Mayor Harker called the regular meeting of the City Council to order at 7:35 p.m. 2. The invocation was given by the Reverend Edwin Linberg, Christian Church, Disciples of Christ, 9723 Garibaldi. 3. Mayor Harker led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen: Beckley, Briggs, Merritt, Tyrell, Harker ABSENT: Councilmen: None ALSO PRESENT: City Manager Koski, Assistant City Manager Recupero, City Attorney Martin, Director of Public Works Pizzorno, Traffic Engineer Envall, Administrative Assistant Lantz Councilman Briggs moved to approve the minutes of the regular meeting of November 4, 1969, seconded by Councilman Merritt and unanimously carried. . 6. YOUTH COMMISSION APPOINTMENTS AND ADMINISTERING OF OATHS: Mayor Harker advised that appointments to the Youth Commission had been made as provided by Resolution No. 69 -906, and that the followin persons were selected to serve on the Commission: Tom Conrow (17) - Robert Eisberg (17) - Arnol d Gaffrey (18) - Dana Godfrey (1 8) - Judith Golden (16) - Linda Harris (16) - Hector Hernandez (1 9) - Steven Johnson (15) - Shirley Mosser (14) - Leslie Sunell (15) - Kristie Woodland (16). - two -year term to December 31, 1971 one -year term to December 31, 1970 one -year term to December 31, 1970 two -year term to December 31, 1971 one -year term to December 31, 1970 two -year term to December 31, 1971 one -year term to December 31, 1970 two -year term to December 31, 1971 two -year term to December 31, 1971 one -year term to December 31, 1970 two - year.. .term to December 31, 1971 9 Councilman Briggs moved to confirm the appointments, seconded by Councilman Beckley and unanimously carried. Dave Wood, President of the Governing Board, Temple City Unified School District, commended the Council for demonstrating confidence in the youth of the community in appointing a Youth Commission, and for providing an opportunity to youth to make constructive efforts in behalf of government. Lou Gilbertson, Traffic Commissioner, congratulated the members of the new Youth Commission on their appointment, and offered the assistance of the County Youth Commission which consists of 15 youths and 5 adults, and of which Mr. Gilbertson was a member, urging estab- lishment of liaison with the County organization; and further, as a fellow- commissioner with the City of Temple City, offered personal cooperation and encouragement. Mayor Harker instructed the members of the Youth Commission- that there would be a joint meeting with the City Council on November 24, 1969, at 7:30 p.m. in the North Meeting Room of the City Hall. He also urged that they attend at least two meetings of other Commissions prior to their first organized meeting, preferably the Planning Commission and. the Parks and Recreation Commission. Councilman Tyrell stressed the importance of the maturity of the mem- bers of the Youth Commission in carrying out their responsibilities, in that the success of the Commission will depend on their ability to conduct their activities in a mature manner. 1 Council Minutes, November 18, 1969 - Page 2 UNFINISHED BUSINESS: 7. PUBLIC HEARING (Cont.): 7:30 p.m. Re. Amendment to Temple City Municipal Code with respect to walls, hedges and fences on corner and reverse corner and key lots in residential zones. City Manager Koski reported that the subject of height of walls, fences and hedges located on corner and reverse corner lots had been brought up by property owners on several occasions, and that, accord- ing to the Temple City Zoning Code, fences, walls and hedges could not be built or kept 6 ft. in height, unless located 10 ft. from the side property line adjacent to the street. Also, that the Planning Commission had met with the Traffic Commission to review and study the matter relative to zoning and traffic safety, and had recom- mended that 6 ft. walls or fences should be permitted on corner and reverse corner lots provided that such fences or walls are located 10 .ft. from the curb line, and the required triangular area main- tains adequate vision clearance for traffic safety purposes, as provided by Planning Commission Resolution No. 69-360PC. Councilman Briggs and Councilman Beckley expressed concern that 40" may not provide enough clearance, particularly with shrubs re- growing to taller heights within a short period of time, and that lot cars in particular may not have sufficent visibility for safe crossing at these intersections. Mayor Harker invited those who wished to speak either for or against the matter to come forward. No one wished to speak. Councilman Tyrell moved to close the Public Hearing, seconded by Councilman Beckley and unanimously carried. Councilman Tyrell moved to instruct the City Attorney to prepare an ordinance in accordance with Resolution No. 69- 360PC, Councilman Merritt seconded, and the motion carried unanimously. 