TEMPORARY HOUSING FOR CONSTRUCTION PROJECTS
BE IT ORDAINED BY THE CITY OF TIFFIN, IOWA:
SECTION 1 : PURPOSE. The purpose of this ordinance is amend Section 8(1)
of Ord.allo. 83 (Zoning) to provide for the highest and best of use of property in the City
of Tiffin, and to allow the use and development of established buildings and uses in
the City that would be unduly restricted by current ordinance provisions.
SECTION 2: AMENDMENT TO SEC. 8 (1) OF ORD. 83. The following shall be
added after,the final existing sentence'found in Sec. 8 (1): °However, upon notice
provided with the submission of an application for a building permit'an applicant may
provide temporary housing for one person at a construction site so long as the
occupant is involved in the construction project, the temporary quarters are safe and
habitable, and the occupancy shall not exceed the reasonable time to complete the
construction project. If the applicant meets these criteria the temporary housing,shall
not be in violation of this ordinance, other provisions herein notwithstanding."
SECTION 3: REPEALER. All ordinances or parts of ordinances in conflict-with
the'provisions of the Ordinance are hereby 'repealed.

SECTION 5: SEVERABILITY. If any section, provision, or part of this Ordinance'
_shall be adjudged to be invalid or unconstitutional, such adjudication shall no affect
the validity of the.ordinance as a whole, or any section, provision, or part thereof not
adjudged invalid or unconstitutional.

f, RATIFICATION:
On the 11th day of October , 1995, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Brown introduced Ordinance
No. 1995- 200 ., and moved that it be given its first reading. The motion was
seconded by Councilperson Stratton
Ayes:: Bartels , Brown, Morgan , and Stratton
Nays: None . Absent : Kern
Four members of the council being present and having voted "Aye", Mayor
Glen Potter Declared the Motion carried, that Ordinance No.
1995- 200 was read for the first time and placed on the record.
Thereupon, it was moved by Councilperson Bartels and
seconded by Councilperson Morgan that the laws and rules
providing that ordinances be considered and voted on for passage at two council
meetings prior to the meeting at which it is to be finally passed by suspended and
dispensed with and that Ordinance No 1995-200 be placed on its last reading.
Ayes: Brown , Morgan , Bartels , and Stratton
Nays: None. Absent.: Kern
Four members of the council being present and having voted "Aye", Mayor
Glen Potter thereupon declared the motion to be carried, and Ordinance No.200 was
then placed upon its last reading and was read the last time.
Thereupon, it was move by Councilperson Brown 1995 and
seconded by Councilperson Stratton that Ordinance No. 1995- 20°
be placed upon its final passage and adopted.

Nays: None . Absent : Kern
Four members of the Council being present and having voted "Aye", Mayor
Glen Potter declared the motion carried, and the Ordinance passed and adopted.
Whereupon the Mayor declared that Ordinance No. 200 be adopted and
signified his approval of the same by affixing his signature thereto.
Passed by the Council on the lit hday op c t o b e r, 1995, and approved by the
Mayor on the 11thclay of October1995.

The foregoing ordinance entitled "NON-CONFORMING USE AMENDMENT
ORDINANCE" was published on the 14th day ofoctober, 1995, by posting copies of
it in four public places within the City limits: the U.S. Post Office, the Fire Station/City
Hall, Morgan's Standard, and Flansburg's Hardware Store, all according to the
requirements of Iowa Code § 362.3(2) (1991) and Tiffin Ord. No. 1980-89.
