RIVERDALE CITY COUNCIL AGENDA
PLACE: Riverdale City Hall, 110 Manor Drive, Riverdale, Iowa
DATE: April 25, 2023 TIME: 7:00 p.m.
The regular meeting of the City Council of Riverdale, Iowa, will be conducted according to the following order
and actions will be considered on the items listed. The notice of this meeting is not considered final until 24
hours prior to the meeting and may be further modified if 24 hours’ notice is impossible or impractical for good
cause.
In compliance with the Americans with Disabilities Act (ADA) and other applicable federal and state laws, all
public hearings and meetings held or sponsored by the City of Riverdale, Iowa, will be accessible to individuals
with disabilities. Persons requiring auxiliary aids and services should contact City Hall at (563) 355-2511 five days
prior to the hearing or meeting to advise of their anticipated attendance.
The requirement that an Ordinance be read three times before passage may be waived by council upon an
affirmative vote of four (4) of the five (5) council members. The public is advised to take note of this process and
be prepared to speak either for or against any ordinance at the time of the first reading.
Per Chapter 21 of the Iowa Code, more specifically described in sections 21.3 and 21.8, a member of the Council
may attend the meeting either in-person or by electronic means, as defined in said sections.

Per Iowa Code 21.7, this governmental body makes and enforces reasonable rules for the conduct of its
meetings to assure meetings are orderly, and free from interference or interruption by spectators.
The public is encouraged to provide insights on the proposed agenda and other items of concern. Public
comment time is limited to three (3) minutes per speaker. Speakers will introduce themselves, their
topic(s) concern, and provide their address for the record. Public comments do not need to be in support
of proposed actions but are to be constructive and respectful. A lack of decorum will result in the end of
the comment period and possible removal from the meeting. All members of council, the public, and staff
are encouraged to find ways to effect positive change in their comments and their actions for the
betterment of our community.

April 10 – April 21, 2023
Sewer Billing: A lot of my time has been spent assisting residents with sewer bill questions, processing
payments, bank runs, adjusting errors on the billing, etc. This follows the same pattern as the previous
billing quarter that I have been here for. I assume this will significantly taper off in the next 2 weeks as
the due date passes.
Fall Fest: I have been reaching out to individual food trucks, as well as to the Iowa Food Truck Alliance,
to try and secure 2 or 3 food trucks for our Fall Fest. I have reached out multiple times and have not
heard back from most of the trucks. The few I heard back from are already booked. Our backup plan for
Fall Fest will be Hy-Vee. I will contact them at the end of April if I am not able to reach any food trucks
for this event.
PVHS Service Learning: There is a student currently working on his hours by cleaning up trash in public
areas of Riverdale. If you have seen any areas that need some attention, please let me know so I can give
him the areas to look at. He is currently working behind City Hall and in the woods around Woods
Estates. His time frame for these hours ends on May 1 so let me know asap if you have somewhere in
mind.
Apparel: This task should be completed by the 5/9/23 meeting. Stay tuned.
Normal/ Other Tasks: Accounts payable/cutting checks, assisting residents with any needs they bring to
my attention, room rentals, working on the newsletter, disassembling council packets after the meeting,
and other tasks delegated to me.
Some of my upcoming goals: Shred Event preparation. Our shred event is 4/29 and I am going
through documents to see what can be shredded and what needs to be saved. This is a tedious task that
requires a lot of attention to detail. We have another event in October, which is ideal as I am not certain
this task will be 100% completed by Saturday 4/29.

SANITARY SEWER REHABILITATION – PHASE 3
MSA has permission from Arconic to remove trees in the woods adjacent to Mr. Bawden’s
Driveway. Operations Manager, Brian Ballard, has received a quote to remove the brush and
trees.
MSA is seeking price quotes to televise the sanitary sewers that are part of the Phase 3 Sanitary
Sewer Rehabilitation Project. Request for price quotes were sent to Kline and Visu-Sewer. Price
quotes should be submitted at any day now.
CITY HALL PARKING LOTS
The bid opening for this project was held on April 20, 2023. No bidders submitted bids. MSA
reached out to two Contractors who had taken out plans for bidding. They both indicated there is
so much work being bid right now. The other issue the Contractors indicated was waiting until
July 4 to start work..
MSA suggests the project be rebid near the middle of June. However, the City will need to
coordinate there next bid effort with room rental so that there is ideally not a delayed start once
awarded.
SCOTT COMMUNITY COLLEGE ADDITIONS
MSA inspects this construction on a periodic basis. No erosion items of concern were noted
during the last site visit.

