Call to Order The meeting of the Riverside County Transportation Commission (RCTC) Technical Advisory Committee (TAC) was called to order at 10:05 A.M., at Riverside County Transportation Commission, 4080 Lemon Street, Riverside, CA 92501. 2. APPROVAL OF MINUTES Dave Barakian, City of Palm Springs, requested that the February 8, 2010 minutes be revised to reflect the change in item 9 from "I-10 Indian, obligated and the award will occur in March" to "I-10 Indian, authorization to bid will occur in March and the award will occur in June." Following that change, the minutes were approved as submitted. 4. PUBLIC COMMENTS There were no public comments. 5. ELECTION OF OFFICERS Shirley Medina, RCTC, stated that there is a two year term for election of TAC officers - one representative from the Western County and one from the Eastern County. Mike Gow, City of Hemet, was unanimously nominated and elected as the Chair for the Western County; Tim Jonasson, City of La Quinta, was unanimously nominated and elected as the Vice Chair for the Eastern County. 6. FEDERAL AND STATE LEGISLATIVE UPDATE Shirley Medina reported that currently the focus is on health care and new concerns over deficit spending; therefore, stalling stimulus 2 (or ARRA II). Without an increase in revenue or .cutting other programs, new spending for transportation will continue to face challenges. Regarding the SAFETEA-LU extension, Congress is in the process of passing a. nine month extension to get us through the end of the fiscal year so that we don't have to rely on continuing resolutions on a month -to -month basis. The funding levels continue to be flat but getting a nine month extension will help to get stability on the federal side. At the state level, there is a proposed sales/gas tax swap legislation that if approved, would provide a stable source of modest state support for the STIP and SHOPP. Transit is adversely impacted and the Proposition 42 and lA protections are no longer in place. The next state bond sale intends to provide funding for CMIA and TCIF; these projects will continue to be funded as well as other projects currently in the STIP, as long as there is a bond sale. It is not known when the bond sale will take place; it sounds like it would be during the month of March 2010. It is not known what level of transportation funding will be included in the bond sale. 7. LOCAL ASSISTANCE REPORT - RESTRUCTURING Bill Mosby, Caltrans Local Assistance, provided a 2010 training calendar and a list of Local Assistance re -structuring contact list. He introduced five of the contacts: Savat Technical Advisory Committee Meeting March 15, 2010 Page 3 Khamphou (new DLAE), Sylvester Lin, Henry Lam, Albert Vergel de Dios and Harish Rastogi, and explained the rationale behind the restructuring and responded to various questions. 8. FY 2009/10 DELIVERY AND OBLIGATION PLAN Shirley Medina provided a March 15, 2010 Draft FFY 09/10 Delivery -Obligation Plan and stated that each year a delivery plan needs to be submitted for the remainder of the federal fiscal year that shows the STP delivery and the CMAQ delivery from this point forward. She further pointed out that if jurisdictions have projects that will be delayed (obligated next federal fiscal year), staff should be advised as soon as possible so that staff can revise the plan before the April 1, 2010 submittal date. 9. MOE UPDATE Ms. Medina provided. a FY 2008/09 Construction and Maintenance Expenditures document and stated that staff has been working with the TAC subcommittee to develop the Maintenance of Effort base year levels for each city for the 2009-39 measure extension. She stated that with the assistance of the subcommittee's finance staff, a new way to report construction and maintenance has been developed. She indicated that she will send an e-mail to the TAC requesting that TAC members and their respective finance staff work together on an exercise to determine if the new method works using their FY 2008/09 budgets. Shirley Medina will send an e-mail to the TAC regarding the 2009 Measure A local streets and roads MOE base year/reporting exercise and Theresia Trevino, RCTC's Chief Financial Officer, will request that information from the finance directors in Riverside County. 10. 2008 RTIP UPDATE Grace Alvarez, RCTC, reported that Caltrans approval for the 2008 RTIP Amendment No. 33 was secured on February 24, and that FHWA approval is pending. Regarding the 2008 RTP A-3 and the associated 2008 RTIP A-34, the 30-day public review and comment period started on these two documents on February 18 and will end on March 19. RCTC provided comments to SCAG on February 26. Once the public review comment period ends, on March 19, SCAG will finalize the documents and will forward to the funding agencies for approval with anticipated approval in the April/May 2010 timeframe. She further reported that Administrative Modification No. 38, including four emergency projects, was submitted to SCAG on February 16. Approval of 08-38 was secured by Caltrans on February 17. Technical Advisory Committee Meeting March 15, 2010 Page 4 Staff is currently working on two emergency amendments, Administrative Modification #40 and formal amendment No. 41, due to SCAG on Friday, March 19. 11. 2011 FTIP UPDATE Ms. Alvarez stated that regarding the 2011 FTIP, SCAG is currently reviewing the submittals and RCTC has responded to the initial inquiries by SCAG reviewers. The inquiries have been minor in nature. Approval of the 2011 FTIP is anticipated for December 2010. 