CITY OF TIFFIN, ORDINANCE NO . ,
AN ORDINANCE AMENDING ORDINANCE NO. 1996-204 (ZONING
ORDINANCE) OF THE MUNICIPAL CODE OF TIFFIN, IOWA REGARDING
R3 'ZONES TO ALLOW FOR ZERO LOT LINE STRUCTURES ON SEPARATE
ADJOINING ,LOTS AND TO ALLOW FOR R3 ZONE SINGLE-FAMILY
RESIDENCES WITH 50 FOOT FRONT YARD WIDTHS
BE IT ORDAINED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1 . Purpose : The purpose of this ordinance is
to amend City of Tiffin Ordinance No . 1996-204 §5 . 07 (D) ( 4 )
and ( 5) regarding R-3 zones to specifically allow zero lot-
line structures on separate adjoining lots and also to
specifically allow single-family residences with fifty- (50)
foot front yard widths .
Section 2 . Amendment . City of Tiffin Ordinance No .
1996-204 , Section 5 . 07 (D) (4 ) is hereby amended by adding the
following thereunder as Paragraph ( f) :
(f) Zero lot line dwellings may be
created by filing an application at the
time of submission of a building permit
for approval. The application shall
state that the applicant intends to
build a residential structure on two
adjoining lots as a zero lot line or
multi-family structure that otherwise
conforms with the .R-3 requirements ,
including those required in Paragraphs
(a) - (e) above. All covenants and
restrictions on the land and structures
shall be consistent with those
restrictions and conditions found in
Paragraphs (a) - (e) above. The structure
shall meet all of the minimum lot size
and set back requirements applicable
under the R-3 .zone as set forth more
fully herein and as apply as described
in Paragraphs (a) - (e) above.

Section 3 . Amendment : City of Tiffin Ordinance No .
1.-,. 1996-205 Section 5 . 07 (D) (5) (a ) is repealed and the following
is submitted in lieu thereof :
(a) Single family dwelling:
The lot areas and widths required
within the R-1 District must be met
accordingly.
Section . Repealer . All ordinances or parts of
ordinances in conflict with the provisions of this Ordinance
are hereby repealed.
Section . Severability. If any section, provision, or
part of this ordinance shall be adjudged to be invalid or
unconstitutional, such adjudication shall not affect the
validity of the ordinance as a whole, or any section,
provision, or part thereof not adjudged invalid or
"unconstitutional .
Section . Effective Date . This ordinance shall be in
effect after its final passage, approval, and posting as
provided by law.
,On the 14th day of August _ 1996, at a regular meeting of
the Tiffin City Council, Tiffin, Iowa, Councilperson
Bartels introduced Ordinance No. 1996_707 , and
moved that it be given its first reading. The motion was
seconded by Councilperson Brown
Ayes : Brown', Kern, Bartels, Walls and Gericke
Nayes : None.
Five members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared the motion carried,
and Ordinance No.1996-207
, was read the first time and
discussed and placed on record.
Thereupon, it was moved by Councilperson
Walls and -seconded by Councilperson
Gericke that the laws and rules
providing that ordinances be considered and voted on for
passage at two council meetings prior to the meeting at
which it is to be finally passed be suspended and dispensed
with and that Ordinance No. 1996-207 be placed on its
last reading.

Five members of the council being present and having voted
"Aye", Mayor Glenn R. Potter declared the motion carried,
and Ordinance No. 1996-207 , was then placed on its last
reading and was read the last time .

Five members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared the motion carried,
and the ordinance was passed and adopted.
Whereupon the mayor declared that Ordinance No.
1996-207 be adopted and signified his approval of
same by fixing his signature thereto.
Passed by the council on the 14th day of
-- August_ 1996 and approved by the mayor on the
4 _ day of August _ 1996 .
