HomeMy Public PortalAbout97-105 (07-15-97)CITY OF LYNWOOD LOS ANGELES COUNTY, CALIFOItNIA RESOLUTION NO. 97-105 A RESOLUTION OF Tf~ CI1'I' COUNCIL OF THE CITY OF LYNWOOD , AP~tOViNG THE LEVY OF A CHARGE (ASSESSMEN'17 AGAINST BUSINESS ENTERPRISES IN THE LYNWOOD PARKING AND BUSINESS IlvIPROVEMENT AREA FOR FISCAL YEAR 199'7-98 WHEREAS, the City of Lynwood ("City") is a general law city organized and existing under the laws of the State of Califomia; and WHEREAS, pursuant to the Parking and Business Improvement Area Law of 1979, former Par[ 6(commencing witli Section 36500) of Division 18 of the California Streets and Highways Code, the City Couttcil adopted Ordinance No. 1262 establishing a parldng and business improvemcnt azea; and WHEREAS, the Pazicing and Business Improvement Area Law of 1979 was repealcd and replaced with the Parking and Business Impmvemert Area Law of 1989 (California Streets and Highways Code Sections 36500, et seg.) (the "Law"), which provides that every improvement azea established prior to January 1, 1990, in accordance with the Pazking and Business Improvement Area Law of 1979 is valid and effective and is unaffec[ed by the repeal of that law; and WHEREAS, the City's parking and business impmvement azea includes all of Uie territory within the e~c[erior boundazies of the City, as the same existed on the date of adop[ion of Ordinance No 1262; and WHEREAS, the Law requires that the City Council appoint an advisory boazd for ilie City's pazking and business improvement area and annually undertake proceedings to levy a charge (assessment) against every business enterprise located therein; and , WHEREAS, by a previous resoluflon, the City Council established an Advisory Bo:ird for the City's parking and business improvement area and direc[ed the Advisory Boazd to prepare a report for fiscal year 1997-98, and modified that report before direcfing Utat it be £iled with the City Clerk; NOW, THEREFORE, BE IT RESOLVED BY TfIE CITY COUNCIL AS FOLLO\VS: Secrion 1. Through the passage of a resoluUOn on June 17, 1997 the City Couucil has declared its inten6on, in addition to any assessments, fees, chazges or ta7ces imposed by the City, to levy and collect a charge (assessment) in an amount equal to 50% of the business license tax payablc by every business enteiprise during fiscal year 1997-98. This charge (assessment) levied and wllected in fiscal year 1996-97. The charge is due and payable at the same time and in the same mazmer that tl~c business license ta7c is paid and is subject to the same penalties and interest for nonpaymem. Secflon 2. The proposed uses af the revenues derived from chazges (assessmcnt) levied against business enterprises in the parking and business improvement distdct aze for the followiug activities: (a) The decorarion of public places in the azea. (b) The pmmouon of public events that ue to take place in the azea. (c) The fundsitings of music in public places in the azea. (d) The genecal promotion of business activities in Uie azea. Secrion 3. The boundaries of the Lynwood pazking and business improvemcnt ' azea include all of the territory within the enterior boundaries of the City. Section 4. The Advisory Boazd repor[ for fiscal yeaz 1997-98 is on file wiUi die City Clerk and available for public inspection. Reference is made to that report for a descripfion of thc activities to be provided for fiscal year 1997-98. Section 5• Apublic heazing concerning levyu~g a charSa (assessment) aguinst all business entecprises in the parking and buslness impmvement azes for the 1997-98 fiscal yeaz was l~cld on Tliesday, July 15, 1997, at 730 p.m., at the City Council's regulaz meeting to be held in the City Council Chambers at 11330 Bullis Road, Lynwood. At the public hearing, the City Council was prepazed to hear and consider all protests and receive evidence, including written protests, for and agau~st levying a ehazge against business entecprises in the parking and business impmvement azea during Uie 1997-98 fiscal year.
