APL 97-05 AND UPHOLDING THE PLANNING COMMISSION'S ~ DECISION DENYING VARIANCE NO. VAR 97-07, A PROPOSAL REQUESTING PERMISSION TO CONVERT THE GARAGE TO A PLAY ROOM AT 4526 CARLIN AVENUE, LYNWOOD IN THE R-1 ZONE. WHEREAS, the Lynwood City Council, pursuant to law, on September 16, 1997 conducted a public hearing on the appeal of the subject application; and WHEREAS, the City Council considered all pertinent testimony offered at the public hearing; and WHEREAS, the Director of the Community Development Department has determined the proposal to be categorically exempt from the provisions of the Califomia Environmental Quality Act, Pursuant to section 15303 of the State Guidelines as amended: therefore, se i n 1. The City Council hereby finds and determines as follows: ' a. The strict or literal interpretation and enforcement of the specified regulation would not result in practical difficulty or unnecessazy physical hazdship inconsistent with the objectives of this chapter. b. That there are not exceptional or extraordinary circumstances or conditions applicable to the property involved which do not apply generally to other properties in the same zone. c. That strict or literal interpretation and enforcement of the specified regulation would not deprive the applicant of privileges enjoyed by the owners of other similaz properties in the same zone. d. That the granting of the vaziance, as conditioned, will constitute the granting of a special privilege inconsistent with the limitations on other properties in the viciniTy classified in the same zone. e. That the granting of the variance will not be detrimental to the public health, safety, or welfaze, or materially injurious to properties or improvements in the vicinity. ~ f. That the granting of the variance will not adversely affect the orderly development of the City. ~ n 2. The City Council of the City of Lynwood hereby denies Appeal No. APL 97-OS and upholds the decision of the Planning Commission denying Conditional Use Permit No. CUP 97-12.
