4. ADDITIONS/REVISIONS - The Committee may add an item to the Agenda after
making a finding that there is a need to take immediate action on the item and
that the item came to the attention of the Committee subsequent to the
posting of the agenda. An action adding an item to the agenda requires 2/3
vote of the Committee. If there are less than 2/3 of the Committee members
present, adding an item to the agenda requires a unanimous vote. Added
items will be placed for discussion at the end of the agenda.

5. PERSONNEL POLICIES AND PROCEDURES MANUAL UPDATE SECTION 4.12,
"EDUCATION REIMBURSEMENT AND SECTION 5.3 "HOLIDAY LEAVE"
Overview
This item is for the Committee to:
1) Approve the revision to the Personnel Policies and Procedures Manual
to amend Section 4.12 "Education Reimbursement" and Section 5.3
"Holiday Leave"; and
2) Adopt Resolution No. 08-021, '"Resolution of the Riverside County
Transportation Commission Amending lts Personnel Policies and
Procedures Manual".
6. FLEXIBLE BENEFITS PLAN AMENDMENT
Overview
This item is for the Committee to:
1) Approve the revision to the Flexible Benefits Plan;
2) Approve the revision to the Flexible Benefits Plan "Frequently Asked
Questions" for distribution to employees; and
3) Adopt Resolution No. 08-022, '"Resolution of the Riverside County
Transportation Commission Amending the Flexible Benefits Plan".
7. ADOPTION OF ORDINANCE NO. 08-001 TO AMEND THE ADMINISTRATIVE
CODE TO REFLECT THE DISBANDMENT OF THE TRANSIT POLICY
COMMITTEE
Overview
This item is for the Committee to Adopt Ordinance 08-001, "An Ordinance
Amending the Riverside County Transportation Commission Administrative
Code", to reflect changes related to the disbandment of the Transit Policy
Committee.

"Education Reimbursement and Section 5.3 "Holiday Leave"
STAFF RECOMMENDATION:
This item is for the Committee to:
1) Approve the revision to the Personnel Policies and Procedures Manual to
amend Section 4.12 "Education Reimbursement" and Section 5.3 "Holiday
Leave"; and
2) Adopt Resolution No. 08-021, "Resolution of the Riverside County
Transportation Commission Amending Its Personnel Policies and Procedures
Manual".
BACKGROUND INFORMATION:
Staff has completed a review and has revised the Personnel Policies and
Procedures Manual. The revised Personnel Policies and Procedures Manual has
been reviewed by legal counsel and approved by the Executive Director. The major
changes to the Personnel Policies and Procedures Manual include:
Section 4.12 'Education Reimbursement"
Currently, the Commission's Personnel Policies and Procedures Manual contains
language that states ". . . upon an employee's voluntary termination of
employment within 24 months following receipt of an education reimbursement
payment, there shall be a deduction for his or her final check as follows: the
amount of the education reimbursement minus one twenty-fourth of the education
reimbursement for each month of service following the receipt of the
reimbursement."
This language is contrary to the California labor law (Barnhill v. Robert Saunders &
Co., 125 Cal. App.3d 1 (1981)), which states that employers may not deduct from
an employee's final check any amount representing the unpaid balance of a debt
owed by the employee even though the indebtedness is contained in a written

agreement to pay the full amount of the debt on demand, at termination or
otherwise.
Staff requests approval to remove the language from the policy referring to a .. a
deduction from his or her final check . . . ". Therefore, staff will seek
reimbursement from voluntarily terminated employees through the Commission's
accounts receivable process.
Section 5.3 '"Holiday Leave"
Holiday Accrual
Currently, the Commission's Personnel Policies and Procedures Manual provides
exempt employees an accumulated holiday bank, not to exceed eight hours for any
work period, when staff works on a holiday and/or for hours worked in excess of
80 hours during a work period that includes a paid holiday. After review of this
benefit in comparison to other similar agencies as the Commission, the
management team concluded that this benefit was not of typical public policy or
practice. Although the average cumulative cost of this benefit, approximately
$400 per employee, does not have significant financial impact on the Commission,
the management team agreed that since an administrative leave benefit was
currently provided, that the accrued holiday leave did not make sense or promote
good public policy. Therefore, the management team wishes to revise the holiday
accrual process and only allow those exempt employees who are required to work
on a scheduled holiday the ability to accrue holiday hours not to exceed eight
hours.
Floating Holiday
The Commission observes 12 paid holidays plus a floating holiday. An eight hour
floating holiday is provided to regular and probationary employees at the beginning
of each fiscal year. However, the current policy does not address the basis of
accrual for those new employees that may begin employment with the Commission
toward the end of a fiscal year. Given this scenario, new staff would be able to
accrue eight hours of floating holiday. time on the first day of work and then an
additional eight hours of floating holiday time at the beginning of the new fiscal
year. Staff is seeking approval to amend the policy to reflect the basis of floating
holiday accrual on a pro-rata based on the date of hire.
