HomeMy Public PortalAboutResolution 2016-08-03 Approving the Final Plan and Final Plat for East Mountain Filing 10 (EMF10) - A Portion of Filing No. 1 Rendezvous Planned Development DistrictTOWN OF FRASER RESOLUTION NO. 2016-08-03 A RESOLUTION APPROVING THE FINAL PLAN AND FINAL PLAT FOR EAST MOUNTAIN FILING 10 (EMF10) - A PORTION OF FILING NO. 1, RENDEZVOUS PLANNED DEVELOPMENT DISTRICT, LOCATED IN SECTION 28, TOWNSHIP 1 SOUTH, RANGE 75 WEST OF THE 6T" P.M., TOWN OF FRASER, GRAND COUNTY, COLORADO WHEREAS, at the regular meeting of the Fraser Planning Commission held on May 25, 2016 and a special meeting of the Fraser Planning Commission held on June 8, 2016 Rendezvous Colorado, LLC requested a recommendation of approval for a Final Planned Development Plan (FPDP/Final Plan) and Preliminary Plat for East Mountain Filing 10 and the Planning Commission recommended approval via Resolution 2016-06-01; and WHEREAS, at the regular meeting of the Planning Commission held on July 27, 2016, Rendezvous Colorado, LLC requested a recommendation of approval for a Final Plat for East Mountain Filing 10; and WHEREAS, Rendezvous Colorado LLC is the current owner of the property known as EMF10, approximately 7.21 acres; and WHEREAS, Rendezvous Colorado LLC is requesting final plan and final plat approval which would create 18 homesites; and WHEREAS, Staff has determined that this application is in compliance with the subdivision and zoning regulations of the Town of Fraser; and WHEREAS, the Planning Commission finds that the applicant has presented evidence that changes in conditions have occurred to support the proposed amendments to the Final Planned Development Plan, including the requested density transfer to Filing No. 10; and WHEREAS, the Planning Commission recommended approval of the Final Plat via Resolution 2016-07-01. NOW THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO THAT: The Town Board of Fraser, Colorado hereby approves the Final Plan and Final Plat for EMF10, Rendezvous PDD with the following conditions: 1. All engineering documents to be approved by Town Engineer. 2. All legal documents to be approved by Town Attorney. 3. Payment of all applicable fees 4. Execution of all documents within 90 days of the adoption of this Resolution. 5. Provide 911 mylar and electronic copy of the plat in accordance with the Subdivision Regulations. 6. Approval of the three variance requests as presented in the TKE Engineering memos dated March 23, 2016 and June 28, 2016 and as supported by the Town Engineer per the JRS memo dated July 8, 2016. If such conditions are not satisfied, the approval provided by this resolution is no longer valid. DULY MOVED, SECONDED AND ADOPTED THIS 3rd DAY OF August, 2016.
