A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
DETERMINING THAT A NUISANCE IS BEING MAINTAINED ON
CERTAIN PROPBRTY LOCATED AT THE SOUTH/WEST CORNER OF LONG
BEACH BLVD. AND PLUMA STREET, GENERALLY KNOWN AS TAX
~,SSESSOR'S BOOK NO. 6170, PAGE 034, LOT 031, IN THE CITY
OF LYNWOOD AND DIRECTING THE ABATEMENT THEREOF
' WHEREAS, pursuant to the recommendation of the City Manager of the City of Lynwood,
and Staff, this City Council has previousty found that certain premises, hereinafter more fully described, aze presently
being maintained in such a manner as to constimte a nuisance; and
WHEREAS, in light of said finding, on February 17th, 1998, this Council adopted a
resolution declazing its intention to conduct a public heazing to ascertain whether a nuisance is being maintained on said
property; and ,
WHEREAS, this Council has held a hearing and has heazd and considered all relevant
evidence and testimony from all interested persons desiring to be heazd concerning the conditions constituting the
alleged nuisance and the proposed abatement.
NOW, THEREFORE, the City Council of the City of Lynwood does hereby find, determine,
order and resolve as follows:
Section 1. The property described as Tax Assessor's Book No. 617Q Page 034, Lot
03Q also known as the south/west comer of Long Beach Blvd. and Pluma Street, in the Ciry of Ly~wood, California, is
hereby found and declazed to be a public nuisance as defined in Chapter 3-13.1 of the Lynwood City Code.
i n . The particulaz conditions of said property which aze hereby found and
determined to constitute a nuisance aze described as follows:
1. Vacant lot with junk, trash, debris and discazded fumiture in the reaz.
' 2. Lot being used to conduct illegal and non-licensed activities.
3. Overgrown vegetation surrounding the lot.
Section 3. It is further found and detertnined that the methods by which said
conditions could be abated include, but are not limited to:
1. Upon obtaining an entry and abatement warrant, remove and properly dispose of all junk, trash, debris and
discazd furniture at the site.
2. Fence the entire lot.
3. Remove and dispose of all overgrown vegetation and maintain site.
Section 4. The owner of said property, Niranjan & Bharati Shah Trust are ordered
and d'vected to take said steps and to abate said nuisance.
Section 5. lf the property owner fails to take the steps as provided in this resolution
within five (5) days after the date this resolution is posted uFon said property, the City of Lynwood shall immediately
cause the same to be abated by City personnel or private contractor and such personnel or persons under contract are
expressly authorized to enter upon the premises for such purposes.
~ ~. The Ciry Clerk is authorized and directed to post conspicuously at least
one copy of this Resolution on the subject property and to send another copy of this Resolution by registered or certified
, mail, postage prepaid, retum receipt requested, to the owner of said land as his name and address appears on the last
equalized assessmant roll, or it known to the City Clerk.
The failure of any owner or other person to receive such notice shall not affect in any manner the
validiry of any proceedings taken under.
ti In the event the Ciry of Lynwood causes the aforementioned nuisance to
be abated by City personnel or private contractor, the owner of the premises shall be liable to said City. All said costs
shall constitute a special assessment against the subject property upon approval from City Council.
THE CITY COiJNCIL hereby fixes the hour of 730 p.m., April 21, 1998 as the time and the City
Council Chambers, 11330 Bullis Road, as the place for a Cost Abatement Hearing.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Lynwood held
on the third day of Mazch, 1998.
