COUNCIL MINUTES
CITY OF TEMPLE CITY
DECEMBER 2, 1969
INITIATION:
1. Mayor Harker called the regular meeting of the City Council to
order at 7:32 p.m.
2. The invocation was given by the Reverend Leonard T. Boyd,
Westminster Presbyterian Church, 9642 Live Oak, Temple City.
3. Mayor Harker led the Pledge of Allegiance to the Flag.
4. ROLL CALL:
PRESENT: Councilmen - Beckley, Briggs, Merritt, Harker
ABSENT: Councilman - Tyrell
ALSO PRESENT: City Manager Koski, Director of Public Works
Pizzorno, Planning Technician Burnham
Councilman Briggs moved that Councilman Tyrel1's absence be excused
because of business reasons, seconded by Councilman Beckley and
carried.
5. Mayor Harker noted a typing error in the minutes of the meeting of
November 18, 1969, in that "lot cars" should be corrected to read
"low foreign cars." Councilman Briggs moved to approve the minutes
as corrected, seconded by Councilman Merritt and carried.
UNFINISHED BUSINESS:
6. PUBLIC HEARING: 7:30 p.m. Re. Amendment to Temple City Municipal
Code relating to exterminating (pest control) businesses.
Mayor Harker inquired if proper'notice had been provided in regard
to the Public Hearing, which was affirmed by the Clerk.
Mayor Harker declared the Public Hearing open.
City Manager Koski presented background information advising that
the present Temple City Zoning Code does not provide a zone class-
ification for exterminating (pest control) businesses, and that the
Planning Commission recommended that retail sales and offices only
be permitted in C -2 zone, the storage of heavy equipment and bulk
chemicals already being within the definition of contractors' yards
which are restricted to C -M zone.
Mayor Harker invited those present .who wished to speak either for o
against the matter to come forward. No one wished to speak.
Councilman Briggs moved to close the Public Hearing, seconded by
Councilman Beckley and carried.
Following discussion, Councilman Beckley moved to approve the
recommendation of the Planning Commission as set forth in Resolution
No. 69- 358PC, and to instruct the City Attorney to prepare an
ordinance to amend the Temple City Municipal Code accordingly, secon-
ded by Councilman Merritt and carried.
City Attorney Martin presented Ordinance No. 69 -301 entitled AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING
SECTION 9390 OF THE TEMPLE CITY MUNICIPAL CODE, for first reading
by title only. Mayor Harker moved to waive further reading,
seconded by Councilman Briggs and carried.

7. PUBLIC HEARING: 7:30 p.m. Re. Sidewalks - Olive Street,
Alessandro to Buttons, south side.
Director of Public Works Pizzorno reported that proper notice had
been provided in regard to the Public Hearing, and advised that
petition for the improvement constituted 75% of the footage. Total
estimated cost of the project was $742.50.
Mayor Harker invited those who wished to speak either for or agains
the matter to come forward. No one wished to speak.
Councilman Merritt moved to close the Public Hearing, seconded by
Councilman Briggs and carried.
Councilman Briggs moved to find the project in the public interest
and to instruct the Superintendent of Streets to cause the work to
be done, seconded by Councilman Beckley and carried.
8. NOISE PROBLEM - NATTER TOOL & MFG. CO.

