RSSOLUTION NO. 98-59
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD DETERMINING THAT A NUISANCE IS BEING
MAINTAINED ON CERTAIN PROPERTY, COMMONLY RNOWN AS
5419 MACMILLAN AVENUE, IDENTIFIED AS TAX ASSESSOR'S
BOOK NO. 6188, PAGE 025, LOT 029, IN THE CITY OF
LYNWOOD AND DIRECTING THE ABATEMENT THEREOF
' WHEREAS, pursuant to the recommendation of the City Manager of the City of Lynwood,
and Staff, the conditions at the site have proven to be an imminent perit to life or adjacent property; and
WHEREAS, it has been documented that this site has heavily impacted the City's resources
due to the excessive amount of enforcement required in trying to bring this site into compliance; and
WHEREAS, this Council has held a hearing and has heazd and considered all relevant
evidence and testimony from all interested persons desiring to be heard concerning the conditions constituting the
alleged nuisance and the proposed abatement.
NOW, THEREFORE, the City Council of the Ciry of Lynwood does hereby find, determine,
order and resolve as follows:
Section 1. The property d:scribed as Tax Assessor's Book No. 6188, Page 025, Lot
029, also known as 5419 McMillan Avenue, in the Ciry of Lynwood, Califomia, is hereby found and declazed to be a
public nuisance as defined in Chapter 3-13.1 of the Lynwood Ciry Code.
Section 2. The particular conditions of said property which are hereby found and
determined to constitute a nuisance are described as Follows:
1. Vacant house with junk, trash and debris scattered throughout.
2. Massive overgrown vegetation throughout the property and pazkway.
, 3. Property left unsecured thus inviting trespassers and unwanted guests.
4. Abandoned trailer in rear yard in an unpaved area.
ti n. It is further found and determined that the methods by which said
conditions could be abated include, but aze not limited to:
1. Upon obtaining an Entry and Abatemen[ Warrant for this site, remove and properly dispose all
junk, trash and debris, and overgrown vegetation and maintain site on a regulaz basis.
2. Propedy board and secure all points of entry.
3. Remove and properly dispose trailer in rear yazd.
Section 4. The owner of said property, Source One Mortgage Services, is ordered
and directed to take said steps and to abate said nuisance.
Section 5. If the property owner fails to take the steps as provided in this resolution
within five (5) days after the date this resolution is posted upon said property, the City of Lynwood shall immediately
cause the same to be abated by Ciry personnet or private contractor and such personcel or persons under contract aze
expressly authorized to enter upon the premises for such purposes.
Section 6. The Ciry Clerk is authorized and directed to post co~spicuousty at least
~ one copy of this Resolution on the subject property and to send another copy of this Resolution by registered or certified
mail, postage prepaid, return receipt requested, to the owner of said land as his name and address appeazs on the last
equalized assessment roll, or it known to the City Clerk.
The failure of any owner or other person to receive such notice shall not affect in any manner the
validity of any proceedings taken under.
Section 7. In the event the City of Lynwood causes the aforementioned nuisance to
be abated by City personnel or private conhactor, the owner of the premises shall be liable to said Ciry. All said costs
shall constitu[e a special assessment against the subject property upon approva] from CiTy Council.
THE CITY COLJNCIL hereby fixes the hour of 7:30 p.m, May 19, 1998 as the time and the City
Council Chambers, 11330 Bullis Road, as the place for a Cost Abatement Hearing.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Lynwood held
on the seventh day of April, 1998