WHEREAS, the City of Riverdale, Iowa ("City") is a municipal corporation, organized and operating under
the laws of the State of Iowa; and,
WHEREAS, City is interested in pursuing a Highway Corridor Overlay District (HCOD) real estate analysis
for the State Street/Highway 67 corridor; and,
WHEREAS, DiSalvo Development Advisors, LLC, has proposed an agreement that includes the following
tasks:

• Key stakeholder discussions/interviews (in-person, when possible, over two-day period)

DDA is pleased to submit a proposal to identify real estate opportunities along Riverdale’s State
Street/Hwy 67 corridor. Based on our review of parcel ownership along the corridor, we envision
the focus of the corridor analysis will be of properties currently owned by Arconic [Davenport,
LLC] and Woods Construction & Development, Incorporated, subject to change by the client.
We recommend a phase one assessment to preliminarily identify potential development

WHEREAS, the City of Riverdale ("City") does not currently have a policy regarding when and how its
flags are lowered to half-staff; and,
WHEREAS, the City Council wishes to memorialize current practices and establish a protocol consistent
with state and federal law; and,
WHEREAS, the City Council has reviewed the attached United States of America, State of Iowa, City of
Riverdale, and Riverdale Fire Department Flag Half-Staff Standard Operating Guidelines; and,
WHEREAS, there is no funding source required for this action.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, IOWA,
THAT:
SECTION 1: The attached United States of America, State of Iowa, City of Riverdale, and Riverdale Fire
Department Flag Half-Staff Standard Operating Guidelines is hereby approved and
adopted.
SECTION 2: Severability: If any section, paragraph, sentence, clause, or phrase of this resolution, or its
application to any person or situation, be declared unconstitutional or otherwise invalid for
any reason, or should any portion of this ordinance be pre-empted by state or federal law
or regulation, such decision or preemption shall not affect the validity of the remaining

of the City of Riverdale hereby declares that it would have adopted this resolution and each

SECTION 3: Corrections: Upon the approval of the city attorney, the city clerk and the codifiers of this

SECTION 4: Ratification: Any act consistent with the authority and prior to the effective date of this

staff. If the City of Riverdale Flag is at half-staff, the Riverdale Fire Department flag will be at
half staff based upon recognized flag etiquette standards.
When can the Mayor of the City of Riverdale order the City of Riverdale and Riverdale Fire
Department flags at half-staff and what is the timeframe for half-staff?
1. When a current or retired City of Riverdale Fire Chief passes away.
• City of Riverdale Fire Chief or next in command will notify the Mayor of the City of

chapter.
SECTION 2. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a
whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval,

47.08 Restricted Activities
47.01 PURPOSE. The purpose of this chapter is to facilitate the enjoyment of park facilities by the general
public by establishing rules and regulations governing the use of park facilities.
(Code of Iowa, Sec. 364.12)
47.02 DEFINITIONS. For use within this chapter the following terms are defined:
1. “City park” means any publicly owned outdoor park, playground, seating area, shelter
gazebo, or other structure, and any restroom or parking areas associated with these areas.
2. “Electronic smoking device” means any device, including but not limited to, e-cigarettes, e-
pens, e-hookah, e-cigars, and vape pens used to vaporize plant material, liquids, oils, nicotine, or
other chemicals that may be inhaled by users.
3. “Motor vehicle” means a snowmobile, minibike, motorized skateboards, motorbikes,
motorcycles, all-terrain vehicles (ATVs), utility-terrain vehicles (UTVs), cars, trucks, golf carts, or
similar type transportation equipment.
4. “Smoking” means inhaling or exhaling from any lighted or heater pipe, cigar, cigarette, or
any other lighted or heated tobacco, plant material, liquid, oils, nicotine, or other chemicals that
may be inhaled or exhaled by the user.
5. “Vapor product” means any noncombustible product, which may or may not contain
nicotine, that employs a heating element, power source, electronic circuit, or other electronic,
chemical, or mechanical means, regardless of shape or size, that can be used to produce vapor from
a solution or other substance, including an electronic cigarette, electronic cigar, electronic cigarillo,
electronic pipe, or similar product or device, and any cartridge or other container of a solution or

other substance, which may or may not contain nicotine, that is intended to be used with or in an
electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or similar product or device.

