AN ORDINANCE AMENDING ORDINANCE NO. 1998- 219
(ZONING ORDINANCE) OF THE 'MUNICIPAL CODE OF TIFFIN,
IOWA REGARDING FIRST FLOOR APARTMENTS IN COMMERCIAL
ZONES
BE IT ORDAINED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1 . Purpose : The purpose of this ordinance is
to amend City of Tiffin .Ordinance No. 1998- 21? Section
5 . 10 and 5 . 07 regarding first floor apartments in
commercial zones .
Section 2 . Amendment . City of Tiffin Ordinance No.
1998- ?17 , Section 5 . 10 is hereby amended by adding the
following thereunder as Paragraph M:
M. First Floor Apartments in
Commercial Zones
:, First floor apartments are permitted in
commercial zones when the residential
dwelling space is separated from the
frontage by no less than 20 (twenty)
feet of enclosed all-weather structure
suitable for commercial uses .
Accessways and hallways connecting the
first floor ' apartment to the frontage
are permitted.
Section 3 . Amendment : City of Tiffin Ordinance No.
1998- 217 Section 5 . 07 . F. l .r. is hereby deleted.
Section 4 . Amendment : City of Tiffin Ordinance No.
1998- 217 Section 5 . 07 . F. 1 . (a) is repealed and the
following is submitted in lieu thereof :
(a) First floor apartments permitted if
in compliance with Section 5 . 10 .M.
Section 5 . Amendment : City of Tiffin Ordinance No.
1998 917 Section 5 . 07 .G. 1 . (a) is repealed and the
following is submitted' in lieu thereof : -
(a) First floor apartments permitted if .
in compliance with Section 5 . 10 .M.

Section 6 . Amendment : City of Tiffin Ordinance No.
1998- 219 Section 5 . 07 .H. 1 . (a) is repealed and the
following is submitted in lieu thereof :
(a) First floor apartments permitted if
in compliance with Section 5 . 10 .M.
Section 7 . Repealer. All ordinances or parts of
ordinances in conflict with the provisions of this
Ordinance are hereby repealed.
Section 8 . Severability. If any section, provision, or
part of this ordinance shall be adjudged to be invalid or
unconstitutional, such adjudication shall not affect the
validity of .the ordinance as a whole, or any section,
provision, or part thereof not adjudged invalid or
unconstitutional .
Sections9 . Effective Date . This ordinance shall be in
effect after its final ' passage, approval , and, posting as
provided by law.
On the _8th day of July 1998, at a regular meeting
of the Tiffin City Council , Tiffin, Iowa, Councilperson
Walls introduced Ordinance No. 1998-220 , and
moved that it be given its first reading. The motion was
seconded by Councilperson Kern
Ayes : Walls, Kern and Bartels
Nayes • None. Absent: Gericke and Ryan
Three members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared the motion carried,
and Ordinance No. 1998-22o , was read the first time and
discussed and placed on record.
Thereupon, it was moved b'' Councilperson
Ryan and seconded by Councilperson
Walls on the 12th of August, 1998 that the laws and rules
providing that ordinances be considered and voted on for
passage at two council meetings prior to the meeting at
which it is to 'be finally passed be suspended and dispensed
with and that Ordinance No. 1998-220 be placed on its
last reading.

Ayes : Walls , Gericke, and Ryan
Nayes : None. Absent : Bartels , and Kern .
Three members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared the motion carried,
and Ordinance No. 1998-220 , was then placed on its last
reading and was read the last time .
Thereupon,, it was moved by Councilperson
Walls and seconded by Councilperson
Ryan that Ordinance No.
1998-2 . be placed upon its final passage and adopted.
Ayes : Walls , Gericke, and Ryan
Nayes : None . Absent : Kern, and Bartels
Three members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared the motion carried,
and the ordinance was passed and adopted.
3t Whereupon the mayor declared that Ordinance No.
1998-220 be adopted and signified his approval of
}'' same by fixing his signature thereto.
Passed by the council on the 12th day of
August 1998 and approved by the mayor on the
12th day of August 1998 . ,

I, Clerk of the City of Tiffin, Iowa, state that an
ordinance entitled: AN ORDINANCE AMENDING ORDINANCE NO.
1998-2.19 (ZONING ORDINANCE) OF THE MUNICIPAL CODE OF
TIFFIN, IOWA REGARDING FIRST FLOOR ,APARTMENTS IN COMMERCIAL
ZONES and known as No. 1998-220 was duly passed by the
council on the 12th day of August 1998, and
signed by the mayor on the 12th day of August 1996,
and published on the 15th day of August 1996, by

posting copies thereof in three public places within the
limits of the City of Tiffin, Iowa.
