HomeMy Public PortalAboutOrdinances-1995-202 (. 1 ORDINANCE NO. 1995- 202 PROHIBITION OF PRIVATE WELLS IN THE CITY BE IT ORDAINED BY THE CITY OF TIFFIN, IOWA: SECTION 1 : PURPOSE. The purpose of this ordinance is to provide for uniform water service inside the City; protect the public health; and maintain the current municipal water system. SECTION 2: WELLS PROHIBITED AND EXCEPTIONS: Privately owned and maintained wells inside the City are prohibited if a City water main abuts the property line by either right of way or easement. New wells may be sunk if the City Council certifies to a property owner that the City is not prepared to provide water service within a reasonable time after the application is made for the service. A property- owner may petition the Council for approval of a well constructed and used for non- potable purposes, and the Council may grant such an exception if it finds the well is not intended for residential or commercial use and it is otherwise in the best interest of the City to grant such an exception. The City shall refer all applications for such exceptions to the City Engineer for review and comment. The property owner shall remain liable for meeting all other applicable state and county regulations and laws governing the location and operation of wells. SECTION 3: REPEALER. All ordinances or parts of ordinances in conflict with the provisions of the Ordinance are hereby repealed. SECTION 5: SEVERABILITY. If any section, provision, or part of this Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall no affect Ordinance 1995-202 Pg.2 the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. RATIFICATION: On the 13thday'of Der-either , 1995, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Pam Brown introduced Ordinance No. 1995- 202 , and moved that it be given its first reading. The motion was • seconded by Councilperson James Bartels . Ayes:: Pam Brown, Jim Bartels, Carrie Stratton and Alan Kern Nays: None Absent: Sandra Morgan Four members of the council being present and having voted "Aye", Mayor Glen Potter Declared the Motion carried, that Ordinance No. ' 1995-4202 was read for the first time and placed on the record. Thereupon, it was moved by Councilperson Carrie Stratton and seconded by Councilperson Pam Brown that the laws and rules providing that ordinances be considered and voted on for passage at two council meetings prior to the meeting at which it is to be finally passed by suspended and dispensed with and that Ordinance No 1995- 202 be placed on its last reading. Ayes: Pam Brown, Alan Kern. Carrie Stratton and Jim Bartels Nays: None Absent: Sandra Morgan Four members of the council being present and having voted "Aye", Mayor Glen Potter thereupon declared the motion to be carried, and Ordinance No)995-2O was then placed upon its last reading and.was read the last time. 2 Well Prohibition Ord Ordinance 1995-202 pg.3 Thereupon, it was move by Councilperson Alan Kern 1995 and lAre seconded by Councilperson Pam Brown that Ordinance No. 1995- 202 be placed upon its final passage and adopted. Ayes: Carrie Stratton, Pam Brown, Jim Bartels, and Alan Kern Nays: None. Absent: Sandra Morgan Four members of the Council being present and having voted "Aye", Mayor Glen Potter declared the motion carried, and the Ordinance passed and adopted. Whereupon the Mayor declared that Ordinance No.1gq5--2noe adopted and signified his approval of the same by affixing his signature thereto.