47.03 USE OF MOTOR VEHICLES. The following regulations shall apply to the use of vehicles within the
City parks:
1. Operation. Motor vehicles shall not be operated on trails, paths, or park grounds not
specifically dedicated for and authorized for use by motor vehicles with the following exceptions:
A. Motor vehicles shall be allowed to operate in designated park parking areas and
park driveways designed for and provided for motor vehicle use.
B. This section shall not apply to motor vehicles owned and operated by City staff and
authorized City contractors.
2. Parking of Motor Vehicles.
A. Motor vehicles shall not be parked in areas of a City park except in designated
parking lots or areas. Motor vehicles that are parked in a location other than a designated
parking lor or area may be ticketed or towed and the cost of which shall be the responsibility
of the motor vehicle owner prior to the release of the motor vehicle.
B. Motor vehicles shall not be left parked in designed areas of the park after the City
park is closed. Motor vehicles left in violation of this paragraph may be ticketed or towed
and the cost of which shall be the responsibility of the motor vehicle owner prior to the
release of the motor vehicle.
C. Overnight Parking. No motor vehicle shall be allowed to be left in designated
parking areas or within a City park overnight. Motor vehicles left in a City park overnight
may be ticketed or towed and the cost of which shall be the responsibility of the motor
vehicle owner prior to the release of the motor vehicle.
D. The City may approve temporary parking areas within the City parks for special
events or programs. In cases where special temporary parking is approved the area shall
be appropriately signed.
3. Speed Limit. No motor vehicle shall travel in excess of 15 MPH on any City park road or
parking area. The speed limit for City parks shall be posted at each park entrance that includes a
roadway.
47.04 BICYCLES. No bicycle shall be ridden or parked on any playground safety surface area within a
City park.
47.05 FIRES.
1. No fires shall be built, for any purpose, except in designated receptacles provided therefor,
and such fire shall be extinguished before leaving the area unless it is to be immediately used by
some other party.
2. A fire shall be considered “extinguished” the ashes, residue, coals, and unburned substances
are cold to the human touch.
3. No fire shall be left unattended.

4. The City may, by written permission only, allow a controlled burn of any forest, brushland,
grassland, meadow, prairie, marsh, refuse, container, or structure by an authorized and trained
individual or group.
47.06 TRASH DISPOSAL.
1. No person shall place, deposit, or throw any waste, refuse, litter or foreign substance in any
area or receptacle except those provided for that purpose.
2. Littering. No person shall throw or deposit on any City park grounds any glass bottles, glass,
nails, tacks, wires, cans, trash, garbage, rubbish, litter, or any other debris or substance likely to inure
any person, animal, or vehicle.
3. Yard Waste. No person shall place in any trash receptacle or in any City park, yard waste as
defined in Section 105.06 of this Code of Ordinances.
47.07 PARK HOURS. All parks shall be open from sunrise to sunset each day and shall be closed from
sunset to sunrise, unless an activity is a regularly scheduled activity or otherwise approved by the City in
writing. No person shall remain in a City park except with the permission of the City when a park is closed.
47.08 RESTRICTED ACTIVITIES. The following activities are restricted or prohibited within the City parks
unless expressly granted permission by the City:
1. Camping.
2. Golfing.
3. Trapping wild animals.
4. Swimming.
5. Fishing.
6. Carrying of a firearm, air gun, or bow and arrow.
47.09 ANIMALS. The following regulations apply to the us of City parks by person with pets and other
animals:
1. All pets must be on a leash while in the City parks.
2. Every person owning or having custody of an animal in the City parks shall immediately
clean up and remove feces deposited by such animals and dispose of in a sanitary manner.
3. No person shall taunt, injure, hunt, pursue, or take any wild animal, bird, or game.
4. No person shall ride any horse, mule, or any other animal in any City park unless granted
specific written permission by the City.
47.10 USE OF AIR SPACE.
1. Drones and Model Aircraft. No person shall fly, operate, use, or control any power-driven
model aircraft or drone except when authorized by the City.
2. Hot Air Balloons, Airplanes, Gliders, and Helicopters. No person shall operate, land, or
launch a hot air balloon, airplane, glider, hang glider, or helicopter from a City park unless expressly
permitted by the City.

47.11 FIREWORKS. The use of fireworks within a City park is expressly prohibited.
47.12 VANDALISM. No person shall damage, destroy, deface, or remove any signage, equipment,
building, structure, tree, vegetation, or machines owned or under the control of the City.
47.13 ALCOHOLIC BEVERAGES. No consumption of any alcohol or alcoholic beverages shall be allowed
with the City parks.
47.14 SMOKING AND VAPING. Smoking and the use of any electronic smoking device or vapor product
by any person in any City park is prohibited at all times. The use of FDA approved products for the purpose
of tobacco cessation are exempted from this section.
47.15 COMMERCIAL AND PROMTIONAL ACTIVITY. It is unlawful for any person to conduct any
promotional or commercial activity on any City park property without first obtaining permission from the
City and only in compliance with Chapter 122 of this Code of Ordinances. It is unlawful for any person to
place or cause to be placed advertising material on or in any structure, playground, pole, or other location
within a City park without the express permission of the City.
SECTION 2. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged
invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any
section, provision, or part thereof not adjudged invalid or unconstitutional.
SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval,
and publication as provided by law.
