A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF LYNWOOD GRANTING
APPEAL NO. APL 97-OS FROM THE
PLANNING COMMISSION'S DENIAL OF
' VARIANCE NO. VAR 97-07 TO ALLOW AN
EXISTING GARAGE CONVERSION TO
REMAIN AS A PLAY ROOM AT 4526
CARLIN AVENUE IN THE R-1 ZONE.
WHEREAS, the Lynwood City Council, pursuant to law, on September 16, 1997,
conducted a public hearing on the appeal from the Planning Commission's denial of the
subject application, and
WHEREAS. the City Council considered all pertinent testimony offered at the
public hearing; and
WHER~AS, the Director of the Community Development Department has
determined the application to be categorically exempt from the provisions of the Califomia
Environmental Quality Act, pursuant to Section 15303 of the State Guidelines as amended;
now, therefore, be it resolved as follows:
Section 1 l'he Ciry Council finds and determines as follows:
' a. The strict or literal interpretation and enforcement of the applicable regulation
would result in practic~l difficulty or unnecessary physical hazdship inconsistent with
the objectives ol'the Zoning Ordinance.
b. There are c~ceptional or extraordinary circumstances or conditions applicable to
the pro}~erty im olved that do not apply generally to other properties in the same zone.
a The granting of the variance, as conditioned, will not constitute the granting of a
special privilege inconsistent with the limitations on other properties in the vicinity
that are located in the same zone.
d. The grantin~ of the variance will not be detrimental to the public health, safety, or
welfare, or materially inj urious to properties or improvements in the vicinity.
e. The grantii~g of thc variance will not adversely affect the orderly development of
the City.
Section 2 Thc Ciry Council hereby grants the appeal from the decision of the
Planning Commission, and approves Variance No. VAR 97-07 authorizing an existing
~ gazage conveision to reinain at 4526 Carlin Avenue, Lynwood, CA, subject to the following
conditions:
1. The proposed devclopment must comply with all applicable regulations of the
Lynwood Municipal Code, including the Building Code, within 120 days of approval.
2. Any subsequcnt moditication of the proper[y or structures thereon, must first be
approved by the Cominunity Development Department, grior to implementation.

3. The applicanL or [he applicanYs representative, must sign a Statement of AccepYance
stating thaL thc aE~plicant I~as read , understands, and agrees to the condirions stated
herein within 15 da~-s of approval, and before issuance of building permits.
4. The applicant must meet the requirements of all other ciTy departments.
5. A permit fiom thc l3uilding Department is required to legalize all construction and
conversions on the property.
6. The garage conversion must meet all applicable provisions of the current building and
safety codes.
7. A portable tirc e~tinguisher must be provided in accordance with the Fire Code.
8. Smoke detect~~rs arc rcquired in all sleeping rooms and all hallways leading to the
sleeping rooms.
9. The water heater must be 18" from the floor and enclosed as required by the code.
10. Prior to the issuance ol~ a building permit, a covenant must be recorded with the Los
Angeles County Rccorder's Office specifying that the garage conversion is to be
returncd to its ori~inal use when it becomes obsolete or prior to a change of
ownership.
