KO OWNPIt without invalidating the Contract may order extra work or make changes by altering,adding to or deducting from the work,the contract sum being adjusted ecrnrdmgly. All such work shall he executed under th- renditions hereof,except that any claim caused thereby shall he adjusted at the time of ordering such change. 9. In giving instructions, the OWNER shall have authnrtty In make minor changes in the work not involving extra cost and not inconsistent with the purposes of the building but otherwise except in an emergency endangering life or property no extra work or change shall he made unless in pursuance of a written order from the OWNER.vaned by an officer of OWNER,and no claim for anv addition to the contract sum shall he valid unless so ordered. 10.The value of any extra work or change not minor,ordered by the OWNER in writing,shall he determined in one or more of the following ways: (a)Ry estimate and acceptance in a lump sum. (h)Hy unit prices named in the contract or subsequently agreed upon, (c)Hy cost and percentage or by cost and fixed fee. 11.If CONTRACTOR claims that any written change order given pursuant to paragraph 9 above involves extra cost under this Agreement,he shall immediately give written notice of such claim to OWNER,and shall not proceed with the work affected by such change order until the method of determining the value of any extra work required by such change order has been agreed to in writing between the parties.In the absence of such an agreement,CONTRACTOR shall have no right to claim any addition to the contract sum in respect of CONTRACTOR'S compliance with such change order.In the event it is agreed between the parties that the value of extra wnrk required by a change order shall he determined under the provisions of sub-parsgraph(c)of the preceding paragraph.CONTRACTOR shall keep and present x correct account of the cost,together with vouchers,including not to exceed a ten percent(10%)allowance for profit to the CONTRACTOR. 12. Neither the final certificate nor payment not any provision hereof shall relieve the CONTRACTOR of responsibility for faulty materials or workmanship and unless otherwise specified he shall promptly remedy any defects due thereto and pay for any damage to other work resulting therefrom which shall appear within a period of nne year specified the date of occupancy of any building provided for hereunder,or one year from the date of substantial completion with respect to other improvements provided for hereunder.OWNER shall give written notice of observed defects with reasonable promptness. 13.If the CONTRACTOR shall neglect to prosecute the work properly or fail to perform any covenant or condition of the Contract,the OWNER after Twenty- Four Hours written notice to the CONTRACTOR may without prejudice or any other remedy(including any remedy available under Paragraph 4of Article 111)it may have,make Rood such deficiencies and may deduct the cost thereof from the payment then or thereafter due CONTRACTOR. 14.CONTRACTOR shall do all cutting, fitting or patching of his work that may be required to make its several parts come together properly and fit it to re- ceive or be received by work of other CONTRACTORS shown upon or reasonably implied by the drawings and specifications forth*completed structure.Any Cost caused by defective or ill-timed work shall be borne by CONTRACTOR.CONTRACTOR shall not endanger any work by cutting,digging or otherwise and shall not cut or alter the work of any CONTRACTOR save with the cnnsent of OWNER.
