A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD, CALIFORNIA AMENDING THE CITY'S
ENVIRONMENTAL QUALITY ACT GUIDELINES TO PROVIDE
FOR A "LAND USE ANALYSIS AND TRANSIT IMPACT REVIEW
PROGRAM" AS REQUIRED BY THE STATE MANDATED CONGESTION
MANAGEMENT PROGRAM.
'oVHEREAS, the California Environmental Quality Act of 1970
(Public Resources Code, Section 21000 et seq.) provides that
proiects carried out by local public agencies require an
identification and evaluation of environmental effects associated
with such projects; and
i-~lHEREAS, Section 21082 of the Public Resources Code requires
local public agencies to adopt procedures for the evaluation of
project environmental effects and preparation of Environmental
Impact. Reports and Negative Declarations pursuant to the California
Environmental Quality Act; and
9~HEREP.S, the Legislature of the State of California has found
that the lack of an integrated transportation system and the
increase in the number of vehicles are causing traffic congestion
tY~at each day results in hundred on thousands of hours lost in
traffic, tons of pollutants released into the air and millions of
de.Llars cf added costs to the motoring public; and
UiHEREAS, the Congestion Management Program (CMP) adopted on
November 1.8, 1992 by the Los Angeles County Transportation
Commiss.i.on (LACTC requires that each Environmental Impact Report
prepared by a local agency must assess project impacts on the
regional transportation system in a manner consistent with the
Transportation Impact Analysis (TIA) guidelines contained in the
CMP; and
YdHEREAS, the Land Use Analysis Program is designed to build on
the existing California Environmental Quality Act (CEQA) process in
identifying the impact of development on the CMP highway system;
an d
rsdHEREAS, specific procedures for consultation with transit
operators and use of CMP Transportation Impact Analysis guidelines
should be included in the City's Guidelines for the Implementation
of the California Environmental Quality Act of 1970, as amended;
NOVd THEREFORE THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBS" RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Lynwood does
find, determine and declare as follows:
A. That the City's California Environmental Quality Act
(CEQA) guidelines are amended by adding "Land Use
Analysis Program" to the guidelines. The Land Use
Analysis shall be conducted consistent with the
Transportation Impact Analysis (TIA) guidelines contained
in the most recent Congestion Management Program adopted
by the Los Angeles Metropolitan Transportation Authority.
The Land Use Analysis shall also include a review of
transit impacts as required in the CMP for every project
requiring an Environmental Impact Report.
SECTlODI 2. That the Guidelines of the City of Lynwood for
the Implementation of the California Environmental Quality Act of
1970, are amended as follows:
A. LAND USE ANALYSIS PROGRAM.
All development projects for which an Environmental
Impact Report (EIR) is required to be prepared shall be
subject to the Land Use Analysis Program contained in the
Los Angeles County Congestion Management Program (CMP),
and shall incorporate into the EIR an analysis of the
projects impacts on the regional transportation system.
Said analysis shall be conducted consistent with the
Transportation Impact Analysis (TIA) Guidelines contained
in the most recent Congestion Management Program adopted
by the Los Angeles County Metropolitan Transportation
Authority.
B. REVIEW OF TRANSIT IMPACTS
Prior to approval of any development project for which an
Environmental Impact Report (EIR) will be prepared
pursuant to the requirements of the California
Environmental Quality Act (CEQA) or based on a local
determination, regional and municipal fixed-route transit
operators providing service to the project shall be
identified and consulted with. Projects for which a
Notice of Preparation (NOP) for a Draft EIR has been
circulated pursuant to the provisions of CEQA prior to
the effective date of this ordinance shall be exempted
from its provisions. The "Transit Impact Review
.~orksheet), contained ir, the Los Angeles County
Congestion Management Program Manual, or similar
~;orksheets, shall be used in assessing impacts. Pursuant
to the provisions of CEQA, transit operators shall be
sent a NOP for all contemplated EIR's and shall, as part
of the NOP process, be given opportunity to comment on
the impacts of the project, to identify recommended
transit service or capital improvements which may be
required as result of the project, and to recommend
mitigation measures which minimize automobile trips on
the CMP network. Impacts and recommended mitigation
measures identified by the transit operator shall be
evaluated in the Draft Environmental Impact Report
prepared for the project. Related mitigation measures
adopted shall be monitored through the mitigation
monitoring requirements of CEQA.
Phased development projects, development project subject
to a development agreement, or development projects
requiring subsequent approvals, need not repeat this
process as long as no significant changes are made to the
project. It shall remain the discretion of the lead
agency to determine when a project is substantially the
same and therefore covered by a previous certified EIR.
SECTIO!\T 3'. That this resolution shall go into effect
immediately upon its adoption.
APPROVED and ADOPTED by the City Council of the City of
Lynwood this 20th day of April, 1993.
