A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD ACCEPTING THE SLURRY SEAL PROJECT,
PROJECT 5-5198, AS BEING SUBSTANTIALLY COMPLETE
WHEREAS, on September 2, 1997, the City Council awazded a contract to
' California Pavement Maintenance for the Slurry Seal Project; and
WHEREAS, the project started on September 29, 1997, and was completed on
October 30, 1997; and
WHEREAS, samples of slurry seal mix were collected and tested to ensure
compliance with the project specifications; and
WHEREAS, test results indicated that certain applied batches of slurry seal mix
did not meet the project specifications and may shorten the service life of the mix; and
WHEREAS, the Standard Specifications for Public Works Construction, which
was incorporated into the project specifications, allows the City to apply deduction of payment
for the slurry seal quantity not in compliance with the specifications; and
WHEREAS, staff will deduct a total of $18,761 from the total payment for said
slurry seal, bringing the project tota] cost from $59,981.25 to $41,220.25.
WHEREAS, staff inspected the project, and found that all work, except for the
deficient slurry seal, has been completed in accordance with the project specifications.
' NOW, THEREFORE, the City Council of the City of Lynwood does hereby find,
proclaim, order and resolve as follows:
Section 1. That the City Council accepts the Slurry Seal Project, Project
No. 5-5198, as being substantially complete in accordance with contract
documents.
Section 2. This resolution shall go into effect immediately upon its adoption.
