RESOLUTION NO. 83 -2129
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TEMPLE CITY DENYING CUP 82 -661
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY does resolve:
SECTION 1. The City Council does find:
1. That application for CUP 82 -661 was duly filed and heard by
the Planning Commission.
2. That Resolution 82 -1035 P.C. was adopted denying the proposed
auto parts store in the C -1 zone at 9450 -6 Las Tunas.
3. That the applicant appealed and such appeal was heard by the
City Council.
4. That based upon the files and records of the Planning
Commission and City Council and the evidence adduced at
the hearing, the following findings are made:
a That the premises at 9450 -6 Las Tunas are
presently saturated with intensive uses
which has caused traffic congestion, parking
problems which could only be intensified with
another traffic oriented business.
b That Thrifty (as Lessor) has had a poor history
of property maintenance and landscaping so as
to downgrade the frontage and neighborhood; and
there is no reason to expect change.
c It is the nature of auto parts stores to engage
in high intensity traffic, to have auto work
and maintenance done in and about the premises
and to congregate teenagers and their vehicles in
areas normally devoted to shoppers - all to the
detriment of C -1 zoning.
d That the problems referred to herein are not
easily or readily controlled by mitigating
conditions.
e. That the proposed use will have adverse effect
upon the use, enjoyment or valuation of adja-
cent property or upon the public welfare, in
that it will lead to detrimental impact on
adjoining property in the form of litter, noise,
and traffic problems, external use and uses at
unusual hours.
SECTION 2. Accordingly said CUP is denied.
SECTION 3. The City Clerk of the City of Temple City shall certify
to the passage and adoption of this Resolution and to its approval by the
Mayor and shall cause the same to be published and circulated in the City
of Temple City.
PASSED AND ADOPTED by the City Council of the City of Temple City
at a City. Council meeting held on the 18th day of January
1983.