8A. ORDINANCE NO. 69 -299: 1st read. Re. Deferment of Ordinance No. 69 -296, Relating to Holidays, until 1971. City Attorney Martin presented Ordinance No. 69 -299 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY SUSPENDING THE EFFECT OF ORDINANCE NO. 69 -296 RELATING TO HOLIDAYS, advising that the previ- ous ordinance had been adopted to conform to State holidays which had been revised by law; however, that, since the State laws will not be effective until January, 1971, the new ordinance will defer the effective date to coincide. Councilman Merritt moved to waive further reading, seconded by Mayor Harker and unanimously carried. 8B. ORDINANCE NO. 69 -298: 2nd read. Re. Amendment to Temple City Municipal Code Relating to Drive -in Businesses. City Attorney Martin presented Ordinance No. 69 -298 entitled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING PARAGRAPH 12 OF SECTION 9202 OF THE TEMPLE CITY ZONING CODE, for second reading. Councilman Beckley moved to waive further reading and to adopt by title only, seconded by Councilman Merritt and unanimously carried. III NEW BUSINESS: 9. RESOLUTION NO. 69 -971: Supporting Senate Finance Committee's action relative to tax exemption on Municipal bonds.. City Attorney Martin presented Resolution No. 69 -971 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY SUPPORT - ING THE DELETION OF ALL PROVISIONS LIMITING THE TAX EXEMPTION ON MUNICIPAL BONDS FROM THE TAX REFORM ACT OF 1969. Councilman Merritt moved to adopt, seconded by Councilman Beckley and unani- mously carried. Council Minutes, November 18, 1969 - Page 3 10. RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of Nov. 5, 1969 A. Item 7 - ENCINITA AVENUE, east side, opposite Woolley Street. Traffic Engineer Envall reported that field investigation dis- closed that Encinita Avenue narrows from a 36 -foot street to a 30 -foot street southerly of Woolley, and continues as a 30 -foot street northerly of Woolley, which affects the northbound traffic flow when cars are parked in the roadway. He advised that the Commission recommended the placing of 85 feet of red curb markings on the east side of Encinita Avenue, commencing 121 feet south of the south curb line prolongation of Woolley Street, northerly to a point 36 feet south of south curb line prolongation. Councilman Tyrell moved to approve, seconded by Councilman Merritt and unanimously carried. B. Item 8 - TEMPLE CITY BOULEVARD, Las Tunas Drive to north City Limit. Traffic Engineer Envall reported that,: based on speed checks taken on the widened portion of Temple City Boulevard north of Las Tunas with the existing 30 m.p.h. speed limit, it was indicated that 35 m.p.h. would be a more reasonable and prudent speed. He stated that no signs would be placed in the vicinity of the high school which is restricted by Vehicle Code regulations during the school period. He advised that areas beyond the city limits had a 25 m.p.h. limit, and no limit, but that the City of Arcadia and the County had indicated that they will be willing to conform to limits set in the City of Temple City. Councilmen Briggs and Tyrell were concerned that the setting of the higher limit may lead to excessive speeds since many people tend to drive five miles beyond whatever speed is posted. Councilman Briggs called attention to an enforcement problem on Temple City Boulevard, south of Las Tunas, advising that traffic in that section normally travels about 45 m.p.h. in the morning, and that radar cars did not seem to be covering this portion of the City. Mayor Harker requested the Traffic Engineer to provide any research material that may be available relative to how people react to posted speeds, such as generally driving 5 miles over posted speed limits, or general traffic speed patterns. Councilman Merritt noted that the signals on Temple City Boulevard were presently set for a traffic flow of approximately 31 to 32 m.p.h. without any interference from one signal to the next. Councilman Beckley moved to approve the recommendation of the Traffic Commission as presented by the Traffic Engineer, seconded by Councilman Merritt. The motion carried by the following roll call vote: AYES: Councilmen- Beckley, Merritt, Harker NOES: Councilmen - Briggs, Tyrell ABSTAINING: Councilmen -None C. Item 9 - TEMPLE CITY BOULEVARD AT ELLIS LANE - Additional Regulations. Traffic Engineer Envall advised that the traffic island at the intersection of Ellis Lane and Temple City Boulevard had been completed, and that the Commission recommended placing 163 feet of additional restricted "NO STOPPING AT ANY TIME" to open up visibility at this unusual intersection. Councilman Briggs moved to approve, seconded by Councilman Merritt and unan- imously carried. D. Item 11 - BROADWAY AT ROSEMEAD BOULEVARD - Left Turn Pockets and Parking Restriction. Traffic Engineer Envall advised that the Traffic Commission recommended placement of left turn pockets for Broadway at both approaches to Rosemead Boulevard, using existing and modified pressure pads which will necessitate '111\10 STOPPING AT ANY TIME" restrictions on the south side of Broadway, westerly of Rosemead, and the north side of _Broadway easterly of Rosemead for a distance of 300 feet in each direction, upon