AN ORDINANCE AMENDING ORDINANCE NO. 57 AND ORDINANCE NO. 138 AND
NO. 189 OF THE ORDINANCES OF TIFFIN, IOWA;
SAID ORDINANCE ESTABLISHING RATES, CHARGES AND RULES FOR THE USE
AND SERVICE OF THE MUNICIPAL SEWER SYSTEM OF TIFFIN, IOWA.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
SECTION I. Purpose. The purpose of this ordinance is to amend Ordinances No. 57, No. 138
and No. 189 so as to establish new minimum monthly sewer rates, monthly sewer charges, and
rates for users outside of corporate limits for each user of the Tiffin Municipal Sewer System.
SECTION II. Amendment. Section VI of Ordinance 57 and Section II of Ordinance 1985-138
and Section II of Ordinance 1994-189 of the City of Tiffin Ordinances are repealed and the
following Section VI is substituted in lieu thereof:
SECTION VI. Sewer Rental Charge Set. That there shall be and there are established
rates and charges for the use of and for the service supplied by the Municipal Sewer
System of the City of Tiffin, Iowa to each user of said System based upon the reading
of water consumed, as follows:
a.) First 1,000 gallons or lesser amount, for each metered user within the city
limits of Tiffin, Iowa, the minimum monthly fee shall be $15.00.
b.) All metered use above 1,000 gallons per month shall be charge in increments
of 1,000 gallons at $2.75 per 1,000 gallons.
c.) The City of Tiffin shall charge the minimum monthly fee for each dwelling unit
served, and where multiple dwelling units are served through a single meter,
the City shall credit the meter account with a monthly use of 1,000 gallons
multiplied by the number of dwelling units served by the meter. The incremental
charge per each 1,000 gallon unit used shall be applied for all sewer use in an
amount greater than this credit.
d.) First 1,000 gallons or lesser amount, for each metered user outside the city
limits of Tiffin, Iowa, the minimum monthly fee shall be $22.50.
e.) All sewer used over 1,000 gallons per month for each metered user outside
the city limits of Tiffin, Iowa, shall be charged in increments of 1,000 gallons at
$4.13 per 1,000 gallons.
The effective date for these rate and fee changes shall be July 1, 1997.
SECTION III. Repealer. All ordinances, or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
SECTION IV. Severability. If any section, provision, or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the ordinance as a whole,
or an section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION V. Effective Date. This ordinance shall be in effect after its final passage, approval
and posting as provided by law.

On the 14 t h day of May 1997 at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Brown introduced.Ordinance No. 19 97 - 213 , and moved
that it be given its first reading. The motion was seconded by Councilperson Bartels
Ayes: Walls , Gericke , Kern , Brown and Bartels
Nays: None .
Five members of the council being present and having voted "Aye",-Mayor Glen R. Potter
declared the motion carried, and that Ordinance No. 19 9 7 - 213was read for the first time and
placed on the record.
Thereupon, it was moved by Councilperson Brown and seconded by
Councilperson Gericke that the laws and rules providing that ordinances be considered
and voted on for passage at two council meetings prior to the meeting at which it is to be finally
passed by suspended and dispensed with and that Ordinance No. 19 9 7 - 213 be placed on its
last reading. during a regular meeting June 11 , 1997 .
Ayes: Brown , Bartels , Kern , Gericke and Walls .
Nays: None .
F i v e members of the council being present and having voted "Aye", Mayor Glenn R. Potter
thereupon declared the motion to be carried, and Ordinance No. 1997 - 213 was then placed
upon its last reading and was read the last time.
Thereupon, it was moved by Councilperson Kern and seconded by
Councilperson Bartels that Ordinance No. 19 9 7 - 213 be placed upon
its final passage and adopted.
Ayes: Brown , Bartels , Gericke , Walls , and Kern .
Nays: None .
Five members of the Council being present and having voted "Aye", Mayor Glen R. Potter
declared the motion carried, and the Ordinance passed and adopted.
Whereupon the Mayor declared that Ordinance No. 19 9 7 213 and
entitled, Amending Sewer Rates be
adopted and signified his approval of same by fixing his signature thereto.
