PLANNING BOARD
September 22, 2009 -Minutes
A meeting of the Orleans Planning Board was called to order at 7:00 p.m. in the Nauset Meeting Room at the
Orleans Town Hall. Present: Chairman: John Fallender; Vice-Chairman: Seth Wilkinson; Clerk: Paul
O'Connor; Kenneth McKissick; John Ostman; Associates: Gary Guzzeau and Chet Crabtree. Planning
Department Staff: George Meservey; Secretary: Karen Sharpless. Board of Selectmen Liaison: Jon
Fuller. Also in attendance: Attorney Michael Ford(Town Counsel).
ZONING BYLAW DISCUSSION
Identify potential amendments for 2010 ATM
Planning Board members discussed a series of proposed zoning articles and made a determination of
what zoning proposals should proceed forward toward a public hearing process:
1. Corrective amendment on lots made unbuildable by expiration of plan freeze—to
be further reviewed by the Planning Board.
Planning Board members agreed to forward the following items to the Zoning Bylaw Task Force for
further review:
1. Amend zoning to reference new flood maps
2. Customary Home Occupations -upgrade definition and consider whether Special Permit
criteria should be added
3. Building Height-remove the reference to the street side which will make for a more
consistent building height in town.
4. Commercial Space in the Rural Business District—Define retail space,possibly increase
the allowable size per business from 1,500 square feet to 2,500 square feet.
5. Panhandle lots {§164-22A(5)} —limit the number of panhandle lots in a smaller
subdivision to one.
6. Transient Housing should be defined.
7. Beauty Salon vs. Beauty Parlor {§164-13}

Planning Board members discussed the possibility of a General Bylaw recommendation to
the Board of Selectmen regarding violations such as cutting public shade trees and
Selectmen Fuller informed Planning Board members that the Board of Selectmen would
accept recommendations from the Planning Board on amendments to the General Bylaws.
Enforcement of General Bylaws
John Fallender questioned the enforcement procedures of General Bylaw amendments which
have already been passed by town meeting, such as the lighting bylaw to which all
commercial businesses must comply as of May 2009. Selectmen Fuller stated that at the
present time, bylaw infractions are enforced after a complaint is received, but there is no
other current method of checking compliance town-wide.
