HomeMy Public PortalAbout97-087 (06-17-97)ci~ oF LYrrwooD LOS ANGELES COUNTY, CALIFOI2NIA RESOLUTION NO. 97-87 A RESOLUTION OF THE CITY COUNCIL OF Tf~ CITY OF LYNWOOD DECLARING ITS INTENTION TO LEVY A CHARGE (ASSESSMENT) AGAINST BUSINESS ENTERPRISES IN Tf~ LYNWOOD PARKING AND BUSINESS ~ IMPROVEMENT AREA FOR FISCAL YEAR 1997-98 AND SETTING A TIIv1E AND PLACE OF A PUBLIC HEARING TO CONSIDER SUCH A CHARGE WHEREAS, the City of Lynwood ("City") is a general law city ocganized and existing under the laws of the State of Califomia; and WHEREAS, pursuant to the Parking and Business Improvement Area Law of 1979, former Par[ 6(commencing with Section 36500) of Division 18 of the California Sffeets and Highways Code, the City Council adopted Ordinance No. 1262 establishing a pazking and business improvement area; and WHEREAS, the Pazking and Business Improvement Area Law of 1979 was repealed and replaced with the Pazking and Business Improvement Area Law of 1989 (California Streets and Highways Code Sec[ions 36500, et seg.) (the "Law"), which provides that every improvement azea established prior to Januazy 1, 199Q in accordance with the Pazking and Business Improvement Area Law of 1979 is valid and effective and is unaffected by the repeal of that law; and WHEREAS, the City's pazking and business improvement azea includes all of the territory within the exterior boundaries of the City, as the same existed on the date of adoption of Ordinance No 1262; and WHEREAS, the Law requires that the City Council appoint an advisory boazd for the City's pazking and business improvement azea and annually undertake pmceedings to levy a chazge (assessment) against every business enteTprise located therein; and t WHEREAS, by a previous resolution, the Ciry Council es[ablished an Advisory Boazd for the City's pazking and business improvement azea and directed the Advisory Boazd to prepaze a report for fiscal year 1997-98, and modified that repoII before directing that it be filed with the City Clerk; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL AS FOLLOWS: Section 1. The City Council declares its irtention, in addition to any assessments, fees, chazges or taxes imposed by the City, to levy and collect a chazge (assessment) in an amount equal to 50% of the business license tax payable by every business entetprise during fiscal year 1997-98. This charge (assessment) levied and collected in fiscal yeer 1996-97. The charge is due and payable at the same time and in the same manner that the business license tax is paid and is subject to the same penalties and interest for nonpayment Section 2. The proposed uses of the revenues derived from chazges (assessment) levied against business enteiprises in the pazking and business improvement distriGt are for the following adivities: ~ (a) The decoration of public places in the azea. (b) The promotion of public events that are to take place in the area. (c) The furnishings of music in public places in the azea. (d) The general promotion of business activilies in the azea. Section 3. The boundaries of the Lynwood pazking and business improvement azea include all of the territory within the ex[erior boundaries of the City. , Sec[ion 4. The Advisory Boazd report for fiscal year 1997-98 is on file with the City Clerk and available for public inspection. Reference is made to that report for a descriprion of the adivities to be provided for fiscal yeaz 1997-98. Section 5. A public hearing conceming levying a chazge (assessment) against all business enterprises in the pazking and business improvement azea for the 1997-98 fiscal year will be held on'I~esday, July 15, 1997, at 7:30 p.m., or as soon thereafter as the mat[er can be heard, at the City Council's regulaz meeting to be held in the City Council Chambers at 11330 Bullis Road, Lynwood. Written and oral protests may be made at that public hearing. At the public hearing, the City Council will heaz and consider all protests and receive evidence, including written protests, for and against levying a charge against business entetprises in the parking and business improvement area during the e1997-98 fiscal yeaz. Written protests must be filed with the Ciry Clerk at or before the time fixed for the public hearing. Mailed protests must be received in the office of the City Clerk, 11330 Bullis Road, Section 5. Continued ' Lynwood, Califomia, 90262, prior to 6:00 p.m. on July 15, 1997. A written protest may be withclrawn in writing at any time before [he conclusion of the public hearing. Each written protest shall contain a descripfion of the business enteiprise in which the person submitting the protest is interested sufficient to identify the business enterprise and, if that person is not shown on the official records of the City as the owner of the business enteiprise, the protest must cornain or be accompanied by written evidence tttat the person sioning the protest is the owner of the business. Any protest pertaining to the regularity or sufficiency of the proceedings must be in writing and must set for[h the uregularity of defect to which the objecrion is made. Section 6. The City Clerk is directed to certify to the adoption of this ResoluGon and to give notice of the public hearing in accordance with the law.
