MEETING MINUTES
Wednesday, September 28, 2016 at 6:30 p.m.
Brewster Town Office Building
Chairman Rick Judd convened the Planning Board meeting at 6:50 pm in the Brewster Town Office Building with
members: Scott Collum, Charlotte Degen, Madalyn Hillis-Dineen, William Hoag, Kari Hoffmann and Elizabeth
Taylor.
Also present: Ryan Bennett, Town Planner and Lynn St. Cyr, Senior Department Assistant
The Chair read the Recording or Taping Notification: "As required by the Open Meeting Law we are informing
you that the Town will be audio and video taping this public meeting. In addition, if anyone else intends to audio or
video tape this meeting he or she is required to inform the chair."

Approval of Minutes
The Board reviewed the minutes from the April 13, 2016, July 13,2016, and September 14,2016 meetings.

The Board discussed revisions to the meeting minutes of April 13th.
Motion by Hoag to approve the minutes of the April 13, 2016 meeting with edits. Second by Degen.
Vote: 6-0-1 (Hoffmann abstained)
The Board discussed revisions to the meeting minutes of July 13th
Motion by Hoffmann to approve the minutes of the July 13, 2016 meeting with edits. Second by Degen.
Vote: 6-0-1 (Hillis-Dineen abstained)
The Board discussed revisions to the meeting minutes of September 14th
Motion by Hoffmann to approve the minutes of the September 14, 2016 meeting with edits. Second by
Degen. Vote: 7-0-0.

Approval Not Required: #2016-19 —Applicant: Williams Real Estate Trust, Elaine F. Williams, Trustee and
Robert C. Williams, Trustee. Representative: Peter Soule, PLS, Soule Land Surveying for property located at
98 Red Top Road, Map 14 Lot 12 (Old Map 37 Lot 17-12). The Applicant proposes to create a 55,167 square

foot unbuildable parcel to be conveyed to the Brewster Conservation Trust to be held as Open Space in
perpetuity.

Peter Soule appeared on behalf of the Applicant and explained the proposed land conveyance to the Board.
Judd: Asked if the property would be in Land Court for a number of years. Soule responded that the land was
registered land so it should not be held up as long as unregistered land could be.
Collum: Asked if the land was being conveyed as public land and Soule responded that it would be private
land. The Conservation Trust gives the public permission to use the land for trails, etc. Collum stated that the
Conservation Trust is doing an excellent job for Brewster.
Motion by Hoffmann to endorse Approval Not Required: #2016-19. Second by Collum. Vote: 7-0-0.
Approval Not Required: #2016-18— (Continued from September 14, 2016) Applicant: Dianne Romme
Representative: John M. O'Reilly, J.M. O'Reilly &Associates, Inc. for property located at 100 Proprietors
Cartway, Map 64 Lot 36 (Old Map 34, Lot 49). The Applicant proposes to divide one lot into two lots.
Documents Referenced:
• 9/26/16 letter from John M. O'Reilly submitted on behalf of the Applicant Dianne Romme
Hoffmann read the letter received from John M. O'Reilly into the record. The letter requests withdrawal of the
ANR without prejudice.
Collum: Asked about the fee waiver referenced in the letter. Bennett responded that the Applicant has paid
the fee already and that the Town Planner has the discretion to waive the fees when Applicants withdraw and
refile. Bennett noted that the ANR the Board heard prior to this was a fee waiver approved by the Board of
Selectmen in advance of the Applicant paying the filing fee.
Hoag: Asked what was meant by the short period referenced in the letter. Bennett responded that the ANR
was not under a time restriction. The application will be accepted when it is refiled.
Motion by Collum to accept the request to withdraw without prejudice for Approval Not Required.
#2016-18. Second by Degen. Vote: 7-0-0.
Topics the Chair did not reasonably anticipate
Hoffmann noted that the Planning Board meeting scheduled for October 12th falls on a holiday and she would
not be able to attend the meeting. The Board requested the Applicant scheduled for that meeting be notified
that only 5 members of the Planning Board will be present.
Judd: Stated that he spoke to Peter Fletcher, the soil scientist, and he is available to meet with the Board on
Monday, December 5, 2016 at 6:30 pm. Judd stated that Fletcher will give a tutorial on conservancy soils and
take questions on the subject. The Board decided that the meeting would be opened to the public. The Board
requested an invitation be extended to the Chair of the Conservation Commission, the Conservation Agent, the
Board of Health, Patrick Ellis of DPW and the Zoning Board of Appeals.
The Board decided that the soil conservancy report and the bylaw will be provided to those invited to the
forum.

The Board agreed that Fletcher should be compensated for his work. Bennett stated that she would contact
Fletcher regarding his speaker fee and to obtain a speaker biography from him.
Motion by Hoffmann to adjourn. Second by Hillis-Dineen. Vote: 7-0-0.
Meeting adjourned at 7:37 pm.
