HomeMy Public PortalAbout97-170 (09-16-97)RESOLUTION NO. 97-llU A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING ITS INTENTION TO CONDUCT A PUBLIC HEARING TO ASCERTAIN WHETHER A NUISANCE IS BEING MAINTAINED ON CERTAIN REAL PROPERTY AND WHETHER THE CITY BUSINESS LICENSE SHOULD BE REVOKED, COMMONLY KNOWN AS 12224-26 ATLANTIC AVENUE, AND IDENTIFIED AS TAX ASSESSOR'S BOOK N0.6186, PAGE 036, LOT 013. WHEREAS, the City Manager of the City of Lynwood has ~ recommended that the City Council find that certain premises within the City of Lynwood may be maintained and that the existing business is operated in such a way as to require a revocation of the City Business License; and WHEREAS, certain procedures are set forth in the Lynwood Municipal Code, Sections 3-13 and 4-9.5, pursuant to which violations of the Code may be considered by the City Council; and WHEREAS, the conditions on this property that may constitute a nuisance and justify revocation of the business license are: 1. Auto repair being done outside an enclosed structure. 2. Conducting a business that is not specifically approved under the existing business license. 3. Improper storage and handling of hazardous materials. 4. Conducting industrial operations that are not ' permitted in the zoning district. NOW, THEREFORE, the City Council of the City of Lynwood resolves as follows: Section 1. Based upon the above referenced facts and the recommendation of the City Manager, this Council finds and determines that the following described property and business may presently be maintained and operated in such manner as to constitute a nuisance and to justify revocation of the business license. Such property is described as Lot 13, Book No. 6186, Page 036, and commonly known as 12224 and 12226 Atlantic Avenue, City of Lynwood. Section 2. The methods by which these nuisance conditions could be abated include, but are not limited to: 1. Revocation of business license #9213 issued to Frank Soria for Frank's Auto Service at 12224-26 Atlantic Avenue in the City of Lynwood. 2. Upon obtaining an entry and abatement warrant, if needed, the removal of all inoperable vehicles at the site which are visible from the ~ public right-of-way. 3. Removal of all flammable/hazardous materials found to be improperly stored at the site. Section 3. The City Council declares its intention to conduct a public hearing, pursuant to Sections 3-18.5 and 4-9.5 of the Lynwood Municipal Code to determine whether the violations existing at the site merit abatement and the revocation of the business license under the police power of the City of Lynwood. Section 4. The City Council hereby fixes the hour of 7:30 p.m., October 7, 1997, as the time, and the City Council Chambers, 11330 Bullis Road, as the place, for said public hearing. Section 5. The City Clerk is authorized and directed to notify Mr. Frank Soria of said complaint and the proposed hearing date, as required under all applicable provisions of the Lynwood Municipal Code.
