Chairman's announcements Dr.Scherzo wished the towns people Seasons greetings from BOW He spoke about the ground water flow direction map. Mrs. Ice will forward it to the members via email so that everyone can have it. E He also spoke about the Water Resource Atlas and the letter to John Yunits asking to be allowed to use George Heufelder for a resource. He let the audience and the other Board members know that Annie Dugan was participating remotely during the meeting and that all votes will be roll call votes. 2. Douglas&Sarah Brown—continued request to keep SAS In its current location—674 Crowell's Bog Road (Dec 7,2016) Mrs. Mason read the motion from the last meeting. Dr.Scherzo stated that there had been an error made at the last meeting with regards to the vote. It was noted that at the December 7, 2016 meeting,the vote was stated as having failed. The vote actually passed,so the owner was granted the waiver. 3 Dr.Scherzo explained that when there is abstention,it doesn't count towards the vote,so in actuality,the vote they took that night passed, Dr.Scherzo asked that new members be told about this rule with"abstentions". : 3. Joseph Jamiel/Ardeo—trash complaint Meredith Baier-resident who made the complaint about the dumpster was present, Mr.Jamiel was not present. Ms. Baler read the letter she submitted to the Board complaining about the smell from the dumpster and the condition around it. She stated that this has been an on-going issue with them. Mr. Ford asked If they were getting a weekly pick up. Ms. Baler stated that she was told that it is on an on call basis. Dr. Chaffee asked Mrs.Ice and the Assistant Health Director to see if there can be an alternative sight for the dumpster and stated 1 that there should be a trash pickup a minimum of twice a week in the summer and once a week the rest of the year. i Dr.Scherzo stated that he was In favor of Issuing a warning and using Dr. Chaffee's suggestions. j Have Mrs. Ice pull the letter from the last issue we had with another restaurant and use that as a template. i Ms. Baler stated that pest control is a big issue also. 1 Motion:Send a letter of warning to Mr.Jamiel that he has to keep the area inside and around the dumpster in a sanitary manner. Trash pick-ups must be twice a week in the summer and once a week at other times. If Mr.Jamiel does not comply,the Board will WWW.TOWN.BREWSTER.MA.US i i BOH 12/21/17 Minutes Page 2 increase the cost of their permit by a certain percentage to be determined.Mrs. Ice will check into the possibility of moving the dumpster to another area. Discuss a possible fragrance policy Dr.Scherzo thinks that the Board should go by whatever the state guidelines are Mr. Ford though they received great information, but doesn't feel it is the right thing for Brewster. Mr. Gallagher doesn't feel comfortable making a policy and thinks it would be very hard to enforce it. Ms, Dugan stated that if there was a policy, it would have to pertain to all things people wear on their bodies and products used in town buildings.She believes that education Is key, Dr, Chaffee stated that although she did not hear presentation,she looked Into the CDC policy. She believes the issues Dr.Young raised are important,but believes some of her views on the CDC are inaccurate. Motion; Do not proceed with a fragrance policy at this time. Motion;Joe Ford Second:James Gallagher Vote: Carmen Scherzo-yes Action: Motion carried Joe Ford—yes Mary Chaffee—yes James Gallagher—yes Annie Dugan—yes Ms. Dugan would like to keep it on the radar for public education. S. Discuss vacancy on the Board of Health Dr.Scherzo thanked Annie Dugan for her service and told the Board that the Town Is seeking applicants to fill her term until May 2017. Resumes should be sent to Sue Broderick in the Selectmen's office, The deadline is December 30th.There will be a joint meeting in Jan with BOS to interview any applicants. 6. Discuss and vote on the proposed Pond Nutrient Regulation Mr.Gallagher stated that he is not ready to approve this regulation as written. Would be comfortable letting others pursue the language and develop something. Feels like the Board has done enough with it. Ms. Dugan asked what happened with the special meeting that the Board was going to have. Dr,Scherzo stated that this meeting is that meeting, Mr. Ford stated that he wouldn't feel comfortable voting on the regulation at this meeting. He supports tabling it indefinitely. Ms. Dugan stated that there is so much riding on this regulation, if we voted now, It could seriously impact what happens. Believes the Board should postpone the vote indefinitely. Dr.Scherzo stated that there are a lot of questions that still need to be answered. He felt that it would be better to wait until the Board could hear more science based information before voting on it. Motion:Annie Dugan Second: Mary Chaffee Vote:Carmen Scherzo—yes Action: Motion carried Joe Ford--yes Mary Chaffee--yes James Gallagher—yes Annie Dugan—yes Ms. Dugan stated that she thought Conservation could take over the vegetated buffer part of the proposed regulation. Dr.Chaffee suggested that the Board notify the chairman of BOS and Ryan Bennett and let them know if they are interested in taking action they can because the Board is at a standstill right now. 7. Discuss Design,Operation and Maintenance of Small Wastewater Treatment Facilities regulation Dr.Scherzo went over the changes that had been discussed earlier. Mrs. Ice will do the changes and bring back to another meeting. E This will need a public hearing and it will need to have a review by Town Council. 8. Minutes from 10/19/16 meeting There were a few minor corrections. Motion:Approve the minutes with corrections.
