Nickerson State Park inspection report--Ms. Dugan-Is disappointed with the continued violations, but knows that they don't
answer to us.
