RESOLUTION NO. 97-"05
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LYNWOOD REPEALING A MOTION ADOPTED ON
NOVEMBER 21, 1997, THAT AUTHORIZED AND
APPROVED "CONTRACT AMENDMENTS" TO THE 1995
AGREEMENT FOR TREE-TRIMMZNG SERVICES BETWEEN
THE CITY AND CALIFORNIA WESTERN ARBORISTS,
' AND RESCINDING IN THEIR ENTIRETY THOSE
"CONTRACT AMENDMENTS."
RECITALS:
A. The City Council has received a letter dated
December 1, 1997, demanding that the City Council cure or correct
certain specified actions that are alleged to have been taken in
violation of the Ralph M. Brown Act at an adjourned regular
meeting of the City Council on Friday, November 21, 1997.
B. At an adjourned special meeting held on Tuesday,
December 9, 1997, the City Council considered the written demand
to cure or correct as it relates to a"proposal" submitted at the
November 21, 1997, meeting by California western Arborists and
action taken by the City Council approving certain "Contract
Amendments" to the 1995 Agreement for Tree-Trimming Services
between the City and California Western Arborists.
C. After consideration of all relevant facts and
circumstances, the City Council finds and determines that the
interests of the City will best be served by curing and
correcting the challenged action described above in paragraph B.
' NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD
FINDS, DETERMINES, AND RESOLVES AS FOLLOWS:
Section 1. The City Council repeals in its entirety
the motion adopted on November 21, 1997, that authorized and
approved the "Contract Amendments" to the 1995 Agreement for
Tree-Trimming Services between the City and California Western
Arborists and rescinds those "Contract Amendments."
Section 2. The City Council directs the City Manager
to place on the City Council agenda for its regular meeting on
Tuesday, December 16, 1997, all documents relating to the
proposed "Contract Amendments" to the Agreement for Tree-Trimming
Services between the City and California Western Arborists, as
well as evaluations and recommendations of City staff relating to
those proposed "Contract Amendments," in order that the City
Council; and interested members of the general public, can make
informed comments, deliberations, and decisions concerning this
matter.
Section 3. The City Clerk is directed to mail a copy
of this Resolution to Mr. Lee Duncan, President, California
Western Arborists, Inc., 2555 East Industry Way, Suite F,
