AN ORDINANCE AMENDING ORDINANCE t NO. 1996-204 (ZONING
ORDINANCE) OF THE MUNICIPAL CODE OFi TIFFIN, IOWA REGARDING
APARTMENTS ON THE SECOND FLOOR OF BUILDINGS IN C2 COMMERCIAL
ZONES
BE IT ORDAINED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1 . Purpose : The purpose of this ordinance is

Section 2 Amendment : City of Tiffin Ordinance
No . i996-204 , Sect.i on 5 . 07 (ll) ( I ) is hereby amended by adding
the following thereunder as Paragraph (r ) :
(r) Apartments , provided that they are
located on or above the second floor of
the building in which theyaare located.
Section 3 . Repealer.. All orrdinances or parts of ordinances
in conflict with the provisions of this Ordinance are hereby
repealed.
Section 4 . Severability. If any section, provision, or
part of this ordinance shall be adjudged to be invalid or
unconstitutional , such adjudication shall not affect the
validity of the ordinance as a 1ihole, or any section,
provision, or part thereof not adjudged invalid or
unconstitutional .
Section 5 . Effective Date . This! ordinance shall* be in
effect after its final passage, approval, and posting as
provided by law.

On the 1 litielayof December at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Walls introduced Ordinance
No. 1996-210 , and moved that it be given its first reading. The motion
was seconded by Councilperson Gericke
Ayes: Gericke ,Walls , Brown , Bartels , and Kern
None .
Nays: None . —

Five members of the council being present and having voted "Aye", Mayor
Glenn R. Potter declared the motion carried, and Ordinance No. 19 9 6_210 _, was
read the first time and discussed and placed on record.
40n the 11th day of December , at a regular meeting of the Tiffin City
xCouncil, Tiffin, Iowa, Councilperson Brown _moved that the
laws and rules requiring consideration and reading at two council meetings prior to
the meeting at which it is to be finally approved be suspended and dispensed with
that Ordinance No. 1996-2IO, and entitled AMENDING 1996-204( ZONING)
SECOND FLOOR APARTMENTS IN C- 2
be placed on its last reading.
Ayes: Kern , Bericke , Walls , Brown , and Bartels
Nays:
None.
Five members of the council being present and having voted "Aye",2 Mayor
Glenn R. Potter declared the motion carried, and Ordinance No. 199 6_ -was then
placed on its last reading and was read the last time.
Thereupon it was moved by Councilmember wails __ and
seconded by Councilmember Gericke that Ordinance No. 1_9 9 6-2 to
entitled, AMENDING ORDINANCE NO. 1996-204 (ZONING) be placed
upon its final passage and be adopted.

Five members of the council being present and having voted "Aye" ,
Mayor Glenn R. Potter declared the ,motion carried, and the
ordinance was passed and adopted.
Whereupon the mayor declared that Ordinance No. 1996-210
be adopted and signified his approval of same by fixing his
signature thereto.
Passed by the council on the 11th day of December
1996 and approved by the mayor on the 11th day of December
1996.

the 11th day of December 199 , and signed by the mayor on
the 11th day of December 1996 , and published on the 6th
day of January 1997, by posting copies thereof in three
public places within the limits of the City of Tiffin, Iowa .
