HomeMy Public PortalAboutOrdinances-1998-222 CITY OF TIFFIN ORDINANCE NO. 1998- 222 AN ORDINANCE AMENDING ORDINANCE NO. 1980-92 TO REQUIRE CUTTING OR DESTRUCTION WITHIN FIVE DAYS OF THE DATE OF NOTICE TO CURE. WHEREAS, the City of Tiffin has determined that it is necessary to establish a policy for the time reasonably necessary to cut or destroy noxious. weeds pursuant to notice, and the Council finding that the period of five (5) • days is such a .reasonable period; therefore BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: SECTION 1 : Amendment,. Section III , subsection (1) of Ordinance No. 1980-92 is hereby repealed, and in lieu thereof the following is enacted: 1 . An order to destroy or cut he weeds and growth shall state that the task shall be accomplished within five (5) days of the date of mailing of the notice to cure. SECTION 2 : Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. SECTION 3 : Severability. If any section, provision, or part of this Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional . On the 14th day of October 1998', at a regular/special meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 1998-222 , and moved that it be given its first reading. The motion was seconded by Councilperson Gericke . • - w Ayes: Gericke, Ryan, Kern and Walls . Nays: None . Absent : Bartels #1998-222 Page 2 ' Four members of the council being present and having voted "Aye" , Mayor Glenn R.;, Potter declared the motion carried, and Ordinance No. 1998-222 was read the first time and discussed and placed on record. Thereupon, it was moved by Councilperson Walls and seconded by Councilperson Ryan that the laws and rules providing that ordinances be' considered and voted -on for passage at two council meetings prior to the meeting at which it is to be finally passed be suspended and dispensed with and that Ordinance No. 1998-222 be placed on its last reading. Ayes : Walls, Kern, Gericke and Ryan - None. Absent: Bartels Nays : Four members of the council being present and having voted 1 "Aye" , Mayor Glenn R. Potter declared the motion carried, and Ordinance No. 1998-222 , was then placed on its last -1 reading and was read the last time. Thereupon, it was moved by Councilperson Ryan and seconded by Councilperson Gericke that Ordinance No. 1998-222 be placed upon its final passage and adopted. Ayes : Gericke, Walls, Ryan, and Kern. Nays None. Absent: Bartels Fourmembers of the council being present and having voted "Aye" , Mayor Glenn R. Potter declared the motion carried, • and the ordinance was passed and adopted. Whereupon the mayor declared that Ordinance No. 1998-222 be adopted and signified his approval . of same by fixing his signature thereto. Passed by the council on the 14th day of October 1997 , and approved by the mayor on the 14th day of October 1997 . GLENN R.