12. MORENO VALLEY STP REPROGRAMMING REQUEST Shirley Medina reported that, based on the substitution policy for federal funds (STP/CMAQ), the city of Moreno Valley is requesting the reprogramming of STP funds from Reche Vista Realignment to the SR60/Nason Street IC (the RFA is currently at Caltrans ready to go headquarters). Moving federal funds to another federal project previously approved by the Commission is consistent with what other agencies have done in the past and consistent with RCTC's substitution policy. Ms. Medina stated that staff recommends approval of this request. M/S/C (Motlagh/Boyd) to approve the request of the city of Moreno Valley to reprogram funds from the Reche Vista Realignment and Signal Install project to the SR-60/Nason Interchange improvement project. 13. COMMISSION MEETING HIGHLIGHTS Anne Mayer, RCTC, reported that on the March Commission agenda the Commission's policies and objectives for next year's budget were reviewed and approved. The primary focus is getting programs and projects delivered, seeking additional funding, working regionally and locally to keep projects moving. There were no significant changes. The Commission also took action on establishing priorities for "Jobs Bill." If there is such a bill, RCTC is advocating that the 90-day tumaround to award be changed to 120 days. Staff requested that the Commission proactively establish the priorities in case something happened between Commission meetings. The Commission priorities are 1) current STIP projects; 2) projects on the state highway system; and 3) local road projects. STIP projects that will be ready to go are the East Junction, Date Palm/I-10, and California Oaks/215 IC, which will be ready in the next six months. 14. Respectfully submitted, mo_dt:Lit Shirley Medina Programming and Planning Manager AGENDA ITEM 5 RIVERSIDE COUNTY TRANSPORTATION COMMISSION DATE: April 19, 2010 TO: Technical Advisory Committee FROM: Shirley Medina, Programming and Planning Manager SUBJECT: April California Transportation Commission (CTC) Actions STAFF RECOMMENDATION: This item is for the TAC to receive and file a report on the April CTC Actions. BACKGROUND INFORMATION: The April 7-8, .2010 CTC meeting was a significant meeting in regards to a report from Caltrans and CTC staff indicating that there has been significant savings due to low bids that will enable the CTC to allocate projects at next month's CTC meeting. In addition, RCTC's application for design build of the SR 91 Corridor Improvement Project (CIP)/Express lanes was approved. STIP Allocations — At the January 2010 CTC meeting, the CTC .depleted the STIP allocation capacity for fiscal year 2009/2010. At the February CTC meeting, the 1-10 Date Palm interchange project was placed on the "unallocated" list that totaled over $700 million worth of projects. In addition, the 1-15 California Oaks interchange was also placed on the unallocated list on the April CTC meeting agenda. At the April 7-8, 2010 CTC meeting, Caltrans and CTC staff reported that due to cost savings on state federal projects, $620 million would be available for allocation for SHOPP and STIP projects. The Caltrans and CTC staff recommendation was to divide these funds among the SHOPP and STIP projects that were ready to advertise and obligate the funds by August 1, 2010, and bring back a list of projects that meet the criteria for allocating these funds at the May CTC meeting. Caltrans has begun identifying projects to be allocated in May and the 1-10 Date Palm and 1- 15 California Oaks interchange projects have been included on the list along with the SR- 60/1-215 East Junction project. A STIP allocation in May for these three projects will result in approximately $55 million in STIP funding that, as of last week, would have been delayed further until other funding could be identified. SR 91 Corridor Improvement Project (CIP) Design Build Application — After a lengthy discussion, the CTC unanimously approved RCTC's Design Build application for the SR-91 Corridor Improvement Project that includes extending the toll lanes from the Orange County line into Riverside. The initial CTC staff recommendation denied approval of the design build application basing their recommendation on their interpretation of the legislation that local agencies do not have the authority to be the lead agency on a state highway project. Caltrans and RCTC's interpretation of the legislation was that RCTC did have the authority to be the lead agency. RCTC's case was bolstered by a letter from Senator Cogdill, author of the original design -build legislation, stating that projects such as RCTC's were the kind of projects intended for support with his legislation. Anne Mayer, RCTC Executive Director, gave an outstanding presentation discussing the merits and importance of this project. Assemblymen Miller and Commissioner Pettis also testified in support of the project. Other supporters included Commissioner Spiegel, Assemblyman Jeffries, OCTA, LA Metro, American Consulting Engineers Council, and members of the Operating Engineers and Laborers Union dressed in orange shirts and hard hats. CTC Commissioner Tavaglioni forwarded the motion of support that resulted in a unanimous vote approving RCTC's design build application and resounding applause from the audience. There was another design build application that was approved by the CTC at the same meeting. The Los Angeles Metropolitan Transportation Authority and Ca!trans jointly submitted a design build application for express lanes on I-10 and 1-110. AGENDA ITEM 6 RIVERSIDE COUNTY TRANSPORTATION COMMISSION DATE: April 19, 2010 TO: Technical Advisory Committee FROM: Shirley Medina, Programming and Planning Manager SUBJECT: American Recovery and Reinvestment Act (ARRA) Update STAFF RECOMMENDATION: This item is for the TAC to receive and file a report on the ARRA Update. BACKGROUND INFORMATION: Riverside County obligated 100% of its ARRA