OF THE CITY OF LYNWOOD PROPOSING A TAX REDUCTIO.N AND RATE STABILIZATION PLAN FOR THE PURPOSE OF REDUCING UTII.ITY USERS TAX RATES, ELIlI~IINATING THE MONTHLY FEE FOR THE RESIDENTTAL CURBSIDE RECYCLING PROGRAM, AND PROVIDING FUNDING FOR IIVIPROVEMENTS IN PUBLIC SAFETY SERVICES, STREET REPAIRS AND IlVIPROVEMENTS, AND Il~ROVEMENTS IN PARKS AND RECREATION SERVICES AND OTHER COMMUNITY SERVICES, WHICH PLAN IS DEPENDENT UPON 'I~ ADOPTION OF A SPECIAL TAX WITHIN THE Cl1'Y, PURSUANT TO GOVERNMENT CODE SECI'ION 53724; CALLING AND GIVING NOTICE OF THE HOLDING OF A SPEC7AL MUNICIPAL EI.ECI'ION TO BE HELD ON TUESDAY, NOVEMBER 4, 1997; SUBMITTING TO THE VOTERS IN THE C1TY A PROPOSTITON FOR THE ENACTMENT OF AN ORDINANCE IlrIPOSING A SPECfAL PARCEL TAX W1THIN THE C1TY PURSUANT TO GOVERNMENT CODE SEGTION 53724 AND ELECTIONS CODE SECTION 9222; AND REQUESTING THE BOARD OF SUPERVLSORS OF THE COUNTY OF LOS ANGELES TO CONSOLIDATE THE SPEC7AL MUNICIPAL ELECTION W1TH THE SCHOOL DISTRICT ELECTION TO BE HELD ON NOVEMBER 4,1997 WHEREAS, the City Council of the City of L}mwood desires to call a special dection ' for the purpose of submitting to the qualiSed electors of the City the question of whether they will approve a proposition to be lmown as the "Tax Reduction and Rate Stabilization Plan' ; and WHEREAS, if adopted, the proposition will reduce utility users tax rates, etiminate the momhly fee for the residential curbside recycling program, and provide funding for improvements in law enforcemem and Sre services, street repairs and improvements, and improvements in park recreation services and other community se~vices; and WHEREAS, in accordance with the requiremems of the laws of the State of Califomia relating to general law cities, the City Council of the City of Lynwood calls and orders to be held in the City of L}~nwood, Califomia, on Tuesday, November 4, 1997, a Special Muniapal Election to enable the qualifie~ electors of the City to detemrine whether to adopt the Tax Reduction and Rate Stabilization Plan; NOW, THEREFORE, THE CITY COUNCII, OF THE CI1'Y OF LYNWOOD RESOLVES, DECLARES, DETERMINES AND ORDERS AS FOLIAWS: SECTION 1. The adoption of a special tax for the pwpose of reducing utility users tax rates, eliminating the mornlily fee for the residential cucbside recycling progran~, and providing funding for improvements in public safety services, street repairs and improvemerrts, improvements in parks and recreation services and other community services, is hereby proposod in accordance with ' Government Code Section 53724(a) in the form and az the rates stated in Ordinance No.1462, wltich is attached hereto and incotporated by Uus reference. The type of tax, the rate and ma~dmum amourn of tax, the pertnissible uses of the tax, and the method of its collection are stated in Ordinance No.1462. In accordance with Govemment Code Sections 50077 and 53724(d), this proposal will be preseated to the voters residing within the City ai a special election called for that puipose to be held on November 4, 1997. SECTION 2. In accordance with the requiremems of the laws of the State of Califomia relating to general law cities, there is hereby called and ordered to be held vvithin the City of Lynwood, California, on Tuesday, November 4, 1997, a Special Municipal Election to be conducted as required by all applicable provisions of the California Elections Code. SECITON 3. In accordance with California Elections Code Section 9222, the City Council orders submitted to the voters at the Special Municipal Election the following question: PROPOSITION B Shall Ordinance No. 1462, to be Imown as "Tu Reductiou and Rate Stabilization Plan," be adopted to levy a Special Parcel Taz for the purpo~e of reducing utility users taz rates, diminating the monthly fee for the residentis! curbside recyeling program, and providing funding for improvement4 in public safet} services, sd+cet repairs and improvements, and improvements in park and recreation savices and ot6er community services? SECI'ION 4. By Resolurion No. 97-92, adopted by the City Gouncil on Juce 17, 1997, the City Council called and gave notice of the holding of a General Municipal Election to be l~d on Tuesday, November 4, 1997, for the election of certain officers as required by the provisions of the laws of the State of Califomia relating to general law aties. SECTION 5. By Resolution No. 97-91, adopted by the City Council on June 17, 1997, the City Council requested the Board of Supervisors of the County of Los Angeles to consolidate the General Muniapal Election to be held on November 4, 1997, with the School Disttict Election to be held on that same date, pursuant to Section 10403 of the Califomia Elecdons Code. SECI'ION 6. In accordance with Section 10403 of the Califomia Elections Code, the Board of Superviso~ of the County of Los Angeles is requested to consern and agee to the consolidation of the Special Municipal Election referenced above in Section 2 with the School District Election to be held on November 4, 1997. SEC1'ION 7. The ballots to be used at the Special Municipal Election called for by this Resolution will be in fonn and content as required by Iaw. SECTION 8. The City Clerk is dir~ to cause to be published a synopsis of the proposition to be submitted at the Special Municipal Election in the time, manner, and form required by Section 12111 of the Califomia Elections Code. SEGTION 9. In accordance with Section 10002 of the California Flections Code, the Boazd of Supervisors of Los Angeles Cow~ty is requested to consent to the Registrar of Voters rendecing election services to the City of Lynwood as may be requested by the City Clerl~ and the County of Los Angeles will be reimbursed in fiill for all services that are performed. SECTIOIV 10. The election services that the City of Lynwood requests the Registraz of Voters, or such other official as may be appropriate, to perform, and which services that officer is authorized and directed to perform if the Board of Supervisors consents, include: the preparation, priming, and mailing of the o~cial and sample ballots, the canvassing of the returns of the election, the fiunishing of the results of that canvassing to the City Clerk of the City of Lynwood, and tt~ performance of such other election services as may be requested by the City Clerk. SECTION 11. The polls for the election will be open ai seven o'clock a.m. of the day of the election and will remain open continuously from that time urnil dght o'clock p.m. of the same day when the polls will be closed, eucept as provided in California Elections Code Section 14401. ~ SECiTON 12. In all particulars not recited in this Resolution, the election will be held and conducted as provided by law for the holding of municipal elections. L~' SEGTION 13. Notice of the time and place of holding the election is hereby given, and the City Clerk is directed to give furfher or additional notice of the electio~ in the time, manner, and form as required by law. SECI'ION 14. The City Clerk will receive the cam~ass as it pertains to the $pecial Municipal Electioq and will certify the results to this City Council, as required by law. SECI'ION 15. The Ciry Clerk is directed to certify to the passage and adoption of this Resolution and to file a certified copy of this Resohrtion with the Los Ang~es Coiu~ty Board of Supervisors and the Los Angeles Election Departmem.