City Manager Koski presented a status report on the effectiveness
of efforts to date to eliminate noise and vibration emanating from the
Natter Tool & Mfg. Co. He advised that based on interviews with
affected residents and investigation by staff, the installation of
Barry spring mounts have eliminated the vibration problem on the
500 Ton press to an acceptable level, and that the Natter Tool &
Mfg. Co. had ordered similar equipment for installation on two other
presses which would further reduce the noise and vibrations heretofore
experienced.
Frank Hutton, 4515 N. Cloverly Avenue, stated that the Residents'
Committee would like to see the City Council adopt stronger methods of
noise Control for f.utu re i; nsta 1 1 at i ons of this type of equipment. He
stated that he considered the problem much improved at this time.
Following discussion, Councilman Briggs moved to follow the
recommendation of staff and to consider the matter settled, and to
ask the staff to continue to work until the present efforts, agreed
to by Natter Tool, are culminated. Councilman Merritt seconded the
motion, urging that additionally the staff keep alert to any
recurring problems, and the motion carried. Staff was instructed
to inform the Council by memo whenever any complaints are received.
9. ORDINANCE No. 69 -299: 2nd read. Re. Deferment of Ordinance
No. 69 -296 Relating to Holidays, until 1971
City Attorney Martin presented Ordinance No. 69 -299 entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY SUSPENDING THE EFFECT OF
ORDINANCE No. 69 -296 RELATING TO HOLIDAYS for second reading by
title only. Councilman Merritt moved to waive further reading
and adopt, seconded by Councilman Briggs and carried.
10. ORDINANCE No. 69 -300: 1st read. Re. Amendment to Temple City
Zoning Code with respect to walls, hedges and fences on corner
and reverse corner and key lots in residential zones.
City Attorney Martin presented Ordinance No. 69 -300 entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY
ZONING CODE RELATING TO THE HEIGHT OF-WALLS, FENCES AND HEDGES,
for first reading, by title only. Councilman Beckley moved to
waive further reading, seconded by Mayor. Harker and carried.
NEW BUSINESS:
11. PARKING COMMISSION RECOMMENDATION - Meeting of November 20, 1969
Mayor Harker advised that this item concerned a request from
Standard Oil for use of Public Parking Lot No. 7 for the purpose
of drilling a temporary exploratory core hole, and that at this
time it was not the option of the Council to take testimony, that

such testimony would be reserved for any public hearing that may be
set, but to receive and consider the recommendations of the Parking
Commission in light of a City Attorney interpretation regarding the .
use of the parking lot for other than parking purposes.
City Attorney Martin advised that he could forsee at least three
public hearings on the matter, the first by the City Council to con-
sider alternate use of the lot; and that if it is then decided that
the lot could be used for alternate use, it would be referred to the
Planning Commission to consider the specific request for the conditional
use of core -hole drilling, which Commission would hold public hearing
on the matter; and further, following the decision of the Planning
Commission to approve or deny the request, an appeal may be made to
the City Council on the decision, for which another Public Hearing
would then be required.
Councilman Briggs moved to receive the recommendation of the Parking
Commission, and to set a Public Hearing for Tuesday, January 6, 1970,
at 7:30 p.m. in the Council Chambers of the City Hall to consider
alternate use of the public parking lot. The motion was seconded by
Councilman Merritt and carried. Mayor Harker reminded those present
that the Public Hearing that had now been set was for any alternate
use of the public parking lot (such as carnival, core -hole drilling,
or whatever) and that the specific matter of the request for use from
Standard Oil was not up for consideration at that time.
12. DAINES DRIVE IMPROVEMENTS - south side, easterly of Baldwin Avenue
Director of Public Works Pizzorno reported that right -of -way has been
obtained for Daines Drive improvements, easterly of Baldwin, south
side, where a bottleneck presently existed, and presented plans for
approval, with estimated cost of construction at $9,000, and work
scheduled to commence on January 12, 1970. Councilman Beckley moved
to approve the plans as submitted, authorize the expenditure of funds
and to authorize staff to proceed with construction, seconded by
Councilman Briggs and carried. Councilman Merritt commended the
staff for the tenacious work in obtaining the rights -of -way in order
to complete this needed improvement.
13. LONGDEN AVENUE - Temple City Boulevard to Golden West (Cash Contract
No. 2000X) - Acceptance of Work
Director of Public Works Pizzorno reported that the contractor, F. W
Richter Associates, had satisfactorily completed the construction of
Longden Avenue, Temple City Boulevard to Golden West, and that it was
the recommendation of the County Road. Department and the Director of
Public Works, that the work be accepted, that additional work in the
amount of $194.62 (net) be approved and authorized; that filing of
Notice of Completion be authorized; and that the withholding of 10%
for a minimum of 35 days after recordation of Notice of Completion
be authorized. It was so moved by Councilman Merritt, seconded by
Councilman Briggs and carried.
14. CAMELLIA FAMILY BILLIARDS - Report of Operation
Pursuant to City Council action that a report on the operation of the
Camellia Family Billards be provided every 90 days, City Manager
Koski advised that reports from the Sheriff's Department consistently
appear favorable, and that the report for the month of November showed
52 field checks made with no loitering observed. He stated that
following the date of the report, the manager of the Camellia Family
Billiards had taken the initiative to call the Sheriff's to assist
in handling a patron, which action provided the necessary control to
prevent further disturbance.
Councilman Merritt moved to accept and file the report, seconded
by Councilman Beckley and carried.

