A RESOLUTION OF Tf~ CITY COUNCIL OF Tf~ CITY OF LYNWOOD
MODIFYING Tf~ REPORT OF THE ADVISORY BOARD FOR FISCAL
YEAR 1997-98 IN CONNECTION WITH THE LYNWOOD PARKING AND
BUSINESS IIvIPROVEMENT DISTRICT
WHEREAS, the City of Lynwood ("City") is a general law city oxganized and exisflng
under the laws of the State of California; and
WHEREAS, pnrsuant to the Pazking and Business Improvement Area Law of 1979,
former Part 6(commencing with Section 36500) of Division 18 of the Califomia Streets and Highways
Code, the City Council 1985 adopted Ordinance No. 1262 establishing a pazking and business
improvement azea; and
WHEREAS, the Pazking and Business Improvement Area Law of 1979 was repealed
and replaced with the Parking and Business Improvemem Area Law of 1989 (Califomia Streets and
Highways Code Sections 36500, et seg.) (the "Law"), which provides that every impiovement azea
established prior to January 1, 1990, in accordance with the Pazking and Business Improvement Area
Law of 1979 is valid and effective and is unaffected by the repeal of that law; and
WHEREAS, the city's pazking and business improvement area includes all of the
territory within the exterior boundaries of the Ciry, as the same existed on the date of adoption of
' ordinance No. 1262; and
WHEREAS, the Law requires that the City Council appoint an advisory boazd for the
City's parking and business improvement azea and annually undertake proceedings to levy a chazge
(assessment) against every business enterprise located therein; and
WHEREAS, by a previous resolution, the City Council established an Advisory Boazd
for the City's pazking and business improvement area and directed the Advisory Boazd to prepaze a report
for fiscal yeaz 1997-98.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL AS FOLLOWS:
Section I. In accordance with the directives of the City Council, the Advisory Boazd
prepazed a report for fiscal yeaz 1997-98 in connection with the Ciry's pazldng and business improvement
area, and that report was filed with the Ciry Clerk and presented to the City Council for consideration at
its regulaz meeting held on June 17, 1997.
Section 2. The Advisory Boazd made and approved the following recommendations:
Lynwood Chamber of Commerce $ 90,OOOAO ( Allocation for 1997-98 FP)
City of Lynwood $ 15,000.00 ( Carryover Funds from 1996-97 FY)
Total $ 105,000.00
These allocations aze to be expended solely for the purposes authorized by State law, all of which aze
~ identified in the report. The report does not propose any changes in the boundazies of the parking and
business improvement area, the basis and method of levying the assessments, or the classificarion of
businesses. There aze no suiplus or deficit revenues to be carried over from the previous fiscal year, and
no coutribuGons aze to be made from sources other than [he assessments.