the completion of construction. Councilman Merritt moved to approve, seconded by Councilman Briggs and unanimously carried. Council Minutes, November 18, 1969 - Page 4 E. Item 14 - ALESSANDRO, southerly of Live Oak - Parking Res- triction. Traffic Engineer Envall reported that a message from the Sheriff's Department indicated a hazardous condition for cars making a turn onto Alessandro from Live Oak where the pavement is narrow, with no curb, in an unlighted area; and that the Traffic Commission recommended parking restriction on the west side of Alessandro for a distance of 50 feet, southerly of Live Oak. Councilman Tyrell advised that he was familiar with the intersection and did not feel that a 50 -foot restriction was sufficient, and suggested that two "PARK OFF PAVEMENT" signs be installed in addition to the 50 -foot parking restriction. Following discussion, it was moved by Councilman Tyrell, seconded by Councilman Briggs and unanimously carried, that the recommendation of the Traffic Commission be approved with the addition of two "PARK OFF PAVEMENT" signs as discussed. 11. SET PUBLIC HEARING: Sidewalk Improvements - Olive, south side, Alessandro to Buttons. Director of Public Works advised that petition for sidewalks on Olive, Alessandro to Buttons, south side, had been received for 75% of the total footage on the block. Councilman Merritt moved to set for Public Hearing on Tuesday, December 2, 1969, in the Council Chambers of the City Hall, seconded by Councilman Briggs and unanimously carried. 12. PERSONNEL APPOINTMENTS: City Manager Koski presented Resolution No. 69 -972, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL TEMPORARY. Councilman Briggs moved to approve, seconded by Councilman Tyrell and unanimously carried. 13. WARRANTS & DEMANDS: RESOLUTION No. 69 -973 - Demand Nos. 1031 through.1093, in the amount of $61,283.90 Councilman Tyrell moved to adopt Resolution No. 69 -973, A RESOLUTIO OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $61,283.90, DEMAND NOS. 1031 THROUGH 1093. Councilman Briggs seconded the motion which carried unanimously. 14. COMMUNICATIONS: City Manager Koski presented a request from Ami L. Partlow, owner of Camellia Family Billiards, to permit opening of the establishmen at 11:00 a.m. instead of 12 :00 noon, as presently required. Counci man Tyrell moved to approve, seconded by Councilman Beckley and unanimously carried. Mayor Harker inquired as to the status of the City of Temple City as a member of Town Affiliation Association, for which he had received an invoice for membership dues. City Manager Koski advised that the City was not a member of the Association. 15. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward. 16. MATTERS FROM CITY OFFICIALS: A. City Manager Koski reported that escrow was about to close on the acquisition of addition to Live Oak Park properties, and tha an amount of $212,877.25 would need to be appropriated to cover the costs. Councilman Tyrell moved to approve, seconded by Council- man Merritt and unanimously carried. N t t 1 1 Council Minutes, November 18, 1969 - Page 5 City Manager Koski advised that it was necessary to appropriate additional additional funds in the total amount of $234,716.74 from the General Fund and amend the Adopted Budget accordingly, for the following items: (a) Purchase of Live Oak Park properties - $212,877. (b) Purchase of Giffis property for Corporation Yard - 19,589. (c) Engineering services of Krelle & Lewis for Citywide Lighting District studies 2,250. Councilman Tyrell moved to approve the budget adjustments as outlined by the City Manager, seconded by Councilman Briggs and carried by the following roll call vote: AYES: Councilmen - Beckley, Briggs, Merritt, Tyrell, Harker NOES: Councilmen -None ABSTAINING: Councilmen -None B. City Manager Koski reported that right -of -way had been acquire for the completion of Daines Drive, and that plans were completed with construction scheduled for January 1970. C. City Manager Koski reported that a joint meeting with the City of Rosemead would be held on Thursday evening, November 20, 1969, at the Santa Fe Inn, at 6:30 p.m. D. Councilman Tyrell reported that the Committee on Dues and Membership Fees, California Contract Cities Association, had unan- imously recommended an increase in dues, which would provide approximately $12,000 a year. The proposed dues for Temple City would be $400. E. Councilman Tyrell reported that the report had been received from County Grand Jury to the County Board of Supervisors, relativ to costs for Sheriff's services. If the matter is decided to the disadvantage of the City in this particular contract, it may be found necessary to go another route in providing these services. F. Councilman Tyrell advised that the program for hosting the California Contract Cities meeting at the T & J Restaurant on December 17, 1969, had been arranged. 17 ADJOURNMENT: 25 49 00 d e Councilman Tyrell moved to adjourn to a study session at 9:48 p.m., Councilman Merritt seconded, and unanimously carried.
