HomeMy Public PortalAboutOrdinances-1998-224 CITY OF TIFFIN ORDINANCE NO . 1998 - 224 AN ORDINANCE ESTABLISHING MUNICIPAL INFRACTIONS FOR VIOLATIONS OF TIFFIN CITY ORDINANCES . BE IT ORDAINED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section 1 . Purpose : To enable the City of Tiffin with the legal remedies provided by Iowa Code Section 364 .22 "Municipal Infractions" Iowa Code (1997) , and to provide improved means of law enforcement thereby. Section 2 . Provisions : The provisions of Iowa Code Section 364 . 22 (1997) are hereby adopted by the City of Tiffin, Iowa, and are hereby made applicable to all city ordinances, now or hereafter adopted, to include a penalty provision that allows for imposition of a municipal infraction for each day of violation of the cause. This shall not be construed to prohibit the use of simple misdemeanor violations, but xit shall be construed as an additional remedy along side the imposition of the simple misdemeanor. The city may, at its sole discretion, elect which remedy to pursue, but the city may not pursue both remedies for a single violation. Unless otherwise altered by amendment to the Iowa Code Section 364 . 22, all municipal infractions for each day of violation shall constitute a civil offense punishable by a civil penalty of not more than $200 for, each violation, or if it is a repeat offense, civil penalty not to exceed $750 for each repeat offense. Section 3 . 'Authorized Officers : The following officers are hereby authorized by the City of Tiffin to file municipal infractions when on good faith belief they have determined that a violation has occurred: Mayor, City Clerk, City Engineer, City Planner, and Director of Public Works . Section 4 . Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Ordinance 1998-224 Page 2 Section 5 . Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional , such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional . Section 6 . Effective Date . This ordinance shall be in effect after its final passage, approval , and posting as provided by law. On the 11th day of November 1998, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Walls introduced Ordinance No. 1998-224 , and moved that it be given its first' reading. The motion was seconded by Councilperson Gericke f I Ayes: Gericke, Ryan, Walls , and Bartels . None. Absent: Kern Nayes : .x, Four members of the council being present and having voted -r. "Aye" , Mayor Glenn R. Potter declared the motion carried, and Ordinance No. 1998-224 , was read the first time and J discussed and placed on record. On the 11th day of November 1998, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 1998-224 , and moved that it be given its second reading. The motion was seconded by Councilperson Bartels Ayes: Gericke, Walls , Bartels and Ryan. None. Absent : Kern Nayes : Four members of the council being present and having voted "Aye" , Mayor Glenn R. Potter declared the motion carried, and Ordinance No. 1998-224 , was read the second time and discussed and placed on record. On the 11th day of November 1998 , at a regular meeting of the Tiffin City Council , Tiffin, Iowa, Councilperson Gericke introduced Ordinance No. 1998-224 , and moved that it be given its third and last reading. The motion was seconded by Councilperson Bartels Ordinance # 1998-224 Page 3 - Ayes: Gericke, Walls, Ryan, and Bartels 1 Nayes : None. Absent: Kern 1. r Four members of the council being present and having voted "Aye" , Mayor Glenn R. Potter declared the motion carried, and Ordinance No. 1998-224 , was then placed on its last reading and was read the last time. 1 Thereupon, it was moved by Councilperson Gericke and seconded by Councilperson Bartels that Ordinance No. 1998-224 be placed upon its final passage and adopted. Ayes: Gericke, Walls , Ryan and Bartels 1 Nayes : None. Absent: Kern I Four members of the council being present and having voted "Aye" , Mayor Glenn R. Potter declared the motion carried, and the ordinance was passed and adopted. Whereupon the mayor declared that Ordinance No. 1998-224 be adopted and signified his approval lof same by fixing his signature thereto.
