HomeMy Public PortalAboutOrdinances-1997-216 CITY OF TIFFIN ORDINANCE NO . 1997 - 216 AN ORDINANCE ENACTING A MUNICIPAL CULVERT POLICY FOR THE INSTALLATION OF A NEW CULVERT OR REPLACEMENT OF AN EXISTING CULVERT WITHIN THE CITY OF TIFFIN WHEREAS, the City of Tiffin has determined that at is necessary to establish a policy for the installation Of any new culverts or the replacement of any culverts within its municipal boundaries . BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section I . Application: Tiffin property :owners must apply, in writing, for permission to install any new culverts or replace any existing culverts . Said application must be accompanied by a drawing that 'shows : the proposed new or replacement ;culvert' s dimensions, including diameter and length; its location to any affected property lines; its location to the edge of any street pavements; and any other information the City Engineer or Public Work' s Director may request . Applications submitted without said drawing will be automatidally denied. t 1 Section III . Requirements : All new and replacement t culverts : i 1 . Must have a minimum diameter ,of 12 inches 2 . Must be constructed of either 2000D strength reinforced concrete pipe (RCP) or 10 l gauge corrugated metal pipe (CMP) . • Section -II . Approval . All applications for new or replacement culverts will be either approved or denied, in writing, ly: the City Engineer. The City Engineer shall have the right to request a larger diameter culvert, a longer culvert, or any variations in the proposed bury depth, cover material, or alignment of culverts . Section V. Installation Notification: The Public Works Director must be notified, 24 hours in advance of any installation of a culvert. The Public Works Director may, at his/her discretion, determine if an on-site inspection will be required. • { 1997-216 Page 2 ' Section III . Violations . If a culvert is replaced or installed without approval, found to be constructed of any unapproved material, or fails to meet any request of the City Engineer, it shall be removed by the city. The costs incurred by the city to remove any culvert shall be assessed to the property owner who is determined by the city to be in violation of said ordinance . Section IV. Liability: No city personnel, including the City Engineer or Public Works Director, will install or replace any culvert on private property. The city will not be responsible for the procurement of any contractors or suppliers . Property owners will be liable for any damages to ditches, street surfaces, sidewalks, municipal utilities, private utilities , and neighboring properties . On the 9th day of July 1997 , at a regular/special meeting of the Tiffin City Council, Tiffin, r., Iowa, Councilperson Brown introduced 1997-216 Ordinance No. , and moved that it be given its first reading. The motion was seconded by Councilperson Barh1 Brown, Gericke, Bartels, Kern and Walls Ayes : None Nays Five members of the council being present and having voted "Aye" , Mayor Glenn R. Potter declared the motion carried, and Ordinance No. 1997-216 , was read the first time and discussed and placed on record. Thereupon, it was moved by Councilperson rPricke and seconded by Councilperson Brown that the laws and rules providing that ordinances be considered and voted on for passage at two council meetings prior:Itto the meeting at which it is to be finally passed be suspended and dispensed with and that Ordinance No. 1997-216 be placed on its last reading. Ayes : Walls, Kern, Brown, Bartels and Gericke None Nays : # k. 1 1997-216 Page 3 Five members of the council being present and having voted "Aye" , Mayor Glenn R. Potter declared the motion carried, and Ordinance No. 1997-216 , was then placed on its last reading and was read the last time. Thereupon, it was moved by Councilperson Brown and seconded by Councilperson Bartels that Ordinance No. 1997-216 be placed upon its final passage and adopted. Ayes : Walls, Bartels, Gericke, Brown and Kern None Nays : Fivemembers of the council being present and having voted "Aye" , Mayor Glenn R. Potter declared the motion carried, and the ordinance was passed and adopted. Whereupon the mayor declared that Ordinance No. 1997-216 be adopted and signified his approval of same by fixing his signature thereto.
