HomeMy Public PortalAbout20140602 - Conservation Commission - Meeting Minutes Conservation Commission Meeting 02 June 2014 Page 1 of 3 02 June 2014 Called to Order: 7:30 PM Town Hall, Room 216 Adjourned: 9:15 PM Members Present: Jeffrey Barnes, Craig Nation, Melissa Recos, Kerry Reed, Marcus Waldron, Don MacAdam: Conservation Administrator, Bob Ingram: Conservation Scientist, Anna Rogers, Inspections Administrative Assistant Members Absent: Frank D’Urso 7:30 PM Commission Business • The Commission signed the following documents: - Chen, 18 South Mill St – Certificate of Compliance (188-1374) • The Commission reviewed the following documents they signed previously. - South Mill Street LLC, 1 Hunters Ridge Way – Order of Conditions (188-1548) - Garland, 50 Downey Street – Corrected Order of Conditions (188-1501) – changed owner name and address to satisfy Registry of Deeds. • The Commission reviewed the project changed as identified on site plan with a final revised date of 28 May 2014 from Kelleher, 232 Ash St (188-1485) regarding site work within the previously disturbed vernal pool buffer zone. The Permanent Immovable Barrier (PIB) was brought further away from the vernal pool except for the patio area which was brought closer. Mr. Waldron made a motion to determine the Notice of Project Change to be an insignificant project change. The motion was seconded by Ms. Recos and it passed unanimously. • The Commission reviewed the project change dated 30 May 2014 from Garland, 50 Downey St (188-1501) to replace the lake retaining wall and remove a tree which has roots impairing on the wall. It was noted the tree would be replaced with a native species. Mr. Waldron made a motion to determine the Notice of Project Change to be an insignificant project change. The motion was seconded by Ms. Recos and it passed unanimously. • The Commission reviewed the project change dated 02 June 2014 from Verrecchia, 292 Hayden Rowe (188-1516) to install an underground sprinkler system. Mr. Waldron made a motion to determine the Notice of Project Change to be an insignificant project change. The motion was seconded by Mr. Recos and it passed unanimously. 7:45 PM Torti, 175 & 177 Spring Street RDA 2014-4 Request for Determination of Applicability – continued Robert Murphy, RG Murphy and Associates; Chris Torti, applicant Conservation Commission Meeting 02 June 2014 Page 2 of 3 Mr. Murphy provided an overview of his report dated 24 May 2014. A discussion was held regarding whether an isolated depression area qualified as an isolated wetland under the Bylaw. Mr. Waldron made a motion to close the hearing and issue a Negative Determination of Applicability and noting the Commission is in agreement with the wetland delineation as identified on the site plans dated 18 February 2014 with a final revision date of 25 March 2014. The motion was seconded by Mr. Nation and it passed unanimously. 8:05 PM Niss, 3 Colella Farm Road DEP File No. 188-1245 Violation Discussion Dave Marquedant, JD Marquedant & Associates, Inc.; Knut Niss, owner Mr. Niss provided the Commission with an overview of the development history for the property. He stated that the original ground cover plantings did not survive and that he planted turf grass to stabilize the site. A discussion was held regarding planting ground cover plants to overtake the established turf grass. It was noted that Requests for Certificates of Compliance for the Order of Conditions issued by the Commission and the Superseding Order of Conditions issued by MassDEP have not been received to date. Mr. Niss noted he will submit Request for Certificate of Compliance applications. 8:25 PM Legacy Farms LLC, East Main Street DEP File No. 188-1551 (Ray Street to 151 East Main Street) Notice of Intent – continuation Roy MacDowell, applicant Mr. MacDowell provided an overview of the stormwater report dated 02 June 2014 and changes to the layout of the walkway. The Commission determined to have BETA Group review the stormwater report. The hearing was continued to 23 June 2014. 8:35 PM Legacy Farms LLC, Legacy Farms Road South DEP File No. 188-1469 Violation Discussion Roy MacDowell A discussion was held regarding the breaching of a beaver dam without authorization under the state and town wetland laws. Mr. MacDowell stated he wasn’t sure who performed the work but would make sure the proper procedures would be followed in the future. The Commission determined to hold any further enforcement proceedings in abeyance subject to Legacy Farms LLC preparing a beaver management plan for the site and submitting the plan to the Commission for review and approval. Mr. MacDowell stated that he would retain a consultant to draft a beaver management plan for the site and provide it to the Commission for review. 8:40 PM Pyne, 4 Christian Way, 189 Pond Street, 191 Pond Street DEP File No. 188-1539 Notice of Intent – continuation Dave Marquedant, JD Marquedant & Associates; Jim Pyne, applicant/owner Conservation Commission Meeting 02 June 2014 Page 3 of 3 A discussion was held regarding BETA Group’s memo dated 28 May 2014. It was noted that snow would not be stockpiled within the stormwater BMP’s. Mr. Marquedant noted the stormwater management design was engineered without the need to infiltrate roof runoff. Mr. Waldron made a motion to close the hearing and issue an Order of Conditions with the standard and noted special conditions, subject to the submittal of the Homeowners Association documents. The motion was seconded by Ms. Recos and it passed unanimously. 8:55 PM Commission Business • A discussion was held regarding HCAM’s requests to cover Commission meetings. The Commission was amenable to HCAM video recording Commission meetings. • A discussion was held regarding the status of Golden Pond, 50 West Main St (188-1436) and standing water in the stormwater basin. It was noted that the basin is being referred to as a Detention Basin instead of an Infiltration Basin in some documents. The Commission requested Mr. MacAdam to contact Golden Pond and request an as-built plan which the Commission can have FST review on their behalf. • A discussion was held regarding the status of a town-owned parcel, 0 College St (R34 31 0), which the Commission manages on behalf of the town. It was noted that somebody has apparently been blocking a narrow point of the existing stream channel with debris, which in turn has caused water to impound an area on the eastern portion of the property.