Councilman Beckley noted that problems had been minimized, both at
Camellia Family Billiards and at Jack- in-the -Box, because of the
close surveillance that was being given to the locations where
problems have existed in the past, and that chaining the parking lot
at Jack -in- the -Box at the close of business hours appeared to be the
solution to the disturbances. Staff was directed to keep close
surveillance on both operations, and to obtain monthly reports from
the Sheriff's Department as a regular procedure.
15. AGREEMENT: Maintenance Services - James T. Peglau and Associates
City Manager Koski presented an agreement from James T. Peglau and
Associates, for maintenance services, wherein a uniform maintenance
program for the City's parks, buildings, median strips and parking
malls, and related services, would be provided, and which the Council
had previously discussed. It was moved by Councilman Briggs to
approve the agreement as outlined, and to authorize the Mayor and
City Clerk to sign, seconded by Councilman Merritt and carried.
16. WARRANTS & DEMANDS - RESOLUTION No. 69 -974, Demand Nos. 1094
through 1162, in the amount of $40,347,06.
Councilman Merritt moved to adopt Resolution No. 69 -974, A RESOL-
UTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, ALLOWING CLAIMS
AND DEMANDS IN THE SUM OF $40,347.06, DEMAND NOS. 1094 THROUGH 1162.
Councilman Beckley seconded, and the motion carried,
17. COMMUNICATIONS:
A. City Manager Koski presented a damage claim submitted by Paul
T. Erskine, Attorney at Law, in behalf of Lawrence J. Wilson, in
the amount of $54,383.30, for injuries sustained at the Temple City
Sheriff Station. It was moved by Mayor Harker, seconded by Council-
man Briggs and carried, that the claim be denied, and to refer the
communication to the City's insurance agent, and to the County of
Los Angeles, under whose jurisdiction the Temple City Sheriff's
Station is maintained.
B. City Manager Koski presented a proposal from the firm of Fickes
and Fickes, Architects, for services in providing an investigative
report for: 1) Parks & Recreation Department office building and
public restrooms at Live Oak Park, and 2) Outdoor Recreational
Facility Improvements, with recreational equipment and storage room
for community center at Live Oak Park, which services would be
performed on an hourly basis, plus direct costs of any reproduction
of report material, at a cost not to exceed $1,150.
Following discussion, it was moved by Councilman Beckley, seconded
by Councilman Merritt and carried, to approve the agreement with
Fickes and Fickes, Architects, as outlined, and to authorize the
Mayor and City Clerk to sign.
C. The following communications protesting the use of Public
Parking Lot 7 in Parking District 2 by Standard Oil Company for
core hole drilling were received: Albert S. Anspach, Partner -
Liebergs; Duane Gros Jean, Manager, Sherwin Williams Co.;
J. Kenneth Cornwell, Vernon's Pharmacy; and R. B. Fehren, Realtor
and Lulu B. Clewett, owner of property in Parking District 1.
18. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK:
Andrew Kocsi, 9942 E. Live Oak, inquired as to petition for
sidewalks, curb and gutter, on Live Oak, west of Baldwin. He was
advised that previous effort to petition for these improvements
had met with negative results, however that if he would care to
assist with a new petition, the staff would assist in whatever
way possible. Councilman Merritt noted that since storm drain
improvements may be scheduled on Live Oak in the foreseeable future,
it may provide an incentive for residents to sign the petition in
order to provide a place to walk when the construction is in
process.

19. MATTERS FROM CITY OFFICIALS:
Councilman Briggs inquired as to possible improvements to Golden
West in the vicinity of Lower Azusa where the street ends as a dirt
road. City Manager Koski advised that the property owners had been
contacted previously, but were not interested in making a dedication
at this time.
City Manager Koski advised that at the request of the City Council
the City Attorney and members of the staff had made an inspection
of property at 4935 Doreen Avenue, on which complaint had been made,
and that it had been determined that the matter should be processed
under the nuisance abatement ordinance, in order to determine the
nature and extent of possible violations of various City codes.
Councilman Briggs moved to refer the matter to the Planning Commission
for a public hearing on the matter at the earliest possible date.
The motion was seconded by Mayor Harker and carried.
20. ADJOURNMENT:
Councilman Beckley moved to adjourn to a study session at 8 :50 p.m.,
Councilman Merritt seconded, and carried.
Next regular meeting of the City Council will be held on Tuesday,
December 16, 1969, at 7:30 p.m. in the Council Chambers of the
City Hall.