highway funding. ARRA reporting is done on a monthly basis and funds could be jeopardized if the reports are not submitted in a timely manner, or if invoices have not been submitted and paid within a year of obligation. As with regular or non-ARRA federal funds, such as STP and CMAQ, FHWA is maintaining an "Inactive" list. The first Inactive list was distributed at the April CTC meeting, which identified 86 projects in California that had not submitted an invoice or closed out the project. None of the 86 projects were in Riverside County. However, most of the projects on the Inactive list were obligated last June and most of the Riverside County projects were obligated July through December. It is important to remind ARRA project sponsors to invoice at least once every six months to prevent the ARRA project(s) from being included on the Inactive list. The table below is an update of the awards on the ARRA projects. AGENDA ITEM 7 RIVERSIDE COUNTY TRANSPORTATION COMMISSION DATE: April 19, 2010 TO: Technical Advisory Committee FROM: Shirley Medina, Programming and Planning Manager SUBJECT: Measure A 2009 Maintenance of Effort (MOE) Base Year Development Exercise STAFF RECOMMENDATION: This item is for the TAC to discuss the proposed MOE Base Year development for the 2009- 2039 Measure A program. BACKGROUND INFORMATION: On March 24, 2010, TAC members received a request to complete the 2009 MOE Base Year Exercise. A TAC subcommittee has been working on the development of a new MOE Base Year methodology to determine the MOE Base Year and reporting process for the 2009-2039 Measure A program. The exercise was to see if the new reporting method (excel template) was easy to follow and complete. In addition, the method for calculating the MOE Base Year for cities to meet in future cities would also be a resultant of this exercise. We are fully aware of the financial crisis that cities have been facing over the last two years and that meeting the MOE requirement will be very difficult for cities as their budgets continue to be cut. We are discussing ways to provide cities relief if they cannot meet their MOE due to extreme financial conditions. However, we need to ensure that Measure A requirements are being met. The completion of the MOE exercise will provide staff the information needed to develop a method that ensures that the local agencies are maintaining their level of discretionary spending, identifies a reasonable MOE base year for each city, and can be audited in a reliable yet simpler manner. AGENDA ITEM 8 RIVERSIDE COUNTY TRANSPORTATION COMMISSION DATE: April 19, 2010 TO: Technical Advisory Committee FROM: Shirley Medina, Programming and Planning Manager SUBJECT: Federal Fiscal Year 2009/10 Obligation -Delivery Plan STAFF RECOMMENDATION: This item is for the TAC to receive and file the FFY 2009/10 Obligation -Delivery Plan. BACKGROUND INFORMATION: Attached is the FFY 2009/10 Obligation -Delivery Plan. The plan will be monitored weekly to determine if projects have been submitted for obligation on the date that was provided. Staff will work closely with District 8 Local Assistance and the local agencies to ensure projects can be delivered on time. If it is determined that a project cannot be delivered in FFY 2009/10, staff will review the impact of moving the project to FFY 2010/11 or beyond. There are many projects that will be delivered next fiscal year and Riverside County as a whole receives a set amount of federal funds to obligate each year. If more funds are needed, RCTC will need to enter into agreements with other regions to borrow funds. There are certain restrictions and requirements that come into play when regions under deliver (obligate less than they receive) or over deliver (obligate more than they receive) within a given year. Therefore, it is imperative that the local agency inform RCTC as soon as they are aware of a change in the project schedule. Amendment No. 33 was approved by Federal Highway Administration (FHWA) on March 17th. 2008 RTP Amendment No. 3 and 2008 FTIP Amendment No. 34 - The public review and comment period for Amendment #3 to the 2008 RTP and the associated Amendment 08-34 to the 2008 FTIP ends on April 1911. The Southern Califomia Association of Govemments (SCAG) is currently analyzing projects for conformity. The next steps of the review/approval process of the 2011 FTIP and the associated timelines are as follows: ]an 25 — May 3, 2010 SCAG staff will work with Ca!trans and the County Commissions to analyze the project submittals, to ensure: • Project consistency with the RTP - Completed • Identification of modeled projects - Completed • Project conformity - Underway • Financial Constraint • Programmatic analysis • Modeling details entered into the FTIP database March 8 — May 3, 2010 • Modeling and analytical work including timely implementation activities May 2010 • Modeling report due to FTIP section • Final draft write up and management review period • 2011 FTIP document reproduction June 2010 • Presentation of the 2011 FTIP to RTAC to fulfill AB 1246 requirement (Consultation with the California Transportation Commission and Caltrans) July 1, 2010 • Draft FTIP presented to Transportation Committee and Energy and Environmental Committee July 2010 • 30-day public review period July/August 2010 • Public Hearings September 2, 2010 • Transportation Committee October 2010 • Regional Council scheduled to adopt the 2011 FTIP • Adopted FTIP due to the state and federal agencies • Report transmitted to Caltrans, FHWA, FfA, EPA and upload to Caltrans CTIPS database December 2010 • Conformity determination approval by federal agencies AGENDA ITEM 12 A presentation will be made but there is no attachment to the agenda for item 12.
